To clarify, the 40 days is taken from when the bank is deemed to have received your letter and cheque and is 40 straight days and not 40 working days.
If you have had no reply from your bank regarding your SAR request within their 40 day deadline you can try sending this letter by Rex_Mundi to your bank.

You can also and indeed should report the bank to the Information Commission, however as they are very busy handling these complaints they are sending out the complaints to the bank in batches on a monthly basis.

If you bank with Lloyds and HSBC you can download your statements online. Best advice is to camp on the doorstep of your local branch and/or phone HO/Customer Services/local branch daily until they get sick of you.

Hi, and Sorry to be asking yet another 'what next' question, but
I sent to Halifax a request for charges info at end of March with encl. £10 postal order.
After 40 days, and no reply, telephoned to enquire what was happening, and told no record of letter, (even tho' recorded, and signed for) but he would request details again, and could take 40 days.
Numerous telephone calls to Cust Serv. but no answers. Only 'dealing with' and letter to same effect.
Registered with ICO almost 1 month ago, and still nothing, from either Halifax or ICO?
What should I be doing now? Can anyone advise please?
Thanks in advance.makinprogress0 -
Hi there Barclaycard have nearly went over the 40 days, if they do who do you complain to. In Martins letter it says that if you dont recieve them within 40 days that you can complain.
Barclaycard sent me 3 years statements and said the other 3 years would follow becasue these are on microfilm or somethin like that.
Thank you.0 -

I've written the first 2 letters asking for statements to the Halifax to reclaim bank charges but they have ignored both. I did include a cheque for £10 which they have not processed. I sent them to my local branch, was this the wrong thing to do? what should I do now? Do I just carry on and send the next letter?
Any help and advice would be gratefully recieved.
Thanks, Nicki0 -

If you haven't received all the information you require within 40 days of them receiving your Subject Access Request, you can refer the matter to the Information Commissioner.
However, his staff are as inundated with complaints as the banks’ and credit card companies’ are with SAR’s. The banks and credit card companies have received so many reprimands that one more doesn't make any difference.
In the meantime, you can always draft your first claim letter so that, when your data does arrive and you've done your sums, all you have to do is fill in the blanks. The acquisition of wealth is no longer the driving force in my life.0 -
Help, please tell me I'm not doing anything wrong. I sent my cheque for £10 requesting a summary of all my bank charges for last 6 years. Over 40 days gone by and Ive heard nothing. The bank however, did take the cheque because it's gone out of my other account! Can they do this? Please let me know!!!!0

Hi all
I have read the threads and am now more confused than ever!
1)I sent off for my statements just over 40 days ago - no response - so now I need to ring the to chase this up? Where do I find the number? Have been on the HSBC website - even more confused
2)Having been on the ICO website to try and follow link I got even more lost!
Do I need to complete "The data protection act 1998 complaint form"? If so - what is my complain? That HSBC didn't supply copy statements within 40 days?
I'm sorry if this has all been raised before - like I said I have tried to follow the threads.
Any help or advice would be really appreciated
