    That is a good idea and worth checking where it was paid to. If it was HBOS then they need to come up with the data.

    I have been writting and e-mailing the Bank re- my charges sice the 21st of Aug 09. I claimed financial harship, completed the financial statment sent to me by Abbey ans the returned a letter to say taht my calim is on hold.

    However I claimed hardship so doesnt that mean that Abbey have to look at my calim? Can someone give me advice as my housing Association will be taking me to court over my rent arears.

    Is the notice of their intention to take you to court been received since you started reclaiming?
    I am assuming you tick the box on account still being used? Still receiving charges? and priority debt arrears(rent, council tax(?) utilities(?) )?

  • No, the letter they sent was to let me know that they are keeping my complaint on hold until the test case is over. They did say that they wll stop charges but I am still incuring interest.

    This is eveb though they know that I have claimed Financial hardship. The account is open and it is priority debt i.e. rent arreas.

    What shall i do.

    It does if the charges are not causing the financial hardship. Your main account ie the account you use for day to day spending does count(exception perhaps would be if the account is with the same bank).

  • Well I hope It doesnt count. There are many people in this forum that have received their bank charges back that have closed accounts.

    I had to move my money because I kept going over drawn (by a few pennies) and because of this I would be charged. Due to the fact That I couldn't pay back I was charged for that to. It was like a cycle. it was affect my outgoings and I couldn't pay my creditors so I had no choice but to move my money else where.
