  • Original Claim - £4700

    Have been offered £500 due to me being in financial hardship. Wrote to halifax and just spoke to them on the telephone as i have arrears totalling £2000. They said that the offer was final and that i should accept. They will re-look at the case once the test case is over. Really disappointed as this payment will take very little stress away !! Is that it now ?? Good luck everyone else !!
    • Bank: Bank of Scotland plc
    • Amount Reclaimed: £70 + £100 compensation
    • Amount they paid: £70 + £75 compensation (ordered by Ombudsman)
    • The story: Two direct debits were cancelled with the originating companies, not with the bank but were claimed. The bank bounced them both and charged 2x£35 unpaid fees. I told the bank this breached the DD Guarantee and they disagreed as 'they didn't know I had cancelled the DDs with the claiming companies'. The Ombudsman has now found in my favour as shown below.

    "[PaulM1969] has said that he cancelled the direct debits directly with the claiming firms (the Originators) as he had changed his primary bank account and instead wanted the payments taken from his new account. Two payments were claimed by the Originators from his Bank of Scotland account and, due to insufficient funds being held in the account, the direct debitswere returned unpaid. The bank applied two charges of £35 to his account.

    Having reviewed the papers relating to this complaint it is clear that Bank of Scotland was initially unaware [PaulM1969] had cancelled the direct debits with the Originators. However, I consider that it would have been fair and reasonable for the bank to have refunded the charges when [PaulM1969] made it clear that the Originators had incorrectly claimed the money. It would then have been open to the bank to claim the charges from the Originators, given that they were applied due to incorrect collection of direct debits.

    As such, the bank should now refund the charges totalling £70. As [PaulM1969] has observed, the bank credited to his account, in error, the amount of £16.90 which it said it had claimed under the direct debit indemnity. But as the original payment request had, in fact, been returned unpaid, the bank is entitled to recover that amount from Mr Milligan. If the bank has not already debited from [PaulM1969] account the amount of £16.90 that it previously credited to his account in error, I consider it reasonable for it to deduct that amount from the £70 charges refund.

    I also consider that [PaulM1969] has been caused some inconvenience by Bank of Scotland’s delay in concluding this matter, which could reasonably have been resolved at a very much earlier stage. For that reason I agree with the adjudicator’s recommendation that Bank of Scotland should pay to Mr Milligan an additional £75."

    This has taken the best part of two years to resolve, as the bank felt they did not have to take responsibility as I had not told them I had cancelled the direct debits, so they should not have to refund the charges. The Ombudsman found this was contrary to the Direct Debit Guarantee and that it does cover charges.

    An Adjudicator from the Financial Ombudsman Service found in my favour in November 2008 but the bank would not accept it so forced the decision to go to the Ombudsman, who agreed with me!

    I'm just waiting for Bank of Scotland to actually comply with the Ombudsman now - it's about 3 weeks since I accepted the decision and no word yet!

  • I recently claimed my credit card charges back from Capital One.
    I recieved a letter today offering me my charges back...plus interest.
    I still owe money on the card, but i am with a debt management company.
    Capital One has said they will put the money into my Capital One account.
    Can they send me a cheque instead or is this common practice?

  • You can claim from July 2001 to present day.
    Financial Hardship is the only way people are getting paid out but the bank does not have to repay even 1p under financial hardship.

    I asked Barclays for a summary of charges and they just sent me all my statements.
    Do I have to go through them all and add up charges myself or are they obliged to give me a total figure.

  • Hi everyone, I'm not very good with all this so i'll try and be short but clear...

    I wrote to LLOYDS TSB in June with a template letter from here claiming around £800 in charges. They called me and asked me a few questions... sent me a standard letter basically saying im on hold :mad:

    I have called them twice since then and also written once claiming financial hardship and again...nothing from them, they sent me a letter in the end with a leaflet for the financial ombudsman.

    I have even been into my branch twice asking for help but again...nothing.

    My maternity pay finishes soon and £800 even half that would really help me and help for my daughters first christmas!


    I dont see many success stories for Lloyds anywhere...does anyone have any advice for me? I want my money!!! :mad:

  • HI, has anyone had any success with refunds from BOS? My son has been waiting approx a year and has gone down the hardship route, he is an unemployed joiner and is in receipt of jobseekers allowance, he is being taken to court over money owed to the bank and others. he is now under the Drs for depression and i am really worried about the effect all this stess is putting him under. Bank of Scotland has admitted hardship and offered him £28!!!! refund out of poss £1800. This is an insult and we dont know what to do now. Any one got any help or advice??
