Just been offered settlement today:money:. I sent the letter threatening with court, but didn't follow up & apply after 14 days. I thought I better do this soon, but just hadn't got round to it 27 days later. So really surprised today & they've given me more than requested. I also offered to settle for £400, so am well pleased. Thanks Martin:T

Bank: NationwideAmount Claimed - £3003.20Started 6th February, used letters and timescales as per MSE Guide- didn't use MCOL, went direct to local county court - was really easy and staff couldn't have been more helpful.Mysterious Amount of £1236.00 (nice, but not enough!) appeared in account on 5th July (can you beleive I only found out today) called member services at Nationwide today, got tranferred from one department to another andeventually negotiated full amount - all very polite and courteous - needless to say I am over the moon.Default Day would have been today so it hasn't been easy and I thought I would have to go to court..................felt panicked and thought I wouldn't be able to go through with it.Huge Thanks to Martin Lewis and MSE for all the letters help and to everyone that has posted useful info and support.Good Luck to everyone claiming - don't give up, you will get your money.Barclays next! The story: Letter 1 (from MSE Templates) sent 10th May 2007 claiming £1,625.00 + £305.02 interest - standard customer service reply, no further response.
Letter 2 (from MSE template) offering to accept £1,350 sent 2nd July. (Both letters sent recorded).
Offer received today (09/07/07) dated 05/07/07 refusing to pay interest but offering MORE than I had offered to accept. These banks are nervous. Incredibly easy. Having EVERY bank statement I've ever received made it easier to calculate (hint, keep them!)

Update (01/08/2007) I returned the offer recorded mail on 12/07/07, received at HSBC 16/07/07 - so I waited 14 days for the payment. On Tuesday 31/07/07 (15th day) I rang the HSBC service centre. They claim to have recived my covering letter, but not the signed agreement! I am staggered at how low these banks will stoop to delay or avoid making these payments. I went to my local HSBC branch and got them to FAX my copy of the signed agreement to HSBC. I rang again today (01/08/07) to be told it still hasn't been received and I might still wait 48 hours for the payment.
I still don't have my money and I am seething with HSBC.0 -

Story: I followed the instructions on the moneysavingexpert website and sent two letters to my bank. Unfortunately they did not provide me with a satisfactory response and I had to submit a complaint to the Ombudsman. Within two months of doing this I received a letter from the Ombudsman advising me that Bank Of Scotland were willing to offer me the full £1078 I had initially claimed. The bank, of course, advised us that this was not an admission of liability in that the charges were excessive. Whatever!

Finally reached a resolution of complaint with Alliance and Leicester by using FOS. As I'm in Scotland this was the best way to go for my particular claim due to Small Claims limit up here.
CLAIMED - £1020-00
REFUNDED - £1258-00

Just a quick post as I won using the FOS, got a bit daunted by the court process. Sent it to them on 13th June and received a letter yesterday saying they will pay me £468. Thought it might be any error as I had claimed £439 and that included interest. I sent the form saying I accept straight away. It was the Alliance and Leicester.
So would recommended them to other people.

Sent off letters, got the usual reply - sorry, all charges lawful etc etc. Sent letter stating I would accept a reduced amount and had letter back offering £1182. Phoned to say that I wouldn't accept it and spoke to a very nice gentleman who listened to my complaint that the charges were not a true representation of the actual cost to the bank and he didn't deny it! Then he offered me the full amount!!!! I do owe them some money anyway, so that will come off the refund but at least I am reducing my debt as well as getting some money back!
Waiting to hear from Intelligent Finance. Next target - Barclaycard.0
