    couldnt believe how simple it seemed, followed martin's instructions:money: , went through a couple of months of wondering what the bank would say, then got a letter bank from the bank stating that they believe their charges are fair blah blah blah, but as a goodwill gesture they offered the full amount, £4,848 :T . thankyou martin, we are now going on holiday for the first time in 7 yrs. please no-one, give up hope and good luck to everyone who is reclaiming xx:rotfl: :rotfl: :rotfl:

    The story:
    It the same old thing took 8 weeks Natwest dont seam to settle under this time scale. well best go as i have 6 C-Cards and an otherbank account.

    Sent letter one on 26 April. Received acknowledgement within about 10 days saying would reply within 8 weeks. Sent letter two after two weeks. Got a bit worried about court action following the claim that failed so decided to give them the 8 weeks. Last Friday, with no reply received I completed form for ombudsman and same day I posted them received offer of settlement.

    More than delighted to accept and all it took was two letters and a bit of patience. If you are scared of court then try the two letters and see what they offer you. Thanks for all posters advice - that gave me the encouragement to write and good luck to everyone!

    £1730 claimed and fully paid

    I originally claimed £1730 but as in Scotland only 5 years can be reclaimed this was reduced to £1640. I then offered to accept £1450 in settlement. For all the above I used your excellent templates.
    They are apparently so far behind with their caseload that after two months of no response I was offered the first amount (they said that they were sure their charges were lawful but still offered me the money). I accepted immediately and was paid within a week.

    They Paid in full £2770.29 and £120 cost
    1st letter 29.03.07 asking for £1964 + interest. Reply. How to go about making a complaint, if I was unhappy.
    2nd letter 14.04.07. Threatening Court. Reply exactly as before.
    3rd letter 21.04.07. For a quick resolve I offered a reduced settlement of £2500 round figure, or I would continue with court proceedings[/FONT][FONT=&quot].[/FONT][FONT=&quot] After 14 days, NO RESPONCE !!!
    I now went to Money claim online, followed instruction from Martin and his template as to what to write to the court, (so simple) Paid £120. Notice was served on the 4 June they now had 28 days to file a defence, nothing happened. I was ready to ask the court to rule in my favour on the 29th day as no defence had been received, but a cheque arrived the morning of the 29th day, 03[/FONT][FONT=&quot].07[/FONT][FONT=&quot].07 [/FONT][FONT=&quot]before I had chance to file for judgment to be awarded in my favour by default. Hooooooooooooooooray!!!!!

    It just takes a bit of time and effort, but I looked at it as if I had worked from March 29th to July 3rd and made £2890.29 in just over 3 months, not a bad return for a small amount of time and effort.

    Sent the template asking for statements which arrived late, then sent next two templates asking for money back and then threatening court action- was ignored both times. Then felt nervous to take next step as didn't want to actually go to court and all of a sudden just before I was about to be brave and go for it, the letter arrived offering me the amount before interest! Am absolutely delighted and determined to be angelic with my finances from now on! Thanks to Martin and everyone who gave me the courage to do this and I would encourage everyone to have a go - what have you got to lose!

    I wrote the initial letter to hsbc after looking up my charges on the online banking service, aproximately a week later i recieved a letter saying they were looking into my claim and i would be contacted when a decision is made.

    7 weeks later i.e. today i recieved a letter offering me £200 less than my initial estimation and im going to send off the letter in the morning accepting it

    Very very pleased with the help this forum has given me so thanks and good luck to everyone trying this :)

    Claim: nearly £1900 + £450'ish interest
    Settled: nearly £2200 = charges (minus interest) + court fees + further charges since start of claim

    Original claim letter early March.
    Second letter 2 weeks later.
    Didn't use 3rd letter, went straight to MCOL.
    At 8 weeks from original claim received 80 percent'ish offer.
    Respectfully declined this offer and suggested the above settlement.
    HSBC defended claim online.
    Got a court date in Cardiff for 14th August.
    Generally made a complete nuisance of myself with regular phone calls and emessages asking for updates. Informed FOS of apparent intention to waste mine, FOS's and court's time by settling last minute. Informed Cardiff court of the same, all the while informing HSBC of what I had written.
    Finally submitted above suggested settlement claim to DG Solicitors via fax, accompanied by original claim and original schedule of charges being claimed. Did this repeatedly for the last 5 days or so, while doing same on HSBC's emessage service.

    I think they'd finally simply had enough of me, their offer of settlement as above was waiting for me when I got home this evening.

    Very glad this is over, but nonetheless encourage everyone else to carry on with it and settle at whatever level suits your particular needs. Encourage your family and friends too.

    Oh, and use the rest of this site too, there's some damn good stuff on here. Cheers Martin and all for the encouragement this site and others has provided throughout.

  • Thank you to everyone on this forum for their help and guidance. I have been trying to reclaim my bank charges since February 2007. I have been reclaiming from Halifax, ended up going down the MCOL route. After receiving notice on Friday that they intended to defend their claim in court, yesterday the refunded the full amount into my bank account. I also received the usual letter stating that it was no admission of liabilty but they were paying as it would cost too much to defend it in court.
