If you have had no reply from your bank regarding your SAR request within their 40 day deadline you can try sending this letter by Rex_Mundi to your bank.

You can also and indeed should report the bank to the Information Commission, however as they are very busy handling these complaints they are sending out the complaints to the bank in batches on a monthly basis.

If you bank with Lloyds and HSBC you can download your statements online. Best advice is to camp on the doorstep of your local branch and/or phone HO/Customer Services/local branch daily until they get sick of you.

Hello and good afternoon.
I just wanted to hear suggestions on what to do if the bank have not responded to the first letter you've sent them - First letter template from Martin Lewis guide
They cant say they have not got the letter because it was posted on recorded delivery and according to the post office website they have receive it 2 days since it was posted. They also cashed the £10 CHQ that was attached to it payable to the BANK.
Shall i call them or wait for another weeks? If i need to call them, is there anyone got the direct number for HALIFAX bank?
I hope you can help me.

If you haven't received all the information you require within 40 days of them receiving your Subject Access Request, refer the matter to the Information Commissioner.
However, his staff are as inundated with complaints as the banks’ and credit card companies’ are with SAR’s. The banks and credit card companies have received so many "black marks", that one more doesn't make any difference.
In the meantime, you can always draft your first claim letter so that, when your data does arrive and you've done your sums, all you have to do is fill in the blanks.

Yup, as the title says.
March 22nd this year I sent my bank Lloyds TSB a letter requesting my 6 years worth of statements. 45 days later contacted them and was told due to the amount of people doing the same, my details had only just been processed and should get them in 2 weeks. Waited awhile, phoned 4th of this month was told/promised I'd get them on the 6th of this month, phoned this morning to be told an entirely different story. The first lot they'd sent got 'lost' in the post, yeah what ever!:mad: and now I've got to wait another 40 days for them to be processed! Big fob off or what? Anyone else been given this crock of crap as an excuse? Anyone else reported their bank? If so, what happened next and is there any truth in the rumour that you can sue the bank for this breach of DPA regulations????0 -

I called the bank and spoke to an Adviser and she said she will put an urgent request for the bank statements to be posted to my address. She said it will take 5 to 10 working days to come through.
If these bank statements are not here in 10days time.. i will give them another call and perhaps tell them that i am going to Information Commissioner. This is probably the best thing to do if you are saying staff from there are inundated with complaints.

I am very concerned as I am not getting anywhere with this bank charges thing. So I have followed your guide I have sent the first letter with a £20 cheque as I am claiming for 2 accounts that have been closed for a couple of years.
I did not here anything from natwest for 40 days so I sent anothe letter and still nothing so i called natwest and complained and the lady said she could get the statements to me but she needed my sort code, but I did not have it.
So I went down to my local branch and they gave me the sort code. But for some reason on there system they can see my account details but they do not have any financial records on the accounts.
