I started the process in February but backdated my claim to January 2001 as I came to realise I had received a couple of charges at the beginning of that month that I really watned to get refunded. After two letters I received the standard response telling me I was wrong and that I should contact the ombudsman. However I decided to start court proceedings. I made a complete hash of the Money Claim Online form as I did not read the help pages on this site (:embarasse). Several weeks later I got a letter from the courts which showed me the detailed defence that LLoyds had submitted. It included calling my claim 'an embarrassment'. I nearly gave up as I knew I'd made a bit of a hash of the Money Claim form but I stuck with it. On June 22nd I was sent a court date of August 15th. On July 2nd I received a letter from Lloyds solicitors telling me my claim was misconceived but they did not want to go to court as they were still in talks with the office of fair trading. As such they were willing to settle my claim in full (which included interest) and pay court costs. HAPPY DAYS!!!!!!

Yay NATIONWIDE paid out to me today! I got £265 back in my bank, I claimed £280 so I am so chuffed!!! :beer:0

Hi started the claim proceedure 3 months ago, Nat West lost my claim 1st time round. I sent it to my branch instead of Customer services, any way claimed for £ 670.00 and got back £637.00 very grateful to Martin and the gang.

Posted my first letter on 27th May got the usual response we are looking into your claim blah, blah
Gave the bank 21 days before sending in threat of court action, recieved letter 2nd June with a good will gesture of £1800 :j which I gladly accepted. I know I maybe should of gone for the rest but to be honest on several occasions Barclays have given me the odd charge back here and there so I didnt want to push my luck.

can not believe it but have been paid out by the Halifax. Started claim in April. Got usual no way letter and went to mcol in June. Halifax acknowledged one day late so my request for judgement was declined. They have now though paid back £3880 against 4080 so I am a very very happy bunny.

Hi, started proceedings against Lloyds TSB on 13th March 2007. You know....please can I have my money back? (£355 + £54.00 interest)
They refused and I sent the letter threatening Court action if they did not on 30th March. Still no joy. I am currently awaiting court date against Barclays for a larger amount. Therefore I placed more importance on that and put TSB on back burner. I got a shock when I got home today to find a letter from TSB stating they were going to place £595 in my bank account. Should be in within a week now.
I never thought I would have any success at all with this, things never seem to come easy do they but I never look a gift horse (or a black horse) in the mouth.
Chin up everyone & carry on the good work. I am awaiting Barclays reply...

BANK: HALIFAX

We began a coule of months ago and got the inital, standard letter of reply about dealing with our complaint. I presume the FSA must have drafted a standard Financial Services response as my employer, a major pension provider, writes almost the same letters. After waitng the obligatory 8 weeks we got the letter from Halifax stating that our 'complaint' had not been accepted. Again, a letter that could have been written by my employers complaints department.
We proceeded to make a claim through the samll claims court and, on day 12 (29 June) Halifax registered their acknowledgement of our court claim. We fully expected to wait a further 14 days and eventually end up in court but, yesterday (4 July), when checking our bank balance at a cash machine we discovered to our total amazement that we were £3000+ richer than expected. Only when we got home were our suspicions confirmed as there was a letter on our door mat form the Halifax that they had settled on 3 July but not even bothered to advise us up front.0 -

Hi all,
I have been going through the reclaiming process since December.
I asked for list of charges, they took 3 weeks to say it would cost £10
I then sent the £10 and they exceeded the 40 day rule so I sent letter to them as a compliant and a follow up. The y eventually sent me 5 years worth of statements.
I then sent 1st letter stating I wanted charges back, they replied thta the charges were fair.
2nd letter stating I would take it to court if they did not refund me, no answer.
Went online and printed off documents and filled them out and took them to sheriff court, staff VERY helpful and told me I had to detail my case more. Went home copied every statement and made my case. Took it back and paid my £39 to court. I received notification from court and a date I could call them to see if bank was going to defend themselves.
This time came and I called court..... they were going to defend it!!
I was due to go to court this Friday... BUT yesterday I received a letter from bank for full amount plus my court fees!!
They did not admit fault but stated...
I am of ther view that the bank has a valid defence to the action you have raised. However, it is simply uneconimical for the bank to proceed to a hearing and for this reason only I enclose a cheque for £xxx.00 in full and final settlement of your claim. This is made of of the sum sued of £xxx.oo, your court expenses of £39.00 and interest of £xx.00
A copy of this letter will be lodged with the court to show that your claim has been settled in full

PS - they pushed it right to the wire - I had a court date for the monday and Cobbetts, Natwest solicitors, called to 'talk about coming to an arrangement' le on Thursday afternoon. I got letter on Friday and had to go down to the court with the form to cease hostilities on the friday morning! x£3k back from Natwest:beer:, approx 29% saved on major debts due to Martin's tarting advice and LOTS more (inc weight loss too! ... Martin's a Marvel:j Long healthy good life, great times, and happiness :rotfl: x0 -
