Hello Everyone,<o:p></o:p>
<o:p></o:p>
I applied for my statements in March and they did not repsond under DPA within the 40 day time limit so I complained to Information Commissioner's Office and bingo I got the statements and I did not have to pay the £10 fee!<o:p></o:p>
<o:p></o:p>
I wrote to them on 30th May 2007 and got a decline letter on 6th June 2007, but following advice on this website I rang and asked for my claim to be re-evlauted, they said they would reply by 25th July 2007 with the outcome.<o:p></o:p>
<o:p></o:p>
I rang again on 22nd June 2007 and was told it was still to be looked at and that I would have a reply by 25th July 2007.<o:p></o:p>
<o:p></o:p>
Got home from work on Monday 25th June 2007 and they had sent a ‘goodwill offer’ of £42.50, so taking advice off this wonderful site I rang on the 01977 627313 and got a very nice gentleman in the name of Steve Ramsey, who said I gather your not happy with the offer and how much are you claiming for? I said £789 and he said lets have a look and lets round it up, how does £790 sound? I said fantastic!!!<o:p></o:p>
<o:p></o:p>
The money is to be paid into my account, it was very simple!!! I did not even have to threaten court action.<o:p></o:p>
<o:p></o:p>
Thanks to Martin and this wonderful site I have got money back!! It proves to be patient and it has paid off!!!! :money: :T <o:p></o:p>

P.S. - I used to work for the Halifax and this makes it so much sweeter, so I have so had the last laugh along with all the other customers who have got their money back!!!! :j0 -

Nationwide
amount claimed £3166.16 +interest & court charges.
they are sneaky when i took them to court they got the 28 day continuation & a solicitor , but i heard nothing from them in the whole 28 days, i entered a judgment on the 16th June, & still nothing then my husband suggested i look in the bank account (we had changed banks & stopped using that account)
& low & behold they had paid it back on the 7th of July but not once had contacted me to let me know it was there, now as thats a dormant account it is taking us 5 days to get the money out but at least wee won!!!!:j:j

Bank Building Soc: Nationwide
I wrote to Nationwide requesting summary of charges on 20/3/06. I waitied, and waited, and waited until the 40 days allowed under the data protection act was up, then phoned their data protection department on the 41st day. I left a message with my name and phone number and waited another couple of days. I then had to phone again and leave another message. Two days later my information landed on my doormat, special delivery.
I totalled up my charges, added the interest and wrote my first letter, to which I had a standard reply in about a week.
I then wrote the 2nd letter, threatening to take them to court, to which i received no reply within the 14 days.
I then filed with MCOL and paid the £120 fee. The claim was to be served after 5 days, but Nationwide saved me the wait and Acknowledged the very next day, 4th Jun.
I have been waiting with baited breath every since, with the deadline for defence (2nd July) looming I was getting nervous. No need though as the day before yesterday (27th Jun) I received two corrections into my account totalling £1250. This is just under what I claimed before interest and court fees.
I am now looking forward to 2nd July, when I am hoping I can enter a judgment for the full amount (providing no defence to my claim has been entered) and get the rest back!
I can't even begin to thank the people behind this site. This sort of money is a big deal to me and couldn't have come at a better time, as the Mrs and I are due to complete on our first house in a few weeks :T
A huge thank you to all involved :beer:0 -
Bank:Halifax
Ammount Claimed: £1952
Ammount offered £1500:rotfl:
Typical story
Feb: Sent first letter: rejected and i should be grateful that Halifaxd did not charge me to investigate the claim :mad:
Second Letter: IGNORED :mad::mad::mad::mad:
18/05/07: Third Letter: 14 day response i am willing to accept £1500 NO response
:mad::mad::mad::mad::mad:
13/06/07: filed claim with MCOS Halifax have until 2nd July to respond
27/06/07: Offer of £1005.50.... made in response to 18th May letterwhere does 50p come from i suspect they are using a deal or no deal banker system.
27/06/07: Called to refute 'there is room for negotiation here' Hmmmmm really stayed quiet before asking for full ammount £1952, not going to go that high £1500 offered waiting to have that in writing before i accept.
i will wait until Monday and if they've not filed i might just claim the full ammount £2392 inc interest + £120 court fees is that greedy or sensible??? Either way i will accept £1500 good job well done Martin:T:T0 -
1. I started the affair in Jan this year (only took one weekend day to retrieve all my bank statements from the loft!) - claim of £1197.
2. An initial offer by Barclays of £500 didn't pan out as I stated I'd like that amount in the form of a cheque - and not paid into my overdrawn account (I could hope!).
3. I went through moneyclaimonline in Feb - Barclays naturally scuppered an early win by filing at the last second.
4. 'Directions Hearing' (sans Allocation Questionnaire) in June - on the 28th (yesterday!).
And - oh yes! - it was bank day at my local court - with bodies spewing out of the waiting room
Counsel for Barclays was awaiting me ... hmmmm?
A-ha - they said that their client was trying to get this letter to me - for full & final settlement. Ok - it discounted £9 in daily interest which I raised at the time I requested judgment on MCOL - but who'd be a pedant?
We went before the judge who adjourned until the end of July - with the judge stating that once I'm credited I won't even need to write to the court as the case would be thrown out.
Oh - I'm overdrawn at Barclays - but my sum refunded of 1317.41 means that I'm close to finishing my business with them forever
A big thank you to ALL on this forum for their hints, advice and tales - and 'Good Luck ALL' going forward0 -
