40 days and no info/statements

To clarify, the 40 days is taken from when the bank is deemed to have received your letter and cheque and is 40 straight days and not 40 working days.

If you have had no reply from your bank regarding your SAR request within their 40 day deadline you can try sending this letter by Rex_Mundi to your bank.

You can also and indeed should report the bank to the Information Commission, however as they are very busy handling these complaints they are sending out the complaints to the bank in batches on a monthly basis.

If you bank with Lloyds and HSBC you can download your statements online. Best advice is to camp on the doorstep of your local branch and/or phone HO/Customer Services/local branch daily until they get sick of you.

  • I sent LLoydstsb 1st reclaim letter1/3/07. Received reply 22/3/07 stating i would receive copy statements within 3 weeks they have cashed my £10.00 cheque. no statements arrived so i tried to phone severel times cant get through so wrote back 14/05/07 asking for statements within 7 days still no reply and no statements. They say my charges are not default charges as they were charges for dealing with my request for going overdrawn. Very confused as I have not requested to go over my overdraft. Can anyone help i'm feeling totally confused and disheartned

    You are entitled to your statements within 40 days, esp after they have cashed your cheque. The letter is a standard one to put you off trying to claim your charges back. A bit quick if you haven't even asked for them yet! Don't worry, its a delaying tactic that works against some people, but not you as your asking in the right place. I'd call into a branch and point out they have cashed your cheque and want your statements now or you will report them to the FO. Once you have them, check on your charges and proceed with the template letters on here. Check the LloydsTSB thread on here for people in similar situations

    Whilst I have every sympathy for the poor staff trying to deal with Subject Access Requests, if you haven't received all the information you require within 40 days of them receiving your request, report the matter to the Information Commissioner by clicking here. However, his staff must be as inundated with complaints as the banks’ and credit card companies’ are with SAR’s and there’s only one of him.

  • my former bank sent me a letter saying they were dealing with my request and had 40 days to reply.... 40days have passed i still havent heard from them, i have sent another letter saying i will report them to the financial commissionaire 2 weeks ago and i still have had no reponse what do i do next?:

    If you have internet banking then you can get all you statements for the last 6 years from there at no charge...

    I have recently written to Barclays to request SAR for my accounts and also Barclaycard, no responce within the 40 days, raang them said no record (£10 cheque not cashed) but advised they will send statements and there is no charge because its handled under their complaints system! Bounus!!
    After speaking to Barclays (who very kindly gave me my Barclaycard Number) spoke to BarclayCard who had no record of my account (even told me I have never had one) I was informed (after speaking to 8 yes 8 different people) I would need to write to them to request info as it would probably have been sold off!! Don't understand why it would be sold off with a nil balance?
  • Hi, My wife started the process to calim back these charges in March of this year. I sent a cheque of with this claim. They cashed this in on or abouts the 20th april but we have heard nothing from them.

    My wife then sent a second letter stating that the cheque had been cashed in and that we have not heard anything back from them as to the list of charges made against my wife's account.

    Can we now take them to court for failing to provide my wife with these documents under the freedom of information act.

    I am trying to get my statements and sent a letter on 17th March, they never replied so i called them and left a message which was supposed to be a return call in 2 and a half days. I got a letter after 4 and a half days saying they would deal with my complaint by 15th June!!!! thats 3 months from my orginal letter . What can i do next as i am in the middle of writing another letter.
