    sent martins letter and cheque in april
    not recieved list of charges or any contact at all but cheque was cashed
    any one else had these problems

    If you haven't received all the information you require within 40 days of them receiving your Subject Access Request, you can refer the matter to the Information Commissioner.

    However, his staff are as inundated with complaints as the banks’ and credit card companies’ are with SAR’s. The banks and credit card companies have received so many "black marks", that one more doesn't make any difference.

    In the meantime, you can always draft your first claim letter so that, when your data does arrive and you've done your sums, all you have to do is fill in the blanks.

    To clarify, the 40 days is taken from when the bank is deemed to have received your letter and cheque and is 40 straight days and not 40 working days.

    If you have had no reply from your bank regarding your SAR request within their 40 day deadline you can try sending this letter by Rex_Mundi to your bank.

    You can also and indeed should report the bank to the Information Commission, however as they are very busy handling these complaints they are sending out the complaints to the bank in batches on a monthly basis.

    If you bank with Lloyds and HSBC you can download your statements online. Best advice is to camp on the doorstep of your local branch and/or phone HO/Customer Services/local branch daily until they get sick of you.

  • I contacted my bank (Halifax) on 23rd February, requesting my statements for both my accounts. I received the statements for one account (the one I don't use as much), so I have proof that they received the initial request. I then sent another letter to chase the statements for my other account about 50 days later. Still received nothing. Made numerous phone calls - each time I've been promised the statements are in the post and I'll receive within 10 days. It's now been 17 weeks and still nothing. I've contacted the Information Commissioner who say that it's nothing to do with them and they have closed the case (without even opening one), and I've also contacted the Ombudsman, who haven't replied to my complaint, despite it being sent over 2 weeks ago. Not sure what to do next. How can I take them to court when I don't know the exact amount I'm taking them for. I've kept my statements over the last 2 years, and already it's amounted to a fair amount. I predict the overall amount will be around £2,500.

    Any ideas as to what I do next. Don't want to let them win.

    Catherin, do what I just did, walk into your local branch & ask them for your statements. I just went to mine & said I sent a letter on this dat, took a copy, thn told them I still havent got them. He said no worries I will get it arranged for you now & they will be with you in a week!

  • NatWestStaff Member thanks for the question. The dates I have asked three times for are from 20 July 2006 up to 4 December 2006. I keep getting 20 July 2005 up to 4 December 2005! Each time (3 times now) the Admin Person at NatWest Telephone Banking Service has read out the previous request showing on my records but still haven't got them. I phoned Friday 15 June. The woman confirmed the dates I wanted and said they would be sent out Tuesday 19th June and she would personally supervise their despatch. I wait with great anticipation. You're doing a grand job, thank you.

    Hi

    My husband and I sent seperate letters on May 4th to request details of charges. We have not heard anything from them yet. The problem is we paid by postal order and like idiots didn't send the requests by registered post so don't know if they have been received or if the money has been cashed?!?
    Does anyone have any idea what to do? My husband wants to hold off until the end of the month when we get paid as we have both hit our overdraft limits. Should we wait? Is there a way we can track the postal orders? We have the ID's on our receipts

  • I am sure there is a way to track postal orders, by now the 40 days prescribed under the data protection act has passed so they are in breach of that. I would complain to the Information Commissioners Office.
