february sent 1dt letter to rbs and standard reply sent back so sent 2nd letter after requesting they pay within 14 days, they did send me a letter offering £3298 i thought and deliberated but declined offer and started mcol court action, this went to the wire, on the 28th dat received a defence from cobbetts defending the claim,,,,thought o my god why didnt i accept the offer as it was over £3000 which i really needed,,,was sent court date from local court and prepared bundle which i sent recorded deliver so the got it on the 14 day deadline but cobbetts didnt sen din theirs,,after not hearing from them i contacted them and was advised by cobbetts that they were about to make an offer, 9am the next morning cobbetts rang to say the bank are prepared to settle in full as a gesture of goodwill but i must notify the court to stop court action,,,cheque arrived yesterday and took it straight to the bank,,,got to wait till monday for it to clear and when it does i will cancel the court action...
woooooooooohooooo after thinking id blown it i won after all!!!!
all i can say is please dont give up
if any one need help with rbs and cobbetts drop me a line and i will try to offer you some advice as to what happened during my claim..

I have agreed to this as it is only 100.00GBP less than my claim..
When it's in my account, I'll transfer it to my credit card and that will nearly halve my credit card debt!!!

As my post was moved to success stories, I thought I'd do a proper post!
Sent first letter requesting bank statements in April 2007
heard nothing and followed up with call to the bank after complaining.
Barclays opened a case for me.
Barclays sent wrong account statements (stalling) even though letter and phone call clearly stated correct one
another phone call and another complaint made
Barclays sent correct statements.
claim without interest = 800.00GBP
sent first letter exactly 1 week, 1 day ago
got offered 700.00GBP today.
Thank you Martin and all MSE's... without you I wouldn't hve had the guts to do this.
I've now halved my credit card in one night with money I never thought I'd see again!

First wrote in January went through the usual chain of letters was offered £750.00
Lodged a complaint with the ombudsman four weeks ago just received a letter from them saying Loyds will pay a further £5550 to settle.

Hi all,
Just a note to those who haven't yet claimed - do it now!!!!!!
Yesterday I received a letter from Nationwide saying that they have refunded my full claim + interest + court fees to my account (£1563.47).
They never closed my account either but they did say if it happens again then they will close it which is fair enough.
I started the process months ago & got the letters back refusing the claim so I filed a claim with Moneyclaim. The 28 days which Nationwide had to file a defence was up in 2 days time so they left it right until the very last minute to issue a refund.

Started claim 22-2-07,nationwide very unco-operative throughout had to apply to Mcol, served 22-6-07, defended 29-6-07, time up 27-7-07 paid whole amount 20-7-07,showed up as corrections ranging from £25 to £999 paid in at various stages during the day, no word from Natiowide through. Immediately, well when I'd stopped jumping for joy, transfered most of it to another account, don't want to risk them taking it back. Felt it was never going to happen for me, but it did, and its got me out of a financial struggle, to those still applying keep going, don't loose your nerve and good luck.And thank you again Martin.

I started about three months ago went through the normal channels letters to the bank (ignored) letter to the court response from their solicitors (defending) asking for a mountain of information which was a pain but had to be done with the help of this site.
Today we recieve a letter with a nice big cheque in it (Good will gesture)
Martin thanks to you and your staff with out you we would never of taken them on :T

Hi just to let everyone know, I have just had £1200 credited into my Lloyds TSB account :j
I followed every step that Martin advised and it got to the "threatening to take them to court" stage and guess what I got a lovely letter from Lloyds TSB saying that they will credit £1200 into my account within the next 5 days :beer: Amazing what they can give you if you are persistent with them. I'm over the moon0
