The story: Sent off the letter requesting my money back including interest i also included the sums i was refunded and deducted that from the total, I had no reply from rbs after three weeks so i phoned them to find out why i had no response from them, They told me there was a waiting time of 8 weeks due to the amount of claims being made, I decided to wait on their offer which was due before the23rd june, About 5 days before that an offer of £2746 came through which was what i was claiming for but they said they found it UNFAIR:rotfl: they had to pay interest to me and as a good will gesture they would pay the above amount:dance:0 -

I followed Martins instructions exactly,
Sent cheque for £10 to get the bank to supply me with a list of my charges for the last 6 years.
sent letter asking them to reimburse the charges plus intrest as i thaught that they where unfair.
got reply from bank......no your not having them!!! lol.
threatened court action.
got reply from bank....your still not having them back !!! lol.
started court procedings from this website..
recieved letter from bank offering £464.00
ignored that.

I have received and have been dealing with the proceedings, which you have issued against Halifax plc in the Northampton County Court.

Your claim relates to bank charges debited to your Account. These charges were debited to your account in accordance with the account terms and conditions, which you agreed to accept, and by which you are bound.

I have returned a form of acknowledgement of service to the Northampton County Court indicating that Halifax intends to defend you claim. However, on a purely commercial basis, it will cost Halifax money to defend your claim in terms of the legal costs that will be incurred. It is unlikely that Halifax will be able to recover these costs (even if the bank wins) because your claim will probably be allocated to the small claims track, in which costs are not generally awarded.

For this reason, but without admission of liability, Halifax is willing to reimburse £1005.00 in respect of the bank charges incurred, together with £307.17 in respect of approximate interest that Halifax has calculated was charged on your account as a result of charges. the Halifax will also reimburse £120.00 in respect of the Court fee. This amounts to £1,432.17 which will be paid into your account within the next 5 working days. this amount is inclusive of the £464.00 already offered.

Please note that if an interest payment has been made, this constitutes 'taxable income' and any tax due on this should be dealt with between you and your local tax office.

HSBC today sent me a letter offering £1645.00after going for £1800.00. I didn't have to go to court stage, I just sent the two letters and they wrote back within 9 weeks stating the above and offering to pay me in fourteen days. It was so easy and we are over the moon to have beat the bank. :rotfl:0

:beer: I was quite nervous about claiming back the charges on our account. Six years ago my husband was paying out a fortune due the CSA, although my ex didn't seem to get caught. This lead to us being overdrawn most of the time never catching up. Anyway, I recently (May07) wrote to the Woolwich (now Barclays), using your template letters. The amount totalled £1,300. I requested details of all statements for 6 years which they sent to me. Within a month of requesting the above amount, we have received a letter offering £1,029.00 not admitting any wrong doing of course.
Thankyou Martin for giving me tools to go ahead. We have accepted. We also changed banks to the Halifax and have this month received the £100 bonus. All in all a good couple of months. May I say that we are now in control of our finances, and never go overdrawn, it was a scary few years back then. We have not been told to bank elsewhere it was our decision to switch. :T0 -

I claimed for £2100 from HSBC and received an offer of £1900 just before due to take the claim to court.
Safe to say I accepted and am having a good weekend!!:beer:

Started claim back in April. After receiving list of charges for last six years. Sent letter to bank requesting refund but was politely refused. No response to second letter so started court proceedings. Received letter from my bank this morning with a partial offer which I have accepted.

:money: :beer: hi folks a massive thanks to martin and everyone on here with their advice etc. started our claims in march with halifax looking for me and my wifes reimbursements. 2 days before the 28days mcol was running out they settled most of claim for 5,300 (they haggled over the phone a bit as they say the 6 years start from when they actually acknowledge any court claims-cheeky b.......s.) we thought we got this amount so going to court for the other 1,350 claimed was worth it,but we thought knowing our luck we,d lose, but more than happy with getting anything back-result. once agains thanks

Have been very patient not got angry or shouted down the phone at anyone, had my claim declined, looked at the site help on here, rang them back last Monday asking for re-evaluation, called them again on Wednesday, spoke to a really nice chap who gave me some inside information ..hee hee.. he said I would receive a letter offering me 50% of what I had claimed, but to call the bank and decline their offer and ask for renegotiation ( have a realistic figure in mind.. remember some of us got ourselves into these messes ourselves some didnt.. I did!) I said I would be prepared to accept 80% of the figure and would settle for £2800 and a letter of confirmation. Bank accepted over phone next day the letter was behind the door and the money is safely in my bank where it belongs... thank you . Trick is be nice, stay calm, and dont get too greedy.0 -

Story: Started the process in Mid March, had trouble getting my statements (they sent the oldest statements twice and not the more recent ones, when I requested them, they charged me though until that point, they had not cashed the £10 cheque I sent when statements were requested). I then wrote back after doing the calculations, received a letter after a week saying they were looking into my claim. This satisfied the 14 day time limit for a response to me claim letter. I then had to wait approx 7 weeks for the offer, I was on the verge of contacting them once or twice as I worried they may claim to have posted something but if they did not receive a response after 8 weeks, the matter was closed. Fortunately, the letter came on Friday for my claim minus the interest. I have sent the reply to accept back by recorded delivery. I also used recorded delivery when I sent my claim letter. if the Royal Mail lose it, I would automatically assume the bank were being awkward so best not to allow that to happen.
I can only say thanks to Martin for making this possible, his letter templates were invaluable. I know of several people I work with who have also successfully done this. My only concern is that the offer letter sytes that the bank are entitled to make their charges and set the rates they want to. In signing to accept the offer, I suspect I am also signing to say I accept any future charges. I will not do so of course but reclaiming in future may be more difficult though I am determined not to be in the position to be charged in the way I have been previously. I wrote to First Direct requesting copies of statements in February, then guilt/apathy/ fear of failure prevented me from doing anything with them. Last week (23rd June) I wrote claiming after being slammed with another £149 and a monthly charge because I don't earn enough. I received a letter yesterday dated 27th June offering me the above amount. It just goes to show they don't have a leg to stand on and they know it. Keep with it everyone and thanks Martin. By the way, they haven't closed my account and are refunding the money back into it!!!0
