  • I havent posted on here before, but I have read with interest many of your threads to arm me to tackle my bank with my charge claims!!

    Well I wrote to them on 5 May 2007 requesting £889.59 including interest shown on a spreadsheet.

    I recieved a letter on 2 July offering me £635.40 in full and final settlement, with no admission of liability whatsoever etc.

    I was pretty impressed that this was so easy for me, they did use a few stalling tactics, but once you realise thats what they are doing, and do not get irate..... just do what they ask, calmly and quickly..... they realise you wont be walked over.

    I know it is £200+ off my original request, but its pretty damn good, and to be honest, I really cannot be bothered to take it further and go down the court route, they are also keeping my account open. Probably because I have a loan, credit card and joint account also with them!

    So, all good, any questions anyone has i'll be happy to try and help!

  • :beer: BANKS INVOLVED: ROYAL BANK OF SCOTLAND (RBS) and ALLIANCE AND LEICESTER (A&L).
    AMOUNT CLAIMED; £5,500 (RBS) :eek: and £3,300 from A&L :eek:

    AMOUNTED RECEIVED SETTLEMENT: £5,500 (RBS) :T AND £3,300 (A&L):T

    Time taken from start to finish 5/6 months each claim.

    I assisted my daughter and son-in-law obtain the above monies back from each Bank. I issued proceedings on their behalf against A&L they capitulated after the proceedings were issued. Both Banks settled in full plus Legal Costs, on the basis of no admittance of liability. :beer: Thank you so much Martin without your site I would not have been able to do it. :money: It is great to see someone on the side of the Consumer for a change.
    I am now going to pursue a further two Banks LLoyds, Nat West and I will keep you updated as to what happens:A
    ALTHOUGH I am happy to have achieve this return of monies - unfortunately charging of Penalty Charges is still going on and perhaps we need to start a campaign to convince the Government to deal with this issue more decisively. Keep up the Good Work you are a starXXX:beer: :j :j :j

    I would like to say a big thank you to Martin and all at MSE. With the help of this website I've reclaimed all my bank charges in full with interest.

    This process was made so simple by MSE, all I did was follow the website step by step and approx 4 months later a cheque was in my post.

    Fortunately for me I keep all my bank statements which meant I didn't have to wait for the bank to drag their heels sending me me them in the post. I added up the charges I'd incurred and added interest using the MSE calculator then wrote to the bank asking for it back. I got the standard 'We're looking into your complaint' letter. 8 weeks later they came to the conclusion that they had not charged unfairly. I wrote back saying I was not happy and would take the matter to court. I had no response to this and so I progressed a claim through MCOL. They did not acknowledge nor defend the claim and so I had a judgement entered in my favour. 3 weeks later I hadn't received payment so I spoke to the branch manager and told her I was sending the bailiffs in. That same afternoon a got a call from the banks solicitors informing me the cheque was in the post to me.

    Good luck to everyone else who is fighting this battle!

    I started out on this journey last November. I was with the Woolwich and started my claim with them. Then in January after being taken over by Barclays it was Barclays who started to answer my letters. They offered me £1000, which I declined. I then started court proceedings. I followed this site throughout, using the template letters and Martin's advice as well as gaining support from other peoples' stories.

    We went all the way to court. My appointment at County Court was scheduled for 10:15 yesterday and at 10:13 a representative from Barclays arrived to tell me that they were going to pay in full £2553.66 which included interest calculated from this site plus my Court fee of £120.

    I very much appreciate the support this site gives. Thank you Martin and everyone involved. And good luck to everyone else still claiming.

    Managed to recalaim my sons charges in full yesterday, exactly eight weeks after sending letter requesting they pay them back. The bank sent the offer along with a letter saying that they were sure if they went to court they would win. However the costs and time it would take did not make it worthwhile.
    Still awaiting a reply regarding my daughters £2550.00 charges,for which a letter was sent on exactly the same date as my sons.

    I requested statements as far back as 6 years in January. Received them end of January.
    I started my claimed with MCOL on 3rd March 2007.
    Abbey acknowledged the claim within the time allowed.
    At the end of March they sent me their defense, but didn't have my personal details entered correctly on the defense. I wrote to them to inform them but they never replied to my letter.

    At the end of June, I started getting impatient as I'd heard nothing at all from either Abbey or the courst, so I contacted the court via email and telephone. The court advised me to request a judgment by default, so I did.

    A judgment was entered in my favour on 3rd July 2007 and this morning, as I was preparing a letter requesting my money and threatening request for a warrant of execution, I received a cheque for the full amount claimed.

    Of course Abbey don't acknowledge any admission of legal liability (and have asked me to write to the court to withdraw my claim) but I don't care. For once I'll be selfish and keep jumping around!!!!!

    I never thought I'd be writing a success story!!!!!!

    Amount paid: £2480
    Story: Usual time-wasting responses to letters, went all the way to filing the case with moneyclaim online, Lloyds acknowledged receipt and notified intention to consider claim within 28 days, then the day after this letter we got a letter from their solicitors offering full refund of fees, plus interest, plus court fee if my brother accepted this and signed without prejudice! A zillion thanks to Martin for guiding us through it via this site!!
  • Goldfish £296 reclaimed and received with just 2 letters!

    Nationwide £2162.00 plus interest and £120 court fees, total £2565.74

    Sent 2 letters and court summons. Appointed a solicitor and then paid up in full5 days before 28 days up!

    Bank: Halifax Bank of Scotland
    Started: 3rd Jan requesting £88. they responded duely on the specified 14th day to say they were 'considering my letter and would reply no later than a specific date 6-8 weeks later.

    About 4 days after this specific date I recieved a letter dated to the same specific date rejecting my claim.

    In this time they had added a further £28 charge retrospectively as further admin charges for the previous 3 £20 charges from 2 months previous!!!

    I wrote them the second template letter informing them that I was now going to reclaim all of the charges including the new one plus interest or go to court in 14 days (£110).

    They responded by saying they'd consider it and reply in 6-8 weeks again. Suggesting the FOS.

    8 weeks later they offered me £44 - claiming the total was only £88 in writing. I just rang them up today. They didn't dispute that my claim was £108 pre interest, and offered me £81 on the spot.

    I took it because frankly, the extra £30 quid isn't worth it for a few months court proceedings. (and i'm using their student account 0% overdraft to make some interest... - don't really want them to close my account!)

    Settled: 18th July for £81.
