40 days and no info/statements

In an attempt to get my credit card fees back from N** W***, I sent them one of the template letters back at the end of January asking for details of my statements (so I can assess what charges they owe me) and the ten pound fee.
Since I was already complaining to them about the shabby way they'd treated me and generally ignored the banking code, I sent the letter by recorded delivery (and yes, I still have the slip).
I have heard nothing back from them and the 40 days in which to reply to the 'Data Protection' request has come and gone.
What's my next course of action ?
- A complaint to the Office Of The Information Commissioner ?
- A letter to Nat West's Head Of Compliance / Data Protection Officer ?
- Another letter going down the charging process (they've already 'lost' my bank charges one from last year, such is their efficency) route ?

Hi,
Was wondering if anyone could advice me, i sent a letter to my local halifax bank requesting them to tell me of all the bank charges i have had in the last 6years:
Letter example: (minus personal details)
.....................................
I request that Halifax provides me with details of all default charges for unauthorised overdrafts and unpaid direct debits and standing orders I have paid in the last six years.
I understand that Halifax is obliged to provide this information under the Data Protection Act 1998.
I look forward to hearing from you within 40 days.

And it is getting close to the 40days now and i have heard nothing! So my question is what do i do next?0 -
Hi I first asked Barclays bank for my bank statements on the 31st March 07 and I just couldnt get anyway with getting my bank statements. I was trying right up until they were put on hold and also I just felt I was never going to get them? I was phoning them every other week and just felt like I was being passed from pillar to post?
How do I go about asking them for them again? Do I say that I asked for them over a year ago or do I need to start right from the beginning?

is there a template letter anywhere for when you have not had a response after 40 days.
I sent 2 letters off to 2 different companies asking for copies of my charges and have heard nothing back from them
Just wondering if there is a template letter for this or what do i do next

It does say follow up with a phone call, which id rather not do i prefer things in writing.0 -

I am on hold on one case against the Cumberland BS (£2.5k) and am awaiting info requested 5/3/8 from Halifax. Whats my next step as they haven't sent the info....they confirmed reciept of my initial request?:beer:0

To clarify, the 40 days is taken from when the bank is deemed to have received your letter and cheque and is 40 straight days and not 40 working days.
If you have had no reply from your bank regarding your SAR request within their 40 day deadline you can try sending this letter by Rex_Mundi to your bank.

You can also and indeed should report the bank to the Information Commission, however as they are very busy handling these complaints they are sending out the complaints to the bank in batches on a monthly basis.

If you bank with Lloyds and HSBC you can download your statements online. Best advice is to camp on the doorstep of your local branch and/or phone HO/Customer Services/local branch daily until they get sick of you.
