I sent a letter and £20 cheque on the 24th April 2007 requesting six years of bank statements as is my right under the Data Protection Act. I have been expecting copies of my statements within the 40 days stipulated under the D.P.A. As yet I have not received any correspondence from you.
By not supplying the information I requested, you have breached my rights under the D.P.A. You leave me with no alternative that if I do not receive copies of my bank statements within the next seven days, I will forward copies of my requests to the Information Commissioner.
I look forward to your timely response.

As you threatened to refer the matter to the Information Commissioner, you refer the matter to the Information Commissioner.
However, his staff are as inundated with complaints as the banks’ and credit card companies’ are with SAR’s. The banks and credit card companies have received so many "black marks", that one more doesn't make any difference.
In the meantime, you can always draft your first claim letter so that, when your data does arrive and you've done your sums, all you have to do is fill in the blanks.

Hi All
Posted msg yesterday to say that had not received statements from Barclays after sending 1st letter to have them sent to me & another letter giving them a further 7 days & guess what?
I received them today :j .They even sent me me the Postal Order back saying that its free of charge.
Now I bet they wish they hadnt sent me this now as Im going to be claiming back £1,240. Yippeeeeeeeeeeeee (Hopefully).0 -

I have also just found out that they have not taken the £20 out of my account for the statements and charges.

Just to let you know if you still havent received your statements that the bank are breaking ANOTHER of the Unfair Consumer Regulations 1999 (The one that you can reclaim their charges with). Part 2, Schedule 2, No1 Q States (unfair terms) " Excluding or hindering consumers right to take legal action by unduly restricting the evidence available to them" Might help to write to your bank and point this out to them - When it does get to court, make sure you mention this as well.
