Firstly a massive thanks to Martin Lewis(couild give you a big hug and a kiss!!!! :A :beer: :A and also to all the help I received from you good folk in the Forum.:T :T :T
I went through the Court Procedure Online. Got to the AOS point when LTSB solicitors (in a Confidential and Without Predjudice letter) offered to settle with condions attached. I wrote back and refused to accept payment with conditions attached. I waited a few days expecting to recieive notice that they had filed their defence. Nothing arrived. I logged onto my bank account routinely today 17/07/07 and lo-and behold there was a payment of the full amount of my claim credited to my account - no conditions attached:cool: :cool: :cool:
My advice to all those who are in the process of claiming is
1. Be professional
2 Follow the procedure to the letter
3 When claiming interest on each charge, calculate the interest for each charge using ML's calculator and total it up. I think this scares the **** out of the banks because they know you are serious when you go to this amount of trouble
4 Be courageous, patient and don't feel daunted. Ask your court for help along the way. Although they will not get into legal advice/debate, they will tell you what to expect as the next step in the procedure, or clarify, as I found, the meaning of a letter etc. Say can you put it in laymans' terms/words. They cant refuse this, I've found
The Banks are not wanting to defend their charges in open court so they will pay up sooner than do this, but the OFT is on their case and, in my humble opinion, Banks will be ordered to reduce their charges. Let's trust the OFT that they will, behind the scenes at least, be asking the Banks to justify their charges. It may never even become public? -let's wait and see
I'm ecstatically over the moon and it has really released the pressure on my finances

I had got as far as taking it to the small claims court however I had not even recieved a court date when I got two letters together from the banks solicitors firstly stating that the charges were lawful and to contact the bank within 14 days to discuss. The second letter saying that they have agreed to pay me £1393.08. Brilliant result thank you Martin and everyone on this site for the information and giving me the confidence to see this through. Good luck to everyone who is claiming. Keep at it you will win, they cannot pay out all these people and not pay you.0 -

Have just received settlement offer, which I have accepted.
It has taken 4 months, and I had to issue court proceedings, to which I received a solicitors defence from RBS and a request for further information last week. Having answered their questions in great detail, and expecting to go to court, I received a settlement offer yesterday, which I almost missed!!
Their letter was a 3 pager, the first page expressing their concern at my unhappiness, and then listing the reasons for their charges and the fact that they were fair and legal, page 2 started with "However"..... As a good will gesture, and without admission of liability or error, we are prepared to offer the amount of £10,260
Following your advice, and by being factual and timely has proven successful, so a huge thank you.
Don't be put off, the whole time spent on this has probably been about 10 hours in total, a pretty good return in my book!0 -

The story
Started the claim in April, After first letter got a response advising me I would have a full response within 14 days, which I didnt, so sent second letter. Then had a reply with a cheque for half the amount. I was willing to accept this so left it, a few weeks letter got another letter offering me the other half. Both supposedly "Goodwill payments". I suppose the first offer must have been a late response to my first letter, and the second offer a response to my second letter!! Quite happy

The story
This was a long one, they took me all the way to the wire. I processed a claim on moneyclaim, which they defended. I even had a court date come through, then about a week later, a letter from their solicitors offering me the full amount!!

The story:
Sent letter requesting statements off end april.
Followed the advise given to the word on this site....got the last letter advising i will be going to court. Gave 14 days to reply. Called them on the 13th day and said if i didnt hear anything i would go to court on day 14.
Left it as that...2 weeks later i was sent an offer letter, was offered £800.00
Called the next day, said i wouldnt accept any less than £1700.00. They tried to haggle me down, but said i was starting court procedings. They then quickly accepted my request.
Received the letter today confirming i would have money within 14 days.
Happy days!
im mega skint at the moment though...so does anyone know how long the money does take in reality? I need it now!!!!

Well after 8 months of writing letters, issuing my claim and getting as far as Allocation Questionnaires Abbey decided to make me an offer which I accepted. My bank charges totalled £860 and they paid £859 in my bank today. Really pleased!! Good luck to everyone else, hang in there you will get the outcome you want. Yippeee, I've been reading this thread for ages and AT LAST I get to post my success story.:j

I sent off for my statements back in April and they took 40 long days to arrive in batches but didn't cost me anything. Sent off the letter from template and got a reply ' looking into it will get back to you in 8 weeks blah blah' Read a few things in forum about not steaming in to quickly with HSBC :cool: so decided to sit it and wait the 8 weeks.;)
Wouldn't you know it 7 weeks later an offer £777 comes through my letter box. I've read they never really pay interest back and I'm so busy the thought of court proceedings freaks me out and it's not far off the original sum and hey, it cost me the price of two stamps.

14th: recieved
15th: Sent 1st Letter
28th: Recieved letter saying they are looking into and would hear back from them in 6-7 weeks - (waited no second letter sent)
16th July: Offered amount in full :T

Amount Reclaimed: Joint acc:£1900 (with £700 OD) personal acc: £1400
Amount they paid: Original figure + the interest + court costs +interest from date of original letter to settlement date!
The story: Since Feb 07 I have followed your advice and templates to the letter Martin, joint account settled by letter the week before the hearing next week 24th July 07 (money is clearing as we speak) the personal account was settled in court today by a letter sent to the judge. Money must be paid by the 4th August 07. Judge told me that he would love them to dispute a claim but they just wont do it!

:T I recieved a letter from Lloyds TSB today. They have agreed to pay back all my bank charges £750.00. I followed the plan set out by Money Savers using the letter templates. The last letter I sent was offering to settle for part payment of £600.00 to settle out of court but they have agreed to pay me in full BRILLIANT.
Thank you for your help and support I couldn't have done it without you.
