I have just received a 65% settlement of my claim from Abbey - very happy to have got that. As per previous posts, they tried to stall and kept asking for more time but I eventually filed a claim via the website.
Wouldn't even have considered it without the VERY useful pointers and sample letters on this site. Have recommended it to several other people who have also been successful. Keep up the good work!:beer:0 -
Halifax £3400
I sent my LBA on 10th May and finally received the remainder of the money into my account on 18th June!
It's been such a long haul since I began the claim back in December after seeing Martin on the breakfast news. I wouldn't have done anything about the charges if it wasn't for him & also all the brilliant people on this site who help each other along & inspire them!

Yipee! I've managed to claim back my bank charges from HSBC without having to go down the legal route. In fact the bank paid out after my second letter. I initally requested £881.50 but I have agreed to accept £720. I know it is quite a bit less than I was originally claiming but this is better than nothing.
I am now trying to encourage my husband to do the same.
I would like to thank Martin Lewis for all of his advice and the guidance steps he gave on claiming these charges back, plus other contributors. If I hadnt had used this advice I wouldnt have known what to do.

Both of the above sent standard letters offering full amount without admission of liability in any way.
Bank: HSBC
Amount Claimed: £1540
Bank: Barclaycard
Amount CLaimed: £643
Bank: Lloyds TSB
Amount Claimed: £290
The above three are all in the small claims court.
HSBC ignored all correspondence until a week after the claim was submitted to the courts. They offered a low amount and I had incurred a further £120 court fees so rejected offer.

The story
Sent for statements, added up fees. Sent 1st letter beginning May, got repluy saying no way! Sent letter threatening to go to court if no answer within 14 days, no reply. Called them and told they would assess claim in abount 8 weeks as they were busy, said no good and filed a claim on Moneyclaim co.uk(small claims court). Got letter offering me 1280.00 Saturday. Called them to say not good enough and the court case would still go ahead (very politely, I was a little scared, but didn't show it!). They did not realise I was taking them to court and asked if I would be prepared to discuss matter as they did not want to go to court as it was expensive. Explained (again very politely) I would accept nothing less that 2397.00 plus 120.00 court fee. They agreed within 2 minutes and I will receive my money within 14 days! Go for it, don't be afraid be charming but firm.

Wrote accepting as part payment but requested remainder as a "further goodwill gesture" - pending (on dodgy ground as the account has an outstanding overdraft of £1200)
First Direct
Claimed £4926.50 on 1.3.07
Had letter saying I knew about what their charges were and they are unable to agree to my request......this letter constitutes the bank's final response..blah! blah! blah! I was all prepared to complete the MCOL but couldnt afford the fees!!!! so I filled in a complaint form (14.6.07) and sent it to the Financial Ombudsman Service (claiming the interest too) - had letter from FOS 16.6.07 saying may complaint will be allocated to a caseworker.
Still in shock....Rec'd letter from First Direct 22.6.05 and I quote "I write further to your complaint lodged with the Financial Ombudsman Service, whilst there is little value in repeating what has been outlined previously, I would like to draw this matter to a close withour further delay. As an exceptional gesture of goodwill, I am prepared to offer you a refund of £5125.20!!! - result
Barclaycard - 2 accounts

I know i could have pushed for the ul amount but i am sooooooooooo happy with what i have been given. I didnt think i would ever get this amount back. This reduces my debts big time.

Claimed £335 plus interest. Paid £481.24 (including interest & court fee). :j
They paid up a couple of weeks after I submitted the Allocation Questionnaire to my local court.

Can't believe how simple it all was! One letter as per the template, got a letter back to say my claim was being considered, and a few weeks later, a letter saying my claim was being paid as a 'goodwill gesture'. And today, £617 credited to my account! It's like getting free money! Many thanks for the excellent advice!0
