    I doubt anything would come of it but I don't think it's morally dubious either (depending on your intent). Personally I'd see it as a way to spur them into action. I've done similar myself (wrong parcels delivered and charging for storage if they don't collect etc). It's just a way of making you of a sufficient problem for them that they then reach he decision it's in their best interest to resolve it as quickly as possible.

    I am surprised at the ICO's representative suggesting it though, I've no idea what the legality or official stance of the ICO on it is.

    a penalty charge would be illegal. the whole basis of our bank reclaims.

    until you recieve the data its not possible to ascertain if it has cost you anything.

    should it contain charges that would now be time barred for reclaiming this is a legitimate loss and im sure the Courts would uphold this as being a true loss. it would also be a cost for the time spent in chasing this matter at what you feel is a reasonable hourly rate plus expenses such as phone charges postage paper printer supplies etc.

    its disappointing to hear the data commissioner seems to be toothless

  • hi i have sent a letter to my bank asking them to send confirmation of all charges that was december 2007 as yet they have sent nothing this is more than 40days ago please can anyone advise me what to do next as you can see i am new to all this thanks
  • I have been trying to get a list of charges since last May. I put a written request in with a cheque that was cashed in June of last year. I have followed up with phone calls & letters & reported to Info commisioner last July but still haven't had the info I have requested & it's starting to drive me even more crackers than I already am. Can anyone give me some advice on what to do now please?:confused:

    they don't have to give you a list of charges if that doesn't already exist.

    did you request it under the DPA? If so, you should be getting copies of your statements, and then you go through and find the charges yourself.
  • yes requested though dpa, 1st request they said hadn't received although cheque cashed, 1st 2 phone calls got no response last call got a letter back saying " which dpa info? & send a cheque" which I wrote all over the back with the previous contact details a sent back to them. This was around 3moths ago & I've kinda given up on it now
  • try a letter to their complaints department, and chase up the information commissioner's office too.

    Not sure if this is for bank or credit card statements (sorry if you hve said - long day at work) but i requested a list of charges from A&L (through MBNA) for one of my credit cards on the 21st Jan 08, had a full list by 2nd Feb 08?!

    Haven't tried them for bank statements, or claiming PPI, as soon as i've gone through my credit crds i'll be doing the same with bank charges and PPI!
  • Cap1 have cashed my cheque but 2 wks later no statements yet... :confused:

    How long should I wait before nagging them again?
  • If you call them up they send them out for free. Just ask for your statements ever since the account has been opened and they will send them. I received mine within a few days.
