    No pain no gain, this is where the highlighter pen(pack of 3 and poundland for £1.00) comes in handy. Double check referal fees, unpaid items, overlimit charges and any you're not sure about, ask on here.

    I would accept the offer but also look into any credit card charges/store card charges he has as well. Furthermore, I would get him to move his account to a non Lloyds Banking Group account for his benefits to go into.
    Does he have priority debt arrears(mortgage.rent, council tax, utilities)?
    Please remember any offer is not a full and final settlement of his claim but the rest would be paid on the conclusion of the OFT test case issues.

  • Has anyone heard anymore about the OFT test case. I know there was a hearing back in June for the appeal and the results were to be issued next month, then I heard that they weren't going to be released until next year.

    Anyone have any info?
  • I claimed 1200 Halifax got 1200
    900 Barclays got 770
    900 Abbey got 615
    500 Abbey got 415 Unfortunately still being made bankrupt by 1st credit so dunno if i was successful or not.. reply

    I have charges from Lloyds now dating back two years, I aint giving up and they know it which is why they are delaying the inevitble.

    Financial hardship didn't work and the finacial Ombudsman were as much help as a one legged man in an !!!! kicking competition. They claimed that I wasn't suffering any hardship despite me sending letters of proof that I was two months behind on my mortgage and secured loan.

    Lloyds since I put the claim in are still charging me every month and refuse to put them on hold (whats bizarre is despite the test case stating the charges are unfair and theres still no conclusion the banks are still allowed to charge the customers!!!!! backwards or wot!)

    Anyway bottom line is roll on Jan 2010 when house of lords rule in our favour and I'll take lloyds for every penny they owe plus added 15% due to stress!

    The current litigation is about the preliminary issues ie can bank terms be assessed for fairness. That is the judgement we are awaiting. It will be the half way mark.
    The substantive issues are the things that you will want to be looking at because it will cover what some have suggested could be even bigger than what we have today, ie restitutionary damages which could go back to 1995. At the moment the substantive issues, should the OFT win the current part of the litigation may well have the effect you want it to have.
    Going back to your circumstances, if you had mortgage arrears were you still incurring charges from Lloyds? Or another current account provider?

  • Original Claim - £4700 NOW NEAR £5000

    Have been offered £500 due to me being in financial hardship. Wrote to halifax and just spoke to them on the telephone as i have arrears totalling £2000. They said that the offer was final and that i should accept. They will re-look at the case once the test case is over. Really disappointed as this payment will take very little stress away !! Is that it now ?? Good luck everyone else !!

    Received a letter today from the council tax people,, its a court summons for later this month. Do you think i could get Halifax to up there offer so at least i can get this £800 arrears payed off ?? im at my wits end and really dont know what to do any more. I have payed £5000 in charges in 3 years and £4000 in my overdrafts with halifax and £1000 in arrears. ANY ADVICE APPRECIATED,, THANKS. Dan:rolleyes:
