  • Bank: HSBC
Amount claimed: £5189 inc court costs and interest
    Amount to be paid: £5189

I started my quest back in February and did the usual as per Martin's advice - 1st letter, 2nd letter, filed with MCOL, they defended, it got referred to my local county court, I did my court bundle within 28 days as requested. HSBC didn't send their defence dundle in, so on day 29 I sent a letter asking the court to strike out the defence. I received a letter on Saturday morning to confirm that the court had given me judgement for the full amount claimed.

The crazy thing is, my original request for refund to the bank was about half of what I have now been awarded - and I would probably have settled for less than that - but because they just ignored me I decided to go for interest and costs.

Happy days - good luck to everyone who is still in the process.

  • Hi All

Over the past few months I have received:

£1,117 from Natwest against a claim of £1,150 plus interest - no MCOL needed, took approx 4 months
£254 from Renault Finance against a claim of £254 plus interest - no MCOL needed - took approx a month
An offer of £695 from EGG which is full claim plus full interest - no MCOL needed, took approx 3 months

How cool is that? Thanks to all who have helped and offered advice!:j

I have MCOL claims outstanding against Nationwide for £782 inc interest and Natwest Visa for £180 inc interest so we will see how those go.

I am about to issue MCOL claims against BOS for £580, Barclaycard for £511 and Citicards for £448 all inc interest. Wish me luck!!

LloydsTSB success.. Claimed £2150.00 plus interest and court chargesRecieved cheque 3/08/07 £2370.00Started my claim on my birthday 02/03/07 and recieved finally a cheque after starting court proceedings. Unfortunately for me when l put the claim in for court forgot to add the interest onto the total amount claimed,my mistake. Luckly for me Lloyds gave me an extra £100 for the court allocation questionaire which l didnt need so £175.00 short on my actual total but not complaining !!! Thankyou Martin !! your a star !!
  • Bank: Nationwide Building Society
    Amount Reclaimed: £4,800

    Amount they paid: £4,000

The story: First wrote to the Nationwide in March. They replied with a bog standard "no go" letter. Following all Martin's steps, I wrote again, and received exactly the same letter in response. I wrote to the ombudsman. Received a letter a week later saying the ombudsman would be dealing with it and they'd given Nationwide two weeks. I then heard from the ombudsman saying Nationwide had offered £3080 plus 8% interest (from the date charges first made) so my settlement is £4000. I am very happy indeed, thank you Martin :A and keep going everyone else! :j

Im getting my £516 back from BoS!!

Recieved letter this morning telling me about the 'Test Case' and how this would affect the dealing of claims. I phoned the number on letter and explained how I thought that is unfair not to finish dealing with my case as I had sent my last letter refusing goodwill offer on the 26 june and wasnt my fault that they are so busy not to get to it in time. Was then told that they did have it on record that they had recevied letter on 27th June but some moron had closed my case file on system, that was why I hadnt received anything!(even tho i got the testcase letter ok! )
Anyways the lad i spoke to asked his supervisor on whot to do, and he came back and said that he was emailing the 'fast track dep' dealing with refunds right there and then and money should be in account within 48hours, even tho he did say he couldnt gurantee this time line as he personally didnt know how back logged they are and asked if I could continue to be as patient as I have been and thanked me for being a polite customer and it was a pleasure dealing with me:D .
Probably all smooth sales pitch but it made my morning and with money due soon im well chuffed!!
So thanks to everyone for their help with me and good luck to those waiting!!
  • Bank: Lloyds Tsb
    Amount Reclaimed: £701
Amount they paid: £750! They must have been feeling generous to give me £50 more than I claimed

I wrote the first letter and got 1 letter back denying. Two weeks later they sent me another letter saying they were looking into this. Two months later they paid the money into my account - some £50 more than I claimed - and no they havn't closed my account - wow!!!
  • Bank: Halifax
    Amount reclaimed: £1,888
    Amount they paid: £1,802

    The story:
I started my claim at the end of February, 2007. Eventually I received the standard letter stating that they were unable to help me. Further to advise from a member of the forum I telephoned and asked if my claim could be re-evaluated. After phoning several times and waiting four weeks I approached the Financial Ombudsman. They eventually wrote to me to say that the Halifax were offering £1,802 and suggested I should accept.

I was informed that they would pay me within six weeks, however at the end of the four week period I heard the news regarding Ofsted taking the banks to court and I thought that I would not get my money after all.

I'm glad to say that the cheque arrived this morning.

    Thank you Martin.:T
