40 days and no info/statements

    New thread as the other one was getting too long.

    To clarify, the 40 days is taken from when the bank is deemed to have received your letter and cheque and is 40 straight days and not 40 working days.

    If you have had no reply from your bank regarding your SAR request within their 40 day deadline you can try sending this letter by Rex_Mundi to your bank.

    You can also and indeed should report the bank to the Information Commission, however as they are very busy handling these complaints they are sending out the complaints to the bank in batches on a monthly basis.

    If you bank with Lloyds and HSBC you can download your statements online. Best advice is to camp on the doorstep of your local branch and/or phone HO/Customer Services/local branch daily until they get sick of you.

    Received letter stating not poss to provide statements fr May01-Feb 05 due to acct passed onto collections agency Jan 98 & statements were suppressed.In Feb 05 new computer system was installed allowing us to archive monthly record of account & this is reason been able to supply with statements frMarch 05 onwards.(this is when i had no charges).What can i do to get statements? can anyone suggest anything?

    If you haven't received all the information you require within 40 days of them receiving your Subject Access Request, report the matter to the Information Commissioner by clicking here. However, his staff are as inundated with complaints as the banks’ and credit card companies’ are with SAR’s.

    And the banks know it. Any other type of organisation would have employed extra temporary agency staff in order to meet their legal committments.

    My story...

    a)sent letter to them with 40 day notice
    b)nothing for 30 days
    c)sent reminder with 10 day remaining
    d)recieved letter with statements from 2004>2007 saying that rest on microfilm
    (would in there eyes take another 6 weeks)
    e)sent another letter with 7 day notice furthering there 40 day limit
    f)contacted inform/com on that 7th day
    g)no contact from either untill Friday just gone recieved rest of statements

    Start date 08/03/2007
    Recieved statments 01/06/2007

    You need to make sure you are sending a SAR (asking for all info held by the bank on you) request in this case and not asking for statements as your account has been sent to DCA.

    I was getting fed up of waiting for my statments from natwest credit card dept, 70 day since they cashed cheque, so went onto the natwest website, clicked the contact button, sent a email through that link asking why they had not met the 40 day deadline.
    Recieved a email within 12 hours saying they were looking into it, and list off charges were in my post box next morning!!!
    Phone them, email them, just keep going, they are hoping i think that people will just give up and get fed up of waiting and not pursue the matter.

    I sent my letter requesting charges from Royal Bank of Scotland.

    40 days are up and they have returned my cheque with a covering letter saying they can't find my details with the account number I've provided.

    They've requested my previous address and dates when the account was opened / closed.

    I know I gave them the correct account number, however once I write back with the further details they need do they get another 40 days to send me the information??
