The story:
After going though regime of getting statements and all the letters back and fourth,the halifax told me that the charges were explained to me when i took the account out so they were right to charge them.
So i then sent a repeat letter asking for a refund or i will be going to the courts,nothing for 2 weeks so decided to pay the £120 and start the court proceeding using the online court system.
5 days later a letter arrives from the bank saying as a good will gesture and by no means an addmission of guilt they are offering me £1250.
It said on the letter to accept this money i had to do nothing it would be in my account in 14 days, or if i rejected it to phone the number at the top of the letter.
I decided to ring and reject,they said someone would call me back within 2 hours,i got a call about 1 hour later asking me what sort of figure i was looking at,after a bit of haggling we agreed on £2000 as i put the phone down i could nt belive how easy it was getting from £1250 to £2000.
Hope my story spurs someone on to a successfull result like mine

It has not been a quick process - first wrote to them in December asking for my statements. They have complied with every timescale to the minute, including defending at the 23rd hour. However, it is all sooooooo worth it. Yesterday received a letter, just over one week to go to my court appearance, offering me the full amount, plus interest, plus court fees. £4,582.83 (from memory - letter left at home!). :j

I went down the MCOL route only to have my claim 'rejected'. I must admit I did panic a bit at that point and phoned the Help Desk at MCOL to find out what exactly that meant (since viewing the report online it gave me no information other that it had been rejected). They explained that it meant that the basically the Bank had entered a defence to my claim and that they had until 9th July to back it up. I then went straight back to this site to try and find out what my next step was and I went down the route of phoning the 0845 1241330 number and spoke to a customer service adviser stating that I wanted my claim re-assessed. She said that was certainly possible but due to the high volume of claims it would take approx. 3 weeks but someone would get back to me to let me know what the next step would be.
That was Wednesday, today (Friday) I have recieved the letter explaining that all the charges were intially made clear when I signed my Account T&C's, however blah, blah,blah .... and yes, you have guessed they have agreed to settle the full amount I was claiming (only a paltry £155,compared to others) and I can expect it to be in my account in the next 5 days!!!!
Now whether it had any bearing on the fact that the amount was so realitively small, I do not know. However all I can say (to Martin and everyone else who has posted any advice and info on this site) is thank you, thank you THANK YOU!!!!!

What a result!! Martin you are a legend!
I started this procedure by writing to nationwide asking for a copy of my statements the 13/03/07, they dragged their feet on this simple request, so i knew i was in for an adventure! After 4 weeks and numerous cals i got them and thats when i requested my charges which amounted to £3631.50 plus interest of £709.48. I even said i would settle for a lower amount of £3000 under the without prejudice header......they wrote back almost immediately telling me off about the banking code and that they were right etc etc etc....so i then wrote back saying i was taking them court and paid my £120 to MCOL. The claim was acknowledged on the 06/06/07 and 3 days later i got a letter from Nationwides's solicitors saying that they were defending......of course i panicked then!!! After hearing nothing for almost a month, i checked my account last night and was astonished to see the full amount had been paid in!!
Get in.
And just imagine, they could have given me £3000 3 months ago!

To all those who are doing this with Nationwide who seem to dig their heels in the deepest & even those with other banks, just keep going, you will win in the end........

Wrote to Barclays 2-3 months ago following the letters on moneytips, Barclays responded each time on time. Then offered £590 without needing to threaten court proceedings. Accepted the amount as worried a bit about the past couple of court cases that failed.

The story - i had already claimed £2500 (including interest and court fees) from First Direct and also £1867 (also including interest and court costs) from the Halifax - both went to MCOL stage and after they both filed 'defence' online, a letter appeared from both a week later settling in full - yeahhhhhhhhhh.:j
Soooooooo armed with confidence i proceeded with Barclaycard - i sent the data protection letter in January and it wasnt until the begining of April that i received my bank statements (this was a nightmare as i sent numerous letters and spoke to various Indian call centre workers before contacting the financial ombudsman):mad:
In April the statements arrived and with interest the amount i was claiming totalled £731.00.
I sent the next letter and heard nothing - after the 14 days, i sent another letter, again i heard nothing from them.
Then suddenly when my next statement arrived i found that my account had been credited with £200 -Barclaycard had not informed me about this credit so i sent them a letter informing them that i would only accept the £200 as part payment!
I did not hear anything else so i filed court action on MCOL.
I was hoping that they wouldnt acknowledge the claim but on the 13th day they acknowledged. Again they waited until the 13th day to file a defence. :mad:
My case was transfered to my local court and i was getting worried especially after the Berwick case and then the judge in Hull throwing out all those cases - i had visions that my name would be the next on the money saving site as the second person to lose to the banks!!! :eek:
I waited a further 3 weeks until i received a letter from Nottingham court asking to provide my court bundle to the court and a copy to Barclaycard legal team :sad: - i spent days compiling my bundle and i even charged my time and expenses which added up to a further £320 - i am currently paid £13 an hour so i can justify claiming the same amount as my hourly rate, i also included the paper cost, postage costs etc...
I sent my bundles off on 2nd July 2007 - one to the court and one to Barclaycards legal team.
Yesterday i received a letter from the legal team stating that they were refunding me with £811 :j (which was for the full amount with interest and court costs) I have accepted - i suppose i could go my personal costs but i'm happy to get my full amount - they said they would credit my account, which i dont want - i have said that i will only except a cheque for the full amount before i stop court proceedings!!
So i signed the letter and faxed it off this morning!
My advice is to stick with it - sometimes it was scary but in the end they all paid out and it was worth it!! Reading other peoples success stories gave me the confidence to stick with it and now i can afford to go on a fantastic holiday!!

The story: Applied 8th May 07 refused point blank, sent next letter threatning court actions and received "goodwill" gesture on the 28th of June of half the amount. I called the number on the letter and said the offer was unacceptable. Bank said that it is negotiable, I said full amount or court.
Full amount will be in my account in the next 14 days :j

Started claim 15th June 2007
Woolwich wanted 28 days to investigate and come to a conclusion. Thought ok, i'll give them that, but then thought i'll send the threatening to court letter... just to remind them that i was on the case.
Sent 2nd letter this week 2nd July 2007.
Today (6th July 2007) i recieved an offer for £449, which i'm going to accept.
Amount claimed**£594 + £37.79 interest
Amount won £449.
Its less than what i claimed. But 3 WEEKS its taken and i'm quite happy with this amount, and scared of the court process, but if needs be will fight all the way, so... :j :beer: :j :beer: :j :beer: :j:beer: :j :beer: :j
