  • Did pretty much everything by the book, sent a polite letter asking for money back, was told no. Used money claim online and issued a claim. They sent a cheque for half which I returned along with a rejection letter. Today i recieved an offer for £346.51 which is all charges and court fees PLUS INTEREST.

This is only a small amount compared to some of the people on here but my advice is DONT BLINK! they will chicken out before you do.

    Very happy G-Sensei

  • With just two weeks to go for the Halifax to defend my claim in court, I checked my online banking to find myself 1,371 better off! This was the amount I claimed plus court costs. Later that day when the post arrived I had the letter saying that it would cost too much to defend blah blah RESULT!
All of this took just two and a half months so thanks to everyone for all the encouraging posts and big thanks to Martin!
Hang on in there all of you who are at the nail biting stage, the proof is in the pudding so to speak.
My new summer house is now ordered and paid for courtesy of the Halifax and there odd way of forcing me to save! All I need now is nice weather to enjoy it! :T

After all the publicity i used a sample letter from the BBC sent it off to Halifax in mid March. I received the standard we are looking into it will take 8 weeks. To be fair to them they sent me a few letters at this stage informing me what they were doing and apologizing for the delay. Finally received the standard charges wee applied correctly and you agreed to them when you signed up letter.

Left it a week or so because i'm lazy, then downloaded the standard second letter template from MSE and sent it off with a 14 day dead line, went on holiday for a week and missed the 14th day, as it is so close to payday thought i'd leave it till friday before going through MCOL. Received a letter yesterday with an offer for £1029, for a claim of £1980.

I was thinking of accepting it until i started reading this forum today, called the number on the letter and said i wasn't happy as the offer was barely half what i had claimed. The lovely woman on the end of the line then asked "well how much would you settle for? I told her i was looking for more in the region of £1750/1800. And she just said well if i increase the offer to £1800 will you take it.

    Result
    Claimed £1980
    Offered £1029
after phone call waiting to recieve £1800

Motto call the number at the top of the letter, it seems the staff hae authority to go to a certain limit.

Thanks for all the advice guys

    Bank: First Direct
    Amount Reclaimed: £1,654.50
    Amount they paid: £1,406.00
    The story:
Sent initial letter on 16th June requesting six years statements.
Received the statements on 23rd June.
Sent letter requesting £1,654.50 on 25th June.
Received offer of £1,406.00 on 27th June.

What can I say, very very quick. I'm happy with the offer as it's money I thought I'd never see again. I did not threaten court action at all, just asked for replies within the statutory time limits. They have also said they will not close any of my accounts, so I'm very happy. Money will pay for my holiday in December!
  • URL%5DBig thanks to Money saver. Really thought I was going to court. Paid the court costs through Money Claim and was waiting for the 5 days for the claim to be serviced. Came home tonight to find a letter from the bank stating that in no way it believed the bank to be in the wrong, but as a gesture of goodwill it had credited my account £2185. Yeehawww
