    Just wanted to let everyone know about another success and hopefully encourage others to pursue their money back. After being charged £25 for being overdrawn for about 5 hours and blasting HSBC on the phone until they refunded it, a friend mentioned that thousands of people were claiming as the charges are actually illegal I decided to look into it. From reading the info on this site I sent the first letter April 30th. Got a reply back 2 weeks later saying they were looking into it blah blah. After having no reply for another fortnight I wrote another letter saying I'd accept a grand. Still no response. So I called them up. They informed me they were legally allowed to take 8 weeks to answer, so I decided to let them have this and sit back and wait. It paid off, on the last possible day they could reply they did, offering me the above amount. I signed the acceptance form and sent it 4 days ago. I will receive the money within 14 days. I am really chuffed.

    I'm not against the banks charging to cover costs (coz at the end of the day I was young, naive & a bit reckless with my money) I just don't agree with people being ripped off, esp. if they are trying to get out of debt at the same time!

    Thanks for all the useful info on this site and please do keep going if you're claiming your money back.

    Sent 2nd letter asking for repayment of charges or I would take court action if no satisfactory reply within 14 days. No answer in that time so rang them after another 5 days only to be told,(politely),that they had up to 8 weeks to reply from receiving 1st letter but should get offer around 7 weeks. Thought they were time-wasting but sure enough an offer was received at end of 7th week offering slightly less than my claim,(£270 less). Decided to accept this as I'm only 10% down and it's money I thought I'd never see again and I'd already decided to accept £2000 or even £1800 if it was offered. So stick with it, you'll get there in the end. beerchug.gif

    Well things are going well....came back from holiday to find a letter from Lloyds offering £3316.98, which was more than I had claimed for through MCOL as they included the £100 for the Allocation Questionnaire ,which we never filled out and £46.98 for the additional interest at 0.021% a day since the claim was filed. Due to be in the bank account tomorrow.

    Next day I got a letter from Halifax paying me my total amount of £200.63, which when I checked was already in my account before I received the letter.

    So running total : Natwest £4936.00
    Halifax £ 200.63
    Lloyds £3316.98

    Only my OH Lloyds to pay out now and this is with the court and about 3 weeks behind our joint claim which is the one paid up.

    Really simple. I started and completed the process just over 3 months and only using the advise and letter templates from this site. My total charges amounted to £1900, I added interest and then court costs. Three standard letters, sticking ridgedly to the legal timescales and then one online court application and I was given a court date.
    I was beggining to worry after the first Lloyds success case but stuck with it. I had 3 refusal letters back from the bank trying tell me that the charges weren't defaults so I couldn't reclaim them. I had no offer of settlement or any other correspondence. Literally the day before I was due in court Lloyds deposited £2071 in my account, ref bank charges refund. I have still had no other confirmation or correspondence from them.
    I phoned the court, canceled the hearing and have had to write to the court confirming the details. Transfered my cash straight away and that' that. Thanks very much to this site and thanks Lloyds.

    Good news!

    Bank: Halifax
    Amount Reclaimed: £1028 (turned about to be about £750 as I had claimed back to the beginning of 2001, rather than June 2001)
    Amount they paid: £620 (awaiting transfer of funds)
    The story: All pretty straightforward really - asked for the statements and received them within 40 (working) days. Wrote and requested charge total. Received the 'sorry to inform you' letter. Called and asked for re-evaluation. Was offered £388 goodwill gesture. Thought they could try harder! Called today and was offered £620 (total was about £750) which I duly accepted. This will pay off my £260 O/D and leave me with about £360 :T

    OFFERED: £1300

    Wrote first letter beginning of March, heard nothing for almost 3 weeks. Called and put through to various depts that were in foreign Countries where no one understood a word what I was saying or had a clue. They kept hanging up. Got really p****d off, called back and said I was on hold for Customer Relations. Luckily got put through to correct dept!!!! Simple process, the Advisor said new system is to call them, ask for 6 years statements, no cost.
    Waited over 4 weeks for statements, calling every other day asking where they were, kept getting fobbed off that they were sent, then they were in the system waiting to be sent, no one had a clue:T :beer: :j :rotfl: . Told them I would be issuing Court proceedings immediately, Adivsor promised they would be with me by the 40th day. Waited to see if true, day after, they turned up! Worked out how much, called C.R. again and I told them how much I wanted to Claim. Didn't have to send statements back. Was a bit apprehensive as thought this might be a way of delaying. Two days later, standard letter turned up saying they were sorry and looking into Claim and would respond by end of May. Thought about getting heavy but decided to carry on the pleasant approach. called every week asking if any progress, said it was in a queue awaiting investigation. Received another letter to say it will now be end of June!.
    Only last week decided to call and say I was definately going to issue Court proceedings but next day received an offer of £1300.
    Will accept this as can't be bothered with waiting any longer and will clear O/D and a credit card!
    Am now going after credit cards!

    Success at last - I'm so glad I waited for the eight weeks and then started pushing for a response. Used the message facility online to chase.

    Claimed against two accounts:-

    1st for £1,206 - offered £1173.85
    2nd for £1328.00 - offered £1121.58

    Just waiting for the offer letters now - hope they dont take too long to arrive :D

    Thanks to this site I am now over £2k better off.

    Thought I'd tell you my story.

    I've followed all the advice given on this site and in the forums. Back in Feb 2007 I started the process asking the Halifax for £1300 and another £400 of interest. I got the usual run around stating they were looking in to it. I finally got the "sorry, charges legal" letter and rang up asking for it to be re-evaluated. The bloke told me that they do this with every complaint as they are absolutely snowed under with complaints. Told me it would be re-evaluated and I'd hear back within 14 days.

    I didn't so I rang the bloke back. He told me I'd get an offer within 2 days. Lo and behold, I did, but it was only for £600.

    So, this morning I rang again and asked the bloke if he could re consider. He then offered me £850. I said "is there any way, you could offer a higher amount?". Pretty much immediately, he said yes and offered me 100%. He did say that the only way I would get the interest was if I won in court.

    I'm happy with my money coming back to me.

    My advice is. Follow the advice you find here and when you ring, be polite, reasonable, calm and cheekily persistent.

    I'm just waiting for the cheque, then I may have a beer. just to be sociable though.;)

    Amount Paid: £4700 (including charges)
    Story: I started in february and used the letters on this site, Abbey tried to stall at every stage - asking for more time to investigate etc, but I stuck to the dates and eventually went to Moneyclaimonline. Abbey filed a defence so the hearing was moved to my local court (I had to pay another fee), and then the date of the hearing was set for 16th August. We were given till the 10th June to submit any final documents to the court, and on 7th June Abbey caved in and said that while admitting no liability, they had decided to settle in full, including the charges.

    Don't wimp out - stick to your guns and you'll get it all back!:rotfl:
