  • Hello everyone claiming from HALIFAX. I have watched and read all these threads for the last few months and just wanted to say that i followed Martins instructions to the lata....
Posted and requested bank charges for my 2 accounts back in FEB
Didnt come so called them and told them that by law i was suppose to get them within 42days and now it was 45.
Got apology and they arrived 2 days later.
Sent 1st letter requesting charges back in full from both my current accounts
    1 = nearly £4,000 2 = nearly £6,000
Two weeks later got standard letter stating they were within there rights etc etc.
Straight away i sent 2 nd letter staing i would take them to court if they didnt cough up and i gave them only 14 days to respond otherwise i was taking them to crt.
No reply when the 14 days were up so stuck to my word and filed with MCOL
They acknowledge claim and said they intended to defend and were then allowed 28days to put in defence.
    Defence up today at midnight.
Last friday first lot of money appeared in my account, full amount + interest+ court fee.
Called them today and asked for update on other account before i file judgement.
They had lost claim and i had to fax it through today and they would call me today once they had recieved it.
Told them if i didnt reciev call them i was filling for judgement first thing in morning.
True to their word they called me hour ago and said they were sorry about the mix up and the full amount would be in my account by morning +interest+ court fee.

So all i can say is follow Martins advice. You make the time scales and dont faulter from it.

Well i think i may shop now !!!!

WOOHOO!!!!!! i'm so happy:T . this whole fiasco started in february.sent usual letters and after 8 weeks i got refused a full refund but gave me £850 as a good will gesture, and of course i accepted this as PART payment and continued my claim. so , i took my claim further to the FO and they were brilliant. in the process i recieved a further £60 from abbey. yesterday i recieved a letter from the FO stating that abbey were still insisting they were right but will refund me £3220 as full and final settlement. i have decided to accept this as i couldnt and wouldnt wait any longer for this whole thing to be over. i am very happy with my refund and a big thankyou to all who supported me!!! THANKYOU!!!!!!!!

    Bank: TSB
    Amount Claimed: £524.48 (Inc Interest)
    Amount Received: £524.48

Followed Martin's advice to the letters, send first letter to bank asking for full amount, reply 14 days later stating the charges are fair etc, sent another letter straight away asking for refund or court action. no reply ... so after 14 days logged onto MCOL and started the claim.

1 day before deadline the bank acknowlages claim, a week later (today) i get my money back (8 days before court date). I am awaiting confirmation letter from bank, dreading they will close my account. lets hope not

Thank you very much Martin and everyone who helped me through :money: keep to the letter and you can't lose (i didnt think i would actually see the money)

  • Not sure if im doing this right as i have just been able to register with this site!!

Anyway i started claiming end of february with the 1st letter, received a list of bank charges within deadline, sent 2nd letter back straight away requesting £832 + interest of approx £400, got letter back saying would deal with it within 8 weeks!!! so i thought ok i will wait, received letter saying they are not paying back charges as they are correct in charging me blah blah, so i then sent 14 day court letter, then within 1 week i received offer of £416 (goodwill), and it was in bank same day as letter arrived, i phoned the number on the top of the letter and said i would accept that as part payment but i wanted more, i said if you give me £700 then i will accept that in full and final payment, she said "OK" !!!! wish i'd asked for more!!!

Also now claiming husbands account from halifax, claiming just over £1200 + £500 interest, awaiting offer from halifax, should receive it in the next few days.

Remeber to be polite when phoning halifax they are really helpful then.

    I FEEL LIKE I HAVE POWER !!!!! :j
  • Bank: Lloyds TSB
    Claim: £550 (approx)
    Paid: £690

This whole process took about 6 months, and with some laziness on my part. I had only got as far as sending the second letter - to which a response hadn't been received within about 6 weeks - and then i heard Lloyds had won the court case. I contemplated cutting my losses when a week later i got a letter through the door stating they would repay £690!! That was over £100 more then i claimed.
Also claimed the charges on my joint account as follows:

    Bank: Smile
    Claim: £1152.50 + interest
Paid: £1152.50 (would not pay interest)

Again slight laziness on my part of not following up the letters in a timely fashion, but i checked my account one day and had the above amount put in. The following day the letter from smile arrived to say they would repay the fees. They never refused initial letters like i experienced with Lloyds. All be it they took about 8 weeks to get around to my letter this was a very hassle free process!!
