  • Bank: LloydsTSB
    Amount Claimed: £717.50
Amount Won: £717.50 plus interest, plus expenses.

23 February: Requested list of bank charges applied to my account for past 6 years.

15 April: Eventually received full list of charges.

17 April: Wrote requesting repayment of these unlawful charges.

26 April: LLoyds replied with their standard rubbish - "no default charges were applied to your account" "they are our prices for the service we provide in these situations"

03 May: Lodged a Small Claims Summons at local Sheriff Court. Hearing date set for 22 June. This cost £39

22 June: Attended court. This was a Preliminary Hearing. The date for the full hearing was set for 10 August. Lloyds were not represented in court but had written to say they intended to defend the action.

08 August: Two days before case was due in court I received a letter from LLoyds that included a cheque that refunded all charges, plus interest, plus a refund of the court fee.

Can I take this opportunity to give a huge thank you to Martin and everyone at Moneysavingexpert for the advice and template letters :T . Also thanks to all those who have posted their success stories, it gave great encouragement. Maybe this post will give some optimism to anyone like myself who started court proceedings before the OFT test case - don't give up.

    Good luck all.

    Bank: Lloyds TSB
    Claimed : £750
    Won: £750

After getting copy statements, submitting first letter and getting standard reply from LTSB we continued process and even offered to settle for £600 to get it over with. Came back from holiday on Saturday to find letter saying they were refunding £750 as a goodwill gesture and wiping any charges that had been notified but not applied. Money was already in account. Great result thanks to this website!

    Bank: NAT WEST
    Amount Reclaimed: £4,432
    Amount they paid: £4178
    The story:
Wrote to Nat West in middle of May 2007 to say that i thought the charges applied to my account were unlawful. Gave them 2 weeks to reply. On the last day of the 2 weeks, I received a letter saying they were looking into my claim and would respond within 6 to 7 weeks because they were very busy. I left it to the seven weeks and I received a letter informing me that they were not going to accept liability but would refund £3198 as a jesture of goodwill. I immediately accepted and sent the acceptance form off that afternoon!!!! I know it wasn't for the full amount but it was 3 grand more thatn i ever thought i was gonna get back!!! I was very happy bunny and had spent it 10 times over before i even think they had received the flippin letter!!! Then i gets home from work the following day and there's another letter waiting on my door mat. I felt sick. Thought they were gonna tell me that they'd made a mistake and that they weren't even giving me a £1...... Opened it up and WHAM!!! Another £980!!! Nearly wet myself!!! Was ever happier bunny then!!! Want to say HUGE thanks Martin!!!! You are the man!!!!! :A
  • Bank: Cooperative Bank PLC
    Ammount £6,084
    Payed out all of it!
We thought we might be due some money around the £1500 mark so submitted a request of all charges over the last 6 years and were stunned to see how much we had paid. this was in April and made a request for a refund of £6,084 on 23 May 2007 for all the charges less any refunds and i also deducted £2.50 for each time a letter was sent to inform me they had charged me £35 for the privellage of returned item! I also claimed the charges for being overdrawn. On 19th July recieved the full amount requested which they said was a gesture of good will! One lovely gesture i say!!!:T Now got a fab 50 inch plasma, new dining table and a few other goodies curtesy of a goodwill gesture. It took 3 months from start to finish and 2 first class stamps...thankyou Martin for the templates which were invaluable every time i look at my television i will think of you. • BANK: NATWEST
    AMOUNT CLAIMED: £4014+£120 MCOL
    AMOUNT PAID TODAY: £4014.
Been ongoing since February. Had zero response from Natwest from all template letters. So started MCOL proceedings in May. As predicted, they entered defence on the VERY last day before i could enter judgement. I then got the 'my clients embarassed of your lack of particulars' letter from Cobetts solicitors. So i handed in my updated particulars of claim from rex_mundi on this forum (Thank you Rex). I recieved my court date which was due on the 18th September and was informed that the bank had 14 days to respond to my claim with a witness statement. Which they didnt come back with. Seeing as how i started my claim online, i didnt have the tear off slip required to enter judgement so i wrote in to my local court explaining this. I phoned the court last week and they said that due to the OFT case it would be likely the claim would have a stay applied. Anyway, this morning, through my letterbox came the letter id been waiting months for. I have two months to accept my claim. (it took less than two seconds to be honest).
Thanks to Martin, Rex_mundi and Edinburghlass.
~advice~ get your local court phone number and speak to them if you have any questions. They were really helpful for me.
Dont forget to paste the correct template from this site into your particulars of claim section on the MCOL site like i did.
    THANKS
  • Bank: Royal Bank of Scotland
    Amount Reclaimed: £3,385
    Amount they paid: £3,385
    The story:
Wrote to Royal Bank of Scotland in April. No reply. Wrote again (Recorded Delivery) in June 2007. Received reply within seven days advising that they were looking at claim and requesting that we take no further action without first speaking to them. Three weeks later received a letter saying they held the view that all charges were fair and just but as a gesture of goodwill they were offering the sum of £3,385.00. Needless to say this was accepted and paid within a week or so. Martin, many thanks for your support and guidance - keep up the good work!

  • Bank. Lloyds
Began claim in Feb 2007, won 1st August 2007.
    Amonut Claimed. £3500.00
    Amount Won. £2900.00

I had to work for the money, but eventually won. I had to detail every amount, and date. We got to court on 1st August in Doncaster. We actually got to the court door when Lloyds solicitor said to me he had asked the Judge for a 5 minute break. He then handed me a written offer for £2900.00. This was a bit less than I claimed, but all the other cases that day,(19), got deferred until after the OFT Case, so I accepted.
NOTE. One lady also claiming against Lloyds, made a spelling mistake on her Court statemant.. She finished her statement saying she wished to reclaim her charges over the past year, instead of 'years'. Lloyds put an amount for the last year directly into her account the day before the Court hearing.
kEEP AT THEM, IT IS WORTH IT
    GOOD LUCK.

    Lloyds TSB £500

My mother-in-law received a letter today offering the full amount of her claim almost £500. Her last letter threatening court action was sent 2 months ago and she was thinking of going down the FOS route but no need now.

Do they know what they are doing, my wife had a letter on 04/08/07 saying that they will not be paying anyone else until the court action had taken place.

The letter that my mother-in-law received was dated after the 26th of July.

There could be hope for the rest of us yet.

Good Luck all those still trying
