40 days and no info/statements

  • Please help as I am stuck and have been trying to get my full statement of charges since Feb.

    I am claiming for two bank accounts and wrote one letter with the £10 etc to Halifax. They took longer than 40 days so I followed the procedure right up to informing the Info. Commissioner.

    The bank then sent me a list of charges (not statements) for one account and not the other one (been open longer and has more charges).

    I questioned them by phone and they said they had sent them both out separately and so had fulfilled their duty. To send another copy they said it would have to be treated like a new claim and I would have to wait another 40 days.

    I said I wanted to complain and the woman on the phone said it wouldn' change anything as they were swamped.

    What should I do?!

    Anything much appreciated and I do'nt mind if I have to take them to court!

    I apologise, I know this must have been asked many times but cannot find the answer....
    My request for Statements from Barclays has now exceeded the 40 days on 31st May - they do NOT appear to have cashed my cheque £10 to date.
    I have not heard anything at all from them.

    Should I contact them again? If so is there a template letter?

    I realise this may not be long enough, but I don't want to miss time scales.

    Any advice would be appreciated. MM

    Yep I handed my letter to my bank nothing after 40days wrote and handed second still nothing got 7 days to go ,Oh they cashed my cheque 4 days after recieving it but at a loss now on what to do

    Hi, i'm in the same position as you regarding Barclays and statements, i'm very nearly reaching the 40 day deadline, I have emailed them twice rang them numerous times and customer services tell me it will be dealt with when they get to it as they have a backlog of SARSs they are dealing with, so I dont know as soon as the 40 days are up I'm just going to report them to the IC and hope for the best that I receive them in the meantime :rolleyes:

  • The clydesdale bank has only sent out letters saying can't give me list of charges in 40 days but will do asap. It's now been 80 days. I've called clydesdale but just get excuses and told to wait.

    If you haven't received all the information you require within 40 days of them receiving your Subject Access Request, report the matter to the Information Commissioner. However, his staff are as inundated with complaints as the banks’ and credit card companies’ are with SAR’s.

    New thread as the other one was getting too long.

    To clarify, the 40 days is taken from when the bank is deemed to have received your letter and cheque and is 40 straight days and not 40 working days.

    If you have had no reply from your bank regarding your SAR request within their 40 day deadline you can try sending this letter by Rex_Mundi to your bank.

    You can also and indeed should report the bank to the Information Commission, however as they are very busy handling these complaints they are sending out the complaints to the bank in batches on a monthly basis.

    If you bank with Lloyds and HSBC you can download your statements online. Best advice is to camp on the doorstep of your local branch and/or phone HO/Customer Services/local branch daily until they get sick of you.

    Common problem particularly with the Clydesdale, as above camp on their doorstep until you get somewhere :)
  • Hi, I have sent my cheque over two months ago and it has been cashed. Sent two letter asking for my statements, have phoned three times - no one has phoned me back. Now sent another more serious letter. And you can only phone alliance and leicester not email them. I can not get anyone to realise that they have my £10 but no statements. Have sent all letters to customer contact centre - no written replies or any confirmation.:mad:

    Why are they ignoring me and what do I do now?:confused:

    I sent my original request for a stement to NatWest detaiingl 6 years bank charges. As I received nothing, I followed this up with a letter theatening reporting them to the Ombudman...

    By not supplying the information I requested, you have breached my rights under the D.P.A. You leave me with no alternative that if I do not receive copies of my bank statements within the next seven days, I will forward copies of my requests to the Information Commissioner.

    Still I have recieved nothing. Please can anyone advise my next step towards my goal (reclaiming said charges). Obviously reporting to Ombudsman will be done, but it doesn't get me closer to my objective.

    Any ideas ?

    Whats the best thing to do here, I'm trying to claim for my wife and not having much luck? A+L Haven't sent anything, I've asked them a dozen of times but still no go, I've reported them to the Information Commisioner still no good,

    They where damn speedy at cashing the cheque right enough
