Amount Reclaimed: £1027.94 (which included interest)
Amount they paid: £885.49
Started with the first letter template from your fabulous site on 29th March, got to the threaten court letter and received a letter back this morning 5th June with the offer of £885.49 which is what I said they could pay me without the interest.
I was looking forward to sending the bailiffs in too! boo hoo ha ha
It'll pay my overdraft with them and I can close the account as I now have a fab alliance & leicester online account.

A huge thankyou to Martin and the site I have just been repaid £2245.72 from the Cooperative Bank!! I have been a silent member, just watching and gathering info and taking support from all the members. They had put in an aknowledgement with intention to defend so i was starting to bone up on how to take it forward when i found i had all this dosh in the bank the day before i got the letter to say so! They have repaid all the interest and the court costs. Thanks to this site i have halved my fuel bills and reclaimed all my charges/fees. All i can say is keep on with your fight guys, the banks are paying up!:T

Some of you may be interested to know that I have just reclaimed bank charges going back to Feb 1999 (I had kept every statement since then!). That's over 8 years folks!
It took the usual 1-2-3
Letter 1, then letter 2 threatening court, then registering claim online (cost me £80). They have now sent me a letter promising me the full amount but without admitting unlawfulness.

My story so others know what to expect time scale wise:-
23-2-2007 Sent 1st letter (recorded as with all my letters) with cheque for a tenner to Data Protection Team at Nationwide. Received bank statements 39 days later.
6-4-2007 After totalling up my frighteningly large £1,160.00 or £1,336.11 with interest I sent a letter (recorded) asking nicely for a refund in 14 days, I even added a please on the end!
21-4-2007 Humph... 14 days passed and no response. (no surprise). Time to kick bottom!!! Sent letter 5 threatening court action if they don’t pay within 14 days. Oh and I’m claiming all my interest as well, its pure greed and I probably wont get it but hey, stay confident every step of the way.
30-4-2007 Got letter from bank within the 14 days saying hard cheese and fobbing me off with "gratitude" for the feedback as a member I provide but the charges are fair.
8-5-2007 Onto MoneyClaimOnline and throw £120 at them as the claim was above a certain amount. No worries, its added to the total claim so I will get it back eventually.
This part takes 5 days for the courts to send it to the bank "so to speak" then it is classed as served. The bank has 14 days to at least acknowledge the claim, if not then I WIN!!!
27-5-2007 One day before the deadline and.... they put in an acknowledgement. Now it’s gonna be 28 days from the day it was originally served, 15 days to go then.
5-6-2007 Just a couple of days to go and WOW!!!! 2 debits arrive in my account at 3:15pm. One for £999.99 and one for £160.01 under the heading of CORRECTION. Big cheesy grin!!
So it took 3 ½ months, I was in no hurry!!!!! And now I'm in heaven, hope this timescale helps others! Oh and when I got paid out I had a £1500 reducing overdraft, I still have it and no sign of them closing the account, or taking my overdraft off me. Thank you Nationwide, I will be a loyal customer from now on as you have not closed the account. Not had a letter from them yet but am expecting one in the morning.

The story: It took a few months getting the info (statements), sent 3 letters. The claim, a letter before action, then finally a rejection of initial offer (which was £180). Got letters today of 'full and final settlement' with usual spiel.
Credit card charges: You can claim them back, in the same way as bank charges. They are still penalty charges and no figure has yet been agreed on what is legally right or fair. Stick to your guns and stick to the path and you should be OK.

Halifax WON! Claimed £1549 on 8th Jan 2007, Settled for £1350 on 29th Jan, Paid 7th Feb.
MBNA (Virgin / Alliance Credit Card charges): WON! Claimed £419 on 17 March, finally offered £425! on 5 June)
Natwest Credit Card: WON! Claimed £250, got 100% + interest + court costs too.
Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.
Natwest Bank / RBS: WON! Claimed £400. Got 100% + interest + court fees back.
Halifax 2: Ongoing....0 -
At the same time as doing my claim above i was also doing my dads charges from nationwide for just over £2000, his has been ignored and not acknowledged so monday I paid £55 to get the bailiffs knocking... Process started on 28/2/07 claiming on two accounts I had with them. Used template letters on this site. Put in claim via HMCS costing £120 and used a relatives address for correspondence as I live in Scotland. Submitted online on Mon 28/5/07, papers processed Wed 30/5/07, letter from Bank of Scotland received Sat 2/6/07 offering HALF of claim. Called them Mon 4/6/07told them I would accept no less than the actual charges taken from me or I would continue to court fuelled by all the success stories on the internet. Agreed there and then to refund all the charges on both accounts. As of today (Tuesday 5th June), half of the money has been paid into my accounts and am awaiting other half before 18th June. If not there, I will refund the charges they have given me and call for a judgement online.
Bank - Clydesdale Bank
Amount Claimed - £214.65
Amount Paid - NIL
Have just checked HMCS and notice CB have ACKNOWLEDGED the claim therefore now have to wait 28 days for them to list a defence. Will keep you all posted

Amount they paid: £712 - awarded by judge, awaiting cheque from Abbey.
The story: I went to court and won! has this happened to anyone else?
I've been waiting for the Abbey to settle since I first started my claim in January 07. They kept playing for time, offered me half, then played for time again. Court date was set for 4th June but I thought they'd pay up before it got that far but they didn't. Right up to the post man coming on the 4th, I thought they would pay up - but no! Imagine my horror when I realised that I definitely would have to attend court. Thanksfully I had all the paper work ready just in case. I went for my appointment at the County Court and guess what! The Abbey didn't turn up. No surprise there. So the judge awarded in my favour!! The Abbey have to pay back all the charges plus the court fee plus travel expenses.
For those of you who are still trying, don't give up - don't be worried about going to court, it was scary and I felt unqualified to defend myself but I did it and it felt great! The judge seemed quite stern at first but he admitted that he was playing devil's advocate and was quite nice in the end. He even put my travel expenses on the bill that will be going to the Abbey. If anyone wants to know the sort of things I was asked, just fire away. I'm on top of the world tonight and dead proud of myself for not giving up.
