    I never though i'd say this but A&L have paid out!! I started out in January - Yes January! and was due in court today, to cut a long story short, i was made lots of paltry offers but stuck to my guns and received my money yesterday.

    So, to everyone out there taking on A&L, stick with it they DO pay out - but only at the very, very last minute with lots of faffing about beforehand.

    I successsfully claimed against the beneficial bank and mbna. I got £1301 back for beneficial, the full amount that I was claiming for and mbna, I got £800, I put in a claim for £1000, really pleased. In the middle of claiming back from the rbs, so fingers crossed.:T

    It has taken months of writing, court action and brown trouser moments! My case was rejected on Moneyclaim and transfered to my local court, Nationwide refuted everything. Was i scared? Hell yes!

    But...

    I followed Martins advice to the letter and today got a letter from nationwide saying they were refunding everything i asked them for, cancelling my overdraft fee this month and not closing my account :)

    God luck all and hold your nerve, together we are strong!

    The story:

    Followed the templates exactly as shown on the site.

    1. Requested details of charges (£10 cost).
    2. Sent 1st Letter - Standard 'No' reply letter.
    3. Sent 2nd Letter - Ignored.
    4. Filed claim with MCOL. (£80 cost).
    5. Bank acknowledged within 9 days.
    6. 26 days after filing with MCOL recieved a letter saying it would be too costly to defend the claim etc etc saying they would pay up the full amount.
    7. Full amount placed in my bank the next day.

    My views : Do exactly as this site says, stick to your guns, don't let the banks delay, stick to MSE suggested timescales, don't correspond unless it's on your terms, and wait for the full amount.

    Thank you to all those that have offered support and advice throughout my claim, and good luck to all those claiming or thinking about it. :beer:
  • Hi all, I think I can safely say that I didn't stick rigidly to the timetable for claiming back my charges.

    5th April 2007 - Sent Data Protection Act request
    21st May 2007 - Received statement of charges
    22nd May 2007 - First letter sent off requesting charges
    5th June 2007 - Received standard get lost letter
    5th June 2007 - second letter already prepared sent off advising I intend to take to court if no satisfactory response to request for repayment within 14 days.

    About a week after I sent that 5th june letter off, I found out about the Ombudsman route, so I gave them a call just to ask about how they could help. They said that if it could be shown that the Nationwide's letter I received on 5th June was a final response, then I could start the complaints procedure earlier than the 8 weeks.

    So I filled out the complaints form from the Ombudsman on the 14th June and sent it off, I received a reply from the Ombudsman on the 20th June saying that my case was awaiting allocation to an adjudication officer. In the meantime, I decided to write to the Chief Executive saying that I wasn't happy that I had received a computer generated response to my own concerns, and that I found it highly unsatisfactory that the only reason I had been burdened with debts was due to their unlawful penalty charge regime.

    The Nationwide it seemed had also been in breach of the data protection act because they'd failed to change my address details, despite me following all necessary procedures to do so, they'd allowed me to withdraw money when it wasn't in the account, and they returned direct debits unpaid, when the necessary funds were available. Also, despite being turned down for one of their credit cards, they'd allowed me to log in and increase my overdraft on numerous occasions. (which I only needed to do because of the charges)

    I received a letter this morning saying that Mr Beale is sorry to learn of my disappointment in the Nationwide, and "on this occasion only" they are prepared to offer me the full amount I have claimed as a full and final settlement with no further conditions attached, so I sent the acceptance form back straight away, and according to their letter, I should receive a refund within 14 days!

    Keep up the good work everyone, it's your money the banks and building societies are unlawfully taking, and you deserve it back.

    The story started back in November. I followed MSE all the way through and then got to the court process I was sending my bundle when I was offered a out of court settlement for the whole of the amount.

    I want to say a massive Thank you to all those who work at MSE and Martin of course because without you this would not have been possible xx

    BASICALLY EVEN THOUGH THESE WERE RELATIVELY SMALL AMOUNTS I HAD TO TAKE THEM ALL THE WAY. THIS FOR ME IS 2 DOWN WITH 3 TO GO. I AM STILL AT VARIOUS STAGES WITH HALIFAX (1200) MBNA (700) AND CLYDESDALE (1750).

    MY MESSAGE IS STICK IT OUT GUYS. THERE WERE PLENTY OF TIMES WHERE I FELT WEAK AND BEATEN WITH TAKING ON 5 BANKS AT THE SAME TIME. (HALIFAX IN MY OPINION ARE THE WORST AND HAVE USED EVERY TRICK IN THE BOOK AND BEEN DELIBERATELY OBSTRUCTIVE THROUGHOUT. IE 82 DAYS TO EVEN GET THE STATEMENTS)

    NOW IVE WON ON TWO OCCASIONS BACK TO BACK. THE OTHER 3 ARE CLOSE BEHIND. I HAVE THE CONFIDENCE TO TAKE THEM THE WHOLE WAY. IT CAN BE DONE. I HAVE FOLLOWED MARTINS ADVICE AND STUCK TO MY OWN TIMETABLE. PLEASE, PLEASE, IF YOU ARE STILL CONSIDERING DOING THIS, DO IT NOW.

    TO MARTIN AND ALL HIS TEAM, THANK YOU SO MUCH FOR ALL THE ADVICE AND ENCOURAGMENT. THE ONLY DEBT I NOW OWE, IS OF GRATITUDE TO YOU ALL XXX

    Lloyds - Claimed £464, received £419
    Halifax - Claimed £1087, received £1482

    Lloyds claim started at the beginning of May, received the typical letter on the 11th of May saying our charges are fair etc, phoned them up after about 100 attempts saying not happy with this and if I dont get a reasonable offer I will take the case to court. Today received an offer of £419, £45 difference so not complaining about that.

    Halifax, Claim started on the 12th of April for £1087 with standard letter claiming back charges, sent follow up on the 2nd of May, received standard reply on the 31st of May saying charges are fair. Phoned up on the 4th of June for reassessment. Letter received on 20th of June saying we will pay £741, phoned up again and said that the offer was not enough and immediately I was offered £1087, I dropped in that I have had further charges and I would like these considered up to todays date. Just got a phone call advising that they will pay £1482 in final settlement. Over the moon with that considering my recent charges are nowhere near £400. Anyway I am not complaining.

    Now just Clydesdale bank for the wife.

    The story: Started January 07, initially refused, went to FOS officer,FOS officer recommended the bank refund, bank offered full amount, accepted, recieved letter today saying account will be credited in 10 days.

    Went through the procedure as per very helpful instructions, got as far as a court hearing date (in November!), out of the blue letter arrived saying too costly in time and expense to go through the courts so offered to settle all of the claim including interest and court fees.
    Money paid into account 7 days later:D :D:D
    May I say a huge thank you to Martin and the team for a most helpful and empowering website, couldn't have done it without you!! :T
