  • :beer: good news bank payed up today after three months not bad i thought,Lloyds tsb payed me the lot i clamed for ,it went as far as they was going to put up a defence in court and then to day had letter telling me they payed the outstanding sum in to my account. for all that are still trying stick with it you will come out on top????

    The story:
    We sent the 1st letter on 25th March and waited 4 weeks for the standard letter saying no, our charges are lawful blah blah blah.
    Following Martins advise we sent the 2nd letter on 30th April and gave them 14 days to respond otherwise we would start court proceedings.
    On 24th May got the letter to say 'sorry you are not happy' but we have already outlined our position.
    Started MCOL on 15th May and they acknowledged on the last day :mad:
    They had until 18th may to enter a defence and got home tonight and the money was in the bank !!!:j :beer: :D

    We never thought we would win, I read other sucesses all the time and I never thought I would be writing this.

    Thank you soooooo much Martin, I am off now to pay some bills and treat the children. :A

  • I have been using Martin's site to help me reclaim my bank charges from the RBS. I asked for my statements, sent a £10.00 cheque, they never took the money of me but sent my statements anyway, I then worked out how much, over the last six years they owed me, this was £1519.00, the interest was £270.00(i never claimed for this), anyway sent my letter of along with all my evidence, I recieved a letter 4 days later saying they would look into this, 4 weeks later I phone them up asking about my claim they informed me they had an 8-10 week back log, but my request would be looked into I pestered them a couple of more times by phone, the last phone call was on the 10th June I informed them I wanted my offer by the 13th June, and when I finished work that day the letter was waiting for me, it said that as a gesture of goodwill and without an admission of liability or error, they would offer me £1519.00. So thankyou martin, I am going on holiday in a couple of weeks so this will help greatly.

    I had ten years worth of statements (what can I say I never throw things away) so did not have to request them. Sent by recorded delivery on 29th April. Was about to write to see what was happening, letter received today offering the above amount, have accepted it so will now see how long it takes to clear through my account.

    I was advised in the letter that if I did not now accept any future charges my account would be changed to a 'simple' account with no borrowing facility. No mention of any penalties against my present account so fingers crossed they won't remove my overdraft.

    Our problem started when after 15 years with the bank we were advised that we had to amalgamate our two current accounts because the budget account that we used to pay our direct debits was no longer available.

    We had an overdraft facility of £1000 on each account. When we started using the new account we soon realised that our overdraft was now only £100. When we queried it we were told that we were new customers ahd had to earn the right to an overdraft. So the previous 15 years were completely ignored.

    The story:
    Despite Living in Scotland and only supposed to claim for 5 years charges I chanced my hand and claimed for 6! As it was a business account I had all my statements in the house and did not have to send away for them.

    I sent both letter A and B taken from the website and got replies both times saying that were assessing my claim. I did wait longer than the two weeks I said in my letter but eventually got a very cheeky letter back saying how they were just in charging these charges BUT they offered me a refund of all the charges I had been charged (over 6 years!) minus the interest I claimed.

    I am delighted with this result and want to say a big thank you for all the information that has been provided by this website, I would probably not have continued had it not been made so easy by you. Keep up the good work everyone and give it a go! THANK YOU!

    Sent SAR with £10, statements arrived with letter saying cheque was ripped up and no charge made. Sent in claim and within two weeks offer made.
    No fuss really got the usual letter we make payment as goodwill gesture without admission of fault, reserve the right to close account and charges will remain as in Terms and Conditions. No LBA or Court claim required.

    SAR sent, statements arrived but no letter, 6 years worth in one brown, torn envelope. Sent off claim got two letters both dated 10 April both saying we are considering your claim.
    No response so sent LBA
    No response so sent email with a read notification.
    Email response within minutes, response saying we sent offer on 10 Apr making offer you have obviously not received it, we will send out a duplicate within the next few days.

    Within four days got the usual letter (undated) (so no proof it was a duplicate of the one they say was sent on 10 April) we make payment as goodwill gesture without admission of fault, reserve the right to change account and charges will remain as in Terms and Conditions.

    HSBC No1
    Claimed £1500+ incl interest.
    Claim currently being considered. LBA prepared ready to go. :D

    SAR sent The FSA 8 weeks rule expires 27 Jun.



    Banks changing tactics to delay payment of claims. They want to hang on to our money for as long as possible (After all they will still be earning interest on it) So letters go missing, claims through court are defended at the last minute, and stumbling blocks put in the way in the hope people give up.

    Well done Martin and your team and pat on the back for joining forces with CAG to fight the strike out attempts in Hull.

    Wrote to Natwest in March with template letters at Martin advised. Had one letter weeks after claiming money saying dealing with it and heard nothing more. Heard scare stories about courts backing banks and almost gave up. Filled out court doc's on line but didn't submit and then yesterday had a letter from bank saying not accepting liability, good will gesture etc etc sign this and we'll pay up!!!!:j Needless to say that we're ecstatic - even though the money was ours all along and we nearly lost our home over this! Just one thing that worries us, they say they will credit our account with funds yet we haven't been with them for nearly two years. Wrote with new bank details and said if they can't credit that then we expect a cheque by return but would like to know what the timescale is for obtaining payment in this situation?? Anyone with similar situation i'd be pleased to know the outcome?

    Didn't think I would ever be posting on here - claim started at the end of February, got the usual fob off letter to say charges are fair etc etc - filed MCOL, they acknowledged the claim then sent me a letter to say that on a purely commercial basis they would be settling my claim - Yippee!!!

    Money in account today!

    Well good old Nationwide took it all the way, putting in a defence but settling a week later. No need to go to court.

    Total time to win took around 4 months but well worth the wait.

    Started the process at the end of Feb, after hearing Martin on the radio and being spurred into action. I've already received £520, which was solely 'referral fees', but this was the big one - all the DD non-payment fees. Went through MCOL, and was looking forward to appearing in my local court on Monday 25th - all prepared, 99.5% sure I'd win. Natwest offfered £832 on 14th May; I didn't even dignify that by replying!:p Yesterday I faxed them an offer - if they'd pay £2200 I'd drop the case - and arrived home to find a cheque for £100 more than I was claiming!:rotfl:
