my acct has jus been credited by natwest!!!!!!!!!!!!!!!!
After the amount of calling and waiting around, it has actually paid off!
I had to go via chief exec procedure to get the offer letter agreed on, as they expected me to wait 3weeks for revised letter but because of my circumstances they actually honoured my offer as they rightfully should have.

entered default 10/07/07
after saying they didnt recieve the court papers or judgement by default, i didnt want to send balliffs in cause of delay getting money and another £55
i kept on to them and only today cause ididnt hear nothing after phoning for the last week the woman said it was paid into my account the 27/07/07
yet no-one else told me or i havent recieved a letter saying they were paying it.
but its in there i just checked paid in 2 amounts on the same day.
thanks to all at moneysaving expert especially martin:money: for bringing this to our attention. reading the forums kept my hopes up as everyone says dont give up, keep right on !!

The story:
I downloaded the templates here, and stuck rigidly to timescales.
a) Requested Statements
b) Requested refund
c) Sent threatening letter
They actually responded to my threatening letter but 16 days later, so I'd already submitted an Money Claims application. We therefore went straight down the Court route.
d) Started Court proceedings
My Court date was 3rd August. HSBC sent me a letter offering the full amount (including court costs and interest) on Monday 23rd July. Unfortunately, they sent it to the wrong address (despite me telling them!) so I received it on 30th July and sent back same day.
With postal delays kicking in, HSBC's Solicitors received my acceptance on the day of the Court date and urgently faxed information to County Court with only half an hour to spare!
I await some lovely money...
UPDATE Saturday 4th August: received a cheque for the settlement amount plus an extra £35!
I had originally asked for £293, but (due to a genuine error) this included a £35 charge that HSBC had refunded at the time. The Solicitor therefore knocked this off when making the offer, which I accepted. Another Lloyds TSB victory!!
Amount claming-£2735 plus £513.97 interest= £3248.97 :eek:
Amount paid- £3472.97 inclusive of interest and court fees of £220
Using this site I followed the instructions, using all the template letters and followed all the time scales strictly.
27th March 2007, sent 1st letter, received list of charges 39 days later.
4th May 2007 sent second letter requesting I be refunded, received standard response from bank saying no.
12th May 2007 sent 3rd letter threatening court action, waited 14 days and received no response from bank.
7th June 2007-issued a claim with MCOL, deemed served 12th June 2007.
18th June 2007-Lloyds TSb acknowledge my claim and have 28 days to defend.
27th June 2007-defence to claim filed, claim transferred to my local court, allocation questionnaire dispensed of at Judges' request.
2nd July 2007-Court write to me and ask I pay an allocation fee of £100, Judge orders I file a list of charges and deliver to defendant and court within 21 days. Deliver to court by hand and via recorded delivery to SC&M.
13th July2007-Recieve a hearing date of 15th August 2007.
27th July 2007-TEST CASE ANNOUNCED, after reading the advice on here I prepare myself for the fact that my case may be stayed until the Test Case is resolved.
3rd August 2007-Receive a letter from court saying that the defendant has informed them they will be settling my claim out of court. A huge suprise but still unsure as to what their idea of a settlement may be.
4th August 2007-Recieve a letter from SC&M informing me their client will be depositing the sum of £3472.97 inclusive of fees and interest into my account within 5 working days. Letter states '...not to be treated in any way as an admission of liability...merely an attempt to resolve the matter amicably...'
I can't believe they have paid in full after everything that has happened over the past week, I was not even expecting an offer so this has come as a big suprise!:j
To all of you still in the process of claiming from LLoyds TSB don't give up!!
I would like to say a huge thank you to :money: and his team, if it had not be for the support and advice given on this fantastic site I would not be leaving this post today. You are all doing a truly fab job, keep up the good work!!:beer:

recalculated figure excluding "Debit Interest" £3367.49
Received £2093.04
I claimed for "commision","fees" and "debit interest" plus the standard 8% interest. total £4448.53 The bank repaid me £2093.04 it was never offered to me, they put it straight into my account which at the time was overdrawn(agreed overdraft). This figure repaid the overdraft and put me in the black.The bank declined to pay "debit interest" a figure of £1481.04 which reduced my claim £3367.49. They never yet explained what debit interest was but I am glad to have recieved anything.
The claim was straight forward I followed each stage of Martins plan.It took 15 weeks and a couple of letters.

i sent for statements at start of febuary,recieved them in may and posted my claim off to bank of scotland.after nine weeks i got a full pay out of 3700.00.it took many phone calls and letters but dont give up.i got a letter offering me 2000.00 i phoned up and told them i would only settle for the full amount and he said yes straight away.thanks to you martin we have been able to treat the kids and ourselves.:beer: x0

Actually received my cheque this morning for £2k! No hesitating - straight to the bank and will spend it next week when we take the kids off on holiday for 2 weeks. We have finally got back the money taken from our account that stopped our kids getting treats because the spare money had gone. Even so HSBC still couldn't pay up within the 14 days promised and even had to say: 1. That the cheque was lost in the post.
2. We definitely should have the cheque cos we posted it last week
3. Oh we see what the problem is - your letter that goes with the cheque has been typed in Welsh! (we live in yorkshire) and there is a post strike on.
Anyway, finally came this morning, handwritten and with yesterdays date on it!

Lloyds TSB, following their well-known nature, refused to give me back my charges even after threatening them with court action. Obviously they had some idea of the recent announcement by the FSA? Who can know for sure.
I originally asked for about £1500 (after racking up tons of charges as a poor student), and they refused. This meant taking them to court, so I decided to go for broke and ask for interest as well. They acknowledged the claim (as most banks do), but they failed to submit their defence.
The deadline of 28 days expired just over three weeks ago. I was worried that the claim would then be held, pending the high court case. Thankfully it obviously didn't apply to me. I got my £2000 in my bank account this week. After graduating this year with a first class degree (and being too poor to celebrate it), I've now got enough to start making plans about what to do next (hopefully a biochemistry PhD). Thanks Martin!
