If you have had no reply from your bank regarding your SAR request within their 40 day deadline you can try sending this letter by Rex_Mundi to your bank.

You can also and indeed should report the bank to the Information Commission, however as they are very busy handling these complaints they are sending out the complaints to the bank in batches on a monthly basis.

If you bank with Lloyds and HSBC you can download your statements online. Best advice is to camp on the doorstep of your local branch and/or phone HO/Customer Services/local branch daily until they get sick of you.

I am with Halifax bank, I sent a letter to them in April Re. Bank Charges and havn't yet recieved a statement in the post. I contacted the bank ten days ago and was given the complaints telephone number, I contacted them and was told that I would recieve a breakdown of charges for my current account and credit card.I contacted the complaints department again today due to not receivng the breakdown of charges, and was given a breakdown of the total charges for my current account from the bank.Can I use this information given to me by the bank as it is way over the 40 days deadline?What should I do next? I am not sure how long it will take to get the information that I have requested from the bank.Your help would be very much appreciated :-)Julzs0

If you haven't received all the information you require within 40 days of them receiving your Subject Access Request, you can refer the matter to the Information Commissioner.
However, his staff are as inundated with complaints as the banks’ and credit card companies’ are with SAR’s. The banks and credit card companies have received so many reprimands that one more doesn't make any difference.
In the meantime, you can always draft your first claim letter so that, when your data does arrive and you've done your sums, all you have to do is fill in the blanks.

I sent my £10 to Clydesdale bank in April the 4th and we are almost into July and I still have not received my bank statements and the cheque has been cashed PLEASE HELP!!! FLANNAGAN0 -
Call them, That's definately not right, I got my statements from HSBC after 3 weeks and didnt even include a cheque.

Yes you can use this information to start your claim, however I would persist in asking for the statements/information as you will need "hard copies" of this should your claim go to court.0 -

As the above posts, you need to keep at the bank until you get the information although I have to say Clydesdale is one of the worst banks for taking their time issuing the information.0 -
I am same. Being completely ignored so went to I.C and got letter from them suggesting bringing in Financial Ombudsman. I did that and they have replied that they will be in touch soon and I.C are also dealing with things on my behalf. I was bit cheeky n put problem has been since 1982 as thats when I opened account,well no harm in asking.0

As you threatened to refer the matter to the Information Commissioner, then refer the matter to the Information Commissioner.

I wonder if you can give me some advice. On 4th May I sent a claim with a cheque for £10 to Alliance and Leicester for unfair bank charges. The cheque was cashed by them on 25th May. I sent an email via my account (which I closed in March) and received a reply that the time they were allowed was 40 days from encashment of the cheque. I sent them another email saying that this was incorrrect.
I have now had an email saying that the relevant department cannot find my claim and they will have to investigate. Is this delaying tactics and what should I do next.
I tried ringing A & L on the tel. no. 0116 200444 which is given on the back of their complaints leaflet but it was just an answerphone. I left a message but there has been no reply.
It is now 54 days since I sent off my cheque. What is the next step please.0
