    Started the claim back in March for my daughter. Followed the advice on Martin's web site to the letter. got to the stage of taking them to court, which they acknowledged. The 28 days would have been up on 15/06/07, recieved a letter today 13/06/07 saying they were willing to reimburse the full amount without any admission of liability. fantastic result, next mission is to reclaim all of her charges made on her credit card (also with the Halifax)
    I can't thank Martin enough,and everyone who has offered great advice, my favourite web site.

    Started the process end of March using the templates provided here. Received money last week - FANTASTIC. Halifax did attempt to say the charges were lawful but I stuck to my guns and took them to the small claims court, and it was worth it. However, they do not "admit liability" but paid because "it will cost Halifax money to defend (the) claim in terms of the legal costs involved". Thank you so much to this website and please go for it everyone!!!!!!!!:beer: :beer:

    Hi everyone wasn't sure where to post this but wanted to thank everyone as just recieved a cheque for £150 from GE money for x2 £75 charges from Top Shop store cards and Debenhams from 5 years ago!!! i know it is a small victory but it is a vicory and all it cost was time and 2 recorded letters i am over the moon.

    Thought I'd post this as from what I can gather Abbey have been one of the awkward one's

    So I'm a single mum, decided to go back to college to get degree where I managed my money really well. When I finished my course and looking for a job for 3 months Abbey took my student overdraft off me (TWICE!!) which they shouldn't have. Result lots of charges which snowballed. Biggest charge in one month was £360.

    Even after getting a good job I found it hard to get out of the charge trap, so claimed them back with the help from Martin's templates.

    Sent 1st letter got the usual 28 days reply, looking into it story. So I sent the second letter saying I was going to add interest and threatend court. They replied with an offer after the deadline of £1100. I had just started the court proceedings so guess that was me saying no to the offer. During this time they put the money into my account but also suspended it!!!! Good job I took Martin's advice and opened a parachute account.

    After one week they acknowledged the claim which as you know gave them another 2 weeks. Then I got a letter of defence but also with an out of court settlement of £2361.48. I guess if I had seen it through I would have got the full claim amount but this is money I need and really didn't think i would see again so I have accepted. Spoke to them and they said I will get the money paid into my account in 7 days and they won't close my account.

    Oh Happy days.....thank you so much Martin you are a complete star :j

    It seems like forever since i started this but success at last

    01/02/07 Enlisted a company to get my charges back!
    15/03/07 Dis-instructed useless company!
    16/03/07 Downloaded statements from online banking added it all up and sent 1st letter
    01/04/07 receive letter saying we are looking into it blah, blah, blah
    02/04/07 Send second ( LBA ) letter
    16/04/ 07 receive letter saying charges are fair and we are not giving you any money back!
    18/04/ 07 Filed claim directley with court
    09/05/07 request judgment ( bank didnt acknowledge)
    16/05/07 judgment returned to me for amendment
    16/05/07 BANK ACKNOWLEDGED!!
    06/06/07 Judgment issued! Faxed and called SC&M every day just to harass them.
    13/06/07 Paid in Full, money straight into bank!!!!!!!!!!!!!!!!!!!!!!! $5322.83!!
    that includes the interest!!!!!!!!!!!!!!!!!!!!!!

  • Mine seems so pitiful compared to everyone else's but got my £110 back from Smile (Co-operative bank). They didn't respond to my letter requesting the money back. I hadn't heard anything since I sent it on 13th April and was just about to send a second letter when I noticed last week that they had credited the money to my account. No news is good news...

    First letter sent 4th March asking for list of charges, list returned pretty quickly without charge.
    Letter asking for charges to be repaid 11th April. Usual reply (we're looking into it, give us eight weeks...)
    Second letter repeating request for repayment and threatening court, sent 26th April.
    12th June, letter received offering £2070!

    Am really happy and thank you so much to Martin who is our hero!

    Thanks to all but special thanks to Martin....Top Man! It's been a long hard road but justice prevailed. Court date mid-July but checked my statement online last night and there it was in all its glory! Off to Corfu tomorrow!! Already booked in case you were wondering!

    For those of you still in the queue...be patient, it'll happen.

    I started this back in December. I followed each step and eventally took it all to the small claims court.
    Eventually a court date was set for the middle of June for a hearing expected to last 5 mins and then 2 weeks before the court date Abbey sent a letter saying that when the considered the value of my claim against the costs of their defence, they decided to settle the claim in full out of court. "Without admission of liability." The cheque has now cleared in my account.

    My sister as just had her offer letter through this morning from HSBC. I wrot to them in late March asking for her charges back totalling £2009, Her offer came this morning for £1800, she over the moon.

    Thanks Martin without this site i would never have claimed the charges back but so far you have helped us claim nearly six thousand back all together.

    Have just sent my letters off to Yorkshire Bank and the Royal Bank of Scotland Visa and bank account. Fingers crossed.
