    The story:Halifax paid with 1 day left to defend from a mcol claim. they paid out in full including interest and added in all additional charges they had made on the account.

    Recieved a :shhh: :shhh: letter for Lloyds solicitors today offering full amount with court fees and interest totaling £2388.22, can't quite believe it cause started in Jan so keep going everyone the feeling is GREAT!!!! Good luck to you all... Look out Cap 1 you're next:dance: :dance: Oh and I promise never to get in this situation again:naughty::naughty:

    Just thought I'd let you know that we have just won against Barclays got a full payout including interest and court costs 7 days before going to court and they have'nt intimidated her by closing the account.
    I say we because I have helped my daughter reclaim £2,400+ she lives in Somerset with no internet access, I live in Cheshire with internet access and I couldn't have done it without Martin's Money tips.
    We asked for 6 months bank statements on 15/12/06. Barclays made a ridiculous offer £1,000 of the £1900+ she was owed so we set the ball rolling with Moneyclaim Online.
    To cut a very long story short Barclays played us right along the line, defending on last minute, etc. We had a court date of 4/6/07. I told her to ring the court 14 days before to see if they had the court bundle and did they want to settle out of court. The guy said they didn't want to go to court and he would send her an offer in the post immediately. She got that a few days later and it is in her account today. It was getting quite hairy near the end after all the recent upsets with county judges, but we held our nerve. Good luck to you all.

    today i got 300 put into my bank account/ halifax

    as a good will gestur ha ha

    sent the 2nd letter threateneing with court ( my charges are appox 500 0 so i am very happy with the 300

    did a big shop.he he he.thanks halifax

    Royal bank of scotland.
    Amount of claim =£2377.00 (with interest)
    Amount received =£2377.00

    I sent the initial letter and receved the statements ok.
    After sending the claim letter I heard nothing for about 5 weeks.
    I then sent a third letter threatening court action and again heard
    nothing. After approx 4 weeks I phoned the bank and was told they had
    the claim and were processing it and a offer would be sent to me within
    4 to 6 weeks. On 08/06/07 I received an offer for the full amount of £2377.00.
    (very surprised and very pleased) which I accepted(with open arms).
    The bank however still believe it has nothing wrong and the charges are fair,
    reasonable and transparent.(yeah right !!). It also added if I was unwilling to
    accept any further charges that may occur to my account in the future it may offer a simple account with no borrowing facilities.(a little dig back I think). Thanks for expert help Martin. Cheers

    Claimed £4,050 on 2 business accounts and received £4,050

    Nice and easy, process took 3 months and they settled (without admission) without any need for court action. In fact the whole thing was a lot easier than I ever dreamed it could be.

    The funds go to Payplan and come-off my DMP, but thats a BIG chunk of my DMP paid in one fell swoop.

    Thanks to everyone concerned with MSE and all fellow posters whose advice and encouragement helped me get through this and gave me the confidence to stand-up to a bank that in my hour of need declined to help, and instead decided to fill its boots with charges that went far beyond what is reasonable.

    Remember folks - the bank paid easily because they know they are guilty. Guilty of overcharging and guilty of greed. Banks have a moral obligation to look-after their customers, too often they wade-in and see an individuals crisis as a time to cash-in.

    Banks are financially rich and morally bankrupt - keep up the good work!

    The story:I have had an account with NatWest since 1986 with few problems. While out of the country last December and January, some money due to go in to my current account failed to arrive and on my return I discovered that I had racked up £880 worth of bank charges. At no point did the bank write to me. I have a Private account and a good relationship with my personal manager, so I called him first and expressed my displeasure.

    His solution was to offer me £330 back. At first this sounded good, until I realised that they still had £550 of my money. I then started writing to him, until I just got fed up of his trite refusal letters. I then opened a parachute account with another bank and sent an official letter to my branch manager. Before I could start legal proceedings they wrote to me offering a complete refund by BACS.

    All of my money is now back in my account. Thanks Martin.

    The story:

    OMG I'm sooooooo happy:j after all the worry about the last 2 cases losing against LLoydstsb I am absolutely ecstatic.......read on....

    After receiving all my statements from the bank, I first wrote to them on the 8th of January asking for a refund and then had to go through the process of writing all the various letters that wonderful Martin :money: had advised. I then went through MCOL with my claim against them on January 30/01/07. In February they wrote to me with the "I am sorry you are still unhappy letter" etc, and told me that on this occasion they are crediting £470 to my account. (Which they did). I wrote to them (and got a certificate of posting) telling them that I do not accept this amount and to take it back as I was still going ahead with my claim. They never took back the money. I was then informed by MCOL, that Lloyds were defending the claim and it was being moved to my local County Court and that I would have to pay £100 to do so! I thought shall I shan't I as it had already cost me £120 for MCOL, but I decided to go ahead. I got a court date hearing for 20th June, in the mean time all this news that a man had lost to Lloydstsb was going on which frightened me a bit I must say. I got a General Form of Judgement or Order from the court last week saying that LLoydstsb had until 13th June 2007 to make a skeleton argument by 4pm, and in default the Claim is struck out without further Order and the Claimant may request Judgement in default. And guess what ...... I rang the court this morning and they told me the bank never replied, so I have WON!!!!!!!!!!!!!!!. I dont know how long it will take to get the money out of them but it's taken a good 6 months so far, but its been worth every minute. So keep on claiming........ at the worst all you stand to loose is your cost of the court claim - at the best you will received back all the extortionate charges they have made over the years!!.     great news !!!

    i sent off all the letters back in march and got replies within the 14 day return time i gave them, so the process went through quite quickly. In the beginning they obviously tried to say that the charges were legal and that they wouldn't be coughing up, so i went through the court process.
    Then on Monday i received a letter from a solicitor asking for information on the account and what the charges applied to (standard letter i believe). This worried me a bit, but sent them off the information they requested. first post and posted yesterday.
    this morning i woke up to find a letter from Natwest offering me £2400 as a gesture of good will. :money:
    not being greedy and accepting as this was only £250 short of the actual charges and the rest was interest.

    so thanx to all the people leaving great advise and answering question that i have posted. And to any newbies who are considering going for it with there charges i say "GO for it, i never win anything, and i'm quiet often unlucky"

    Filed with MCOL, they employed a solicitor to defend who intended to do this at court.

    Their 28 days were up at midnight on 12th June to file defence.

    At 12.01am on the 13th I applied for judgement by default as no defence was received!!

    Just checked MCOL today and the judgement has been issued to Nationwide who now, (I believe) have 28 days to cough up MY money!

    Keep at it, nationwide like to play hardball.

    In their letter to me they said it would be unfair to refund me when they weren't refunding anybody else. (which we know was a lie). I had also asked them for a comprehensive breakdown of their costs in justification of their charges......I still haven't received it!!
