40 days and no info/statements

  • I'm hoping someone may be able to help me - 40 days ago I wrote to my bank (HSBC) for a list of all the charges I have paid on my bank account. They haven't sent me any of this information but have sent me a letter on the fourtieth day saying that the info was on it's way. Do they have to provide the information within 40 days or just respond to my request?

    If you haven't received all the information you require within 40 days of them receiving your Subject Access Request, you can refer the matter to the Information Commissioner.

    However, his staff are as inundated with complaints as the banks’ and credit card companies’ are with SAR’s. The banks and credit card companies have received so many "black marks", that one more doesn't make any difference.

    In the meantime, please read the Reclaim Bank Charges Help thread for information and the Reclaimed Bank Charges Success Stories and Reclaimed Bank Charges Success Stories II threads for inspiration.

  • Sorry Matt, and may i say that by now NatWest should know i am now posting codes to get the information in case it helps their DPA team who seem not to know about their own computer system, If the account was opened in 2002 and prior to it then i have a full proof 100% way of getting the number. You need the sort code of the branch where you're account was held, plus address at that point in time. Branch can get for you, they use a system called Back Office. Codes are 04, 26, 45(that takes them to the natwest archive) option 1 or 2 i believe which gives a further menu one of which is a search engine, should take roughly 1 minute to get the account number and sort code.

  • They are in breach of the DPA by not providing details within 40 days. A complaint to the ICO may be in order now. Yes you can sue the bank for breach of DPA for a nominal amount.

    I applied on the 2nd april for the 6 yrs statements from shabbey and to date have still only received 3 yrs worth, what should my next step be as without all the information for the amount trying to claim, i can not proceed. Thanks in advance for any guidance and advice.

    In the meantime, you can always draft your first claim letter so that, when your data does arrive and you've done your sums, all you have to do is fill in the blanks.

  • I have just received my statments from Barclays, however! i was wondering if it has taken anyone else 6mths to receive theirs?? where do i stand with this when it comes to claiming back the wadge of money they have so quickly taken from me??????

    Send your first letter off today, presumably you reported them to the Information Commisioner for breaching the Data Protection Act of not sending them within the 40 day period.

    I've been waiting 6 weeks so far for mine and still nothing, just rude customer services when I ring up,
