It took me 4 months to get my claim, and they refused to pay up until a court date was set. Despite all the anxiety it was well worth it!! I'll be thinking about it all whilst sipping my beer on a beach somewhere sunny & hot!!

I started the process 5 weeks ago when I asked for 6 years of statements. They came fairly quickly although 26 months were missing. I rang the bank to request the missing statements and the girl on the phone asked me why I wanted these statements? I told her that I was hoping to reclaim my bank charges. She said that she could process my complaint over the phone and there was no need for me to write any more letters!
I was happy to do this although I was a bit wary of the complaint being logged. I waited 2 weeks and called the bank to ask them where my complaint was in the system. She replied that due to such high demands on complaints it would take 8 weeks for a reply. I then threatened them with the courts! She immediately pulled my complaint out of the queue and offered me £1850. I said no way and I wanted full amount £3150. She said yes, no problem and that was her final offer.
I received first payment £1850, 24 hours later in my bank, then I received a further payment yesterday of £3150.
An extra £1300 which I wasn't expecting!!!!
I'm off on holiday now to spend, spend, spend!!!!:j0 -

2nd May - 1st letters with £10 sent to Halifax (called on the 4th to confirm they had the request - they denied they had it even though it was recorded. The person I spoke to sent out the statements (I have received 3 sets so far!)
17th May - Halifax statements delivered.
22nd May - First letter sent - Claiming for £2,484 including interest.
25th May - Received rejection letter.
31st May - 2nd Letter Sent.
17th July - Offer of £1106.50 rejected. Expecting a callback tomorrow!!
18th July - Accepted an offer of £2000
20th July - PAY DAY!! HORRAH!

Bank: Lloyds TSB

The story:
Lloyds TSB took it to the very last stage, I was supposed to be in court today with them. I called up there solicitors by chance on wednesday to ask if there was any chance an offer would be made. They said a letter had been sent out to me on 07.07.07 but this was not received by either me or the courts.
Someone from the solicitors called me back yesterday to confirm the money would be in my account by the close on business, and it was!!!! Happy days!!!!0 -
The Bank: HSBC
Amount claimed: £1,079 in charges plus interest plus court cost
Amount received:£1,408.94 in total (charges plus interest plus MCOL fee.)
The Story:
First letter 16.03.07 ignored
Second letter 13.07.07 sent recorded delivery threatened court action - no response
MCOL claim issued 08.05.07 acknowledged 10.05.07 and defence entered 05.06.07
25.5.07 random letter from HSBC Customer Services acknowledging original letter
Case transferred to County Court 21.06.07
04.07.07 brilliant county court judge orders defence be struck out as an abuse of process unless defendant gives details of other cases "where a claim proceeded to final hearing date and was not settled".
19.07.07 HSBC solicitors call me and offer all charges, interest on charges and court fees as final settlement which I accept.
19.07.07 money paid into my account.
I know it's been a long haul but if you persevere you will succeed. Thanks to this site and Consumer Action Group members for help and support - anyone wanting to proceed to court action stage should definitely check out their site - it is amazingly helpful.0 -
Bank: Abbey
Amount Reclaimed: £3000
Amount they paid:£2450
The story: We sent Abbey a letter asking them to repay £3000 and they refused to pay anything. We said see you in Court.
We filed our claim and didn't have to pay the Court fee as we receive Family Tax Credit.
Within a month we had a letter from Abbey -They said that we had agreed to settle for £1600 and sent us a cheque and also back dated bank statment showing their version of the charges. Fortunately, I had kept the originals, there were so many charges missing it was laughable.
We said thanks for the part payment and we will see you in court.
We went to Court on 16/07/07 and the Judge awarded us a further £850. He was not amused that Abbey didn't even turn up for the hearing, especially when it was very clear from the letter we sent back to Abbey that we were going to Court.
They have got 14 days to pay, otherwise we will send in the Bailiffs.
Remember ALWAYS send any correspondance by Recorded Delivery AND keep a copy.

Started the whole process only a month ago, got 2 letters from LloydsTSB solicitors within a day of eachother, in fact, both dated the same day of Tuesday 17th July. 1st one saying they're defending, then this morning's letter saying, "yeah basically we know where in the wrong, don't tell anyone and we'll settle it with you out of court".....
Excellent!!
Keep it going folks, these banks are making too much money out of everyone in the first place. Revenge is sweet, 18 years I have had this account with Lloyds, about bloomin time I had some cash back off them.

Wrote to HSBC in May
Claimed £813
They wrote back a month later saying they were looking into it.
July recieved a letter offering (without prejudice) £733.
No nasty comments, no threats just polite letter thanking me for contacting them
Result!
Thanks for the advice and templates Martin, I wouldn't have had the confidence to do this on my own!:beer:0
