    The story:
    Sent 1st letter. Got reply saying would deal with it in 8 weeks. I waited 8 weeks.
    Received reply stating they are not at fault but "as a gesture of goodwill" they would pay me £811.50
    I faxed them telling me not to pay that I didn't accept. They paid anyway.
    I faxed them saying I would accept as part payment ONLY and then filed my claim by moneyclaim online for the full £1750 + costs
    They acknowledged claim which gave them 28 days and said they would file a defence.
    They filed no defence & I asked for judgement by default for the balance owing. I got judegement by default and they have received an order telling them to pay immediately.

    I am not going to close my accoutn however. I am going to leave 5p in it so they are forced to spend money administering it. I might even put the odd pound in from time to time. LOL

    Amount claimed: £430.25 including court fee and interest
    Payout £430.25
    I requested the statements which arrived within 10 days or so. I followed the procedure exactly as laid out - was given two refunds for small amounts which I accepted -but told them I accepted them as part payment only and without prejudice.
    MCOL claim served on them 22nd May - they acknowledged it and said they intended to defend all of my claim (Duh..... must've overlooked they'd refunded most of the charges by now;) )
    21 days after the claim was served, they offered to settle the claim in FULL :T

    Don't be fobbed off by partial offers, folks !!

    Many many thanks to Martin especially, but to all those who supported and advised me along the way. Now I'm pursuing Natwest!!

    Amount Reclaimed: £1404.23 (including interest) plus £120 Court Fee
    Amount Repaid: £1419.02 plus £120 Court Fee
    Story: I requested a refund of my charges at the begining of March, to which I had no response. I already had my statements as they were available to print out from the internet...FREE! Eventually I decided to take HSBC to court as I'd had no response, even after sending a second template letter. They defended the claim immediately and after completeing the questionnaire, I had no chioce but to sit and wait. I DID panic when I heard about Lloyds winning their case!! Anyway...I received a letter last week offering me a settlement, which I accepted!! I agreed to adhere to their terms of confidentiality in return of the money being in my account the next day...and it was!!! There were many stressful times and I wished I hadn't started this...but hang in there, it'll work out!!

    I started the process on March 19th, first 2 letters were ignored, thought they were ignoring the 3rd then I received the offer letter.

    I have accepted the amount without interest.

  • Just wanted to thank this site, i have just received all my bank charges back from Lloyds Tsb :j They paid up 2 days after they had acknowledged the court service. Thanks Martin :T

    Thank you so much for your help. After Natwest completley ignored my letters and I filed to take them to court. They then sent me a letter offering my money back but not the interest or court fee, which I accepted. Then today in the post I received a cheque for the charges,the interest and the court fees Total £297.00. I can only assume that they had not yet received my acceptance letter and thought that I was still taking them to court. So my advice is to hold out for everything if your nerves can take it

    The story:
    Process started 27th February with letter asking for list of charges... result came this morning (14th June). Followed Martin's step-by-step guide to the letter. Despite letters and timewasting tactics from Halifax (as described in the guide) I stuck to his advice about sticking to deadlines etc.

    Halifax acknowledged my claim via Moneyclaim and stalled untill today - a few hours before the end of their 28 day deadline. Have paid back charges, plus interest and the £120 court fee.

    A huge thanks to Martin and the advice here.

    On behalf of my wife i posted a claim for £450 approx incluidng interest. LLoyds TSB paid up before court but after a court date had been allocated. This was before the court rulings of the last couple of weeks.

    Yesterday my wife received a letter and cheque from them as they had closed her account without warning. She rang them and they apologised and reinstated it - she does have a premium (paid for) account.

    I was slightly disappointed as a trip to the ombudsman was in the offing and another possible £200.

    I have been claiming back bank charges for my 2 sons. I followed Martin's advice to the letter and have had great success.

    Many thanks Martin and to everyone on this site for all the help and advice I have received.

    Bank- Barclays
    Amount Received- £1060
    Amount Asked-£1500

    This was offered after only 2 letters, decided to take the offer this week. They did not pay the interest.

    Bank- Lloyds TSB
    Amount Received- £750
    Amount Asked- £750

    They paid this when I went through Money Claim online, before the 14 days were up.

    Bank- MBNA
    Amount Received- £1599.86
    Amount Asked- £1599.86

    They also paid up when I used the MCO before the 14 days.

    Bank- Halifax
    Amount Received- £993.23
    Amount Asked- £993.23

    This bank was the only one to acknowledge the claim so was quite prepared for court. They paid up this morning without defending the claim.
    Over the moon!!

    Bank- Barclaycard
    Amount Received- £166
    Amount Asked- £274

    This was offered after only 1 letter, decided to accept the offer.

    Bank- Barclaycard
    Amount Received- £60
    Amount Asked- £90

    Again, this was offered after only 1 letter.

    Got one going now with Barclays for over £2000. They have acknowledged this claim and have got another 21 days to file a defence. Will update result.
    Fingers crossed!

    Hope this helps anyone going through the process now. DON'T GIVE UP, and be prepared to go all the way.

  • Hi everyone, just wanted to let you all know that our dispute with yb has been settled this morning, SUCCESS!!!!! We received a substantial cheque from them this morning with a covering letter, 'the cost of defending this claim will shortly become disproportionate to the sums in dispute, for this reason only please find enclosed a cheque for £****.** in full and final settlement, without admission of liability.'
    Thank you Martin Lewis, i have followed every step of your advice and everything you said they would do was spot on, my advice to everyone claiming against their bank is to stick with it and see it through, it gets scary at times but remember that it's your money you're asking for.:beer: :j
