40 days and no info/statements

    i've requested 6 years worth of statements from the HSBC and the 40 day window for them to reply has passed... does anyone know who or where i contact at the HSBC to chase my request up?

    contact phone number would be useful to if it is different from the main telephone banking number

    With HSBC you can download the information you need if you have internet banking so you would be quicker doing that.

    Just a little tip, I send a cheque on 27th April to Littlewoods, asking for statements, 50 odd days later, I still hadn't received any response, athough cheque had been cashed,, so wrote second letter, giving 7 days or I would be reporting to the Information Commission..OK, to day received letter offering apolgies etc, but the letter had be send to the wrong office,(it had taken until 28 June to get to the right office, yeah right!!) anyway the point is...I have been told to night by son, who knows about these things..lol...under the Data protection Act, it states that whether it is the right or wrong office by law the Banks etc still have only 40 days to response, as long as it goes to the right Company of course...point being....don't wait any longer than 40 days, before you take it to the next step, you don't have to, as long as it is in the Banks hands..its their problem if they take so long to pass it to the right Dept...I think they are just using this excuse as a delay tatic...I mean TWO MONTHS to pass a letter to another dept.....I don't think so......Lilly :rolleyes:

    Hmm I sent Littlewoods my letter & aint heard anything yet, have you got your statements then? Your son is correct so I may ring them aswell & complain :mad:

    Nooooo. Lol..I haven't got my statements.....Lol...'she is dealing with it and collecting them together for me'.. I think it was the second letter that got them running scared...I think I will give them to about Tuesday next, and either ring or write another letter....its getting on for nearly three months now, I think they have had enough time now.....Lol...Lilly
  • can anybody advise me on, after requesting bank statements got a letter saying it would take up to 40 days, do i wait for this 40 days or do i ring up?
    Also as you can only claim up until september how soon before do you have to put in your claim?

    Hi yes they do legally have 40 to comply with the SAR request, if anfer 40 days you haven't recd. them you can file a complaint with the Information Commisioner against them.

    Once you have your statements you stick to Martins timescale send the first letter giving 14 days then if no response or an unsatisfactory one send the second letter LBA ( letter before action) giving them a further 14 days to pay. If still no joy you then file your claims by means of either the court or the financial ombudsman

    Hi all,

    I am trying to claim my money back from TSB. I sent a 10.00 cheque by recorded delivery on the 19th June 2007 along with the 1st template letter, I have not had a reply and the cheque has not been cashed!!!

    Should I wait 40 days or should I do something else?

  • Can any body help, It is 3 days away for the 40 day deadline to recieve my bank statements, what happens next as there isnt a templete covering this sinareo. I am with Natwest Bank I look forward to the help from anyone :confused::confused: :mad:

    You have to wait the 40 days, if you want the statements. But Lloyds TSB Credit Card have ignored all my requests, and have kept me waiting 70 days.

    I have now have a ruling in my favour by the Information Commissioner, but still no statements.

    I wanted to use MCOL, but have now gone down the FOS route, as you do not need to know the amount of charges.

    Write a reminder letter to Lloyds, pointing out how long they have left to comply.

    Dead on the 40 day mark, write to the information commissioner. You must have proof of delivery of your requests to LLoyds TSB.

    Dead on 56 days, you can also start with the FOS, if you are going down that route. Point out that Lloyds TSB have not been forthcoming with the list of charges. I have requested compensation myself.

    But its still early days yet, so they may arrive within the deadline. But Lloyds TSB have no respect for the Information Commissioner, the FOS, or the law, and its time they were slapped with a HUGE fine.
