Got settlement letter from them 10th July
So happy i persevered with this, to everyone out there do not give up you will prevail in the end. As yet also no word that they are going to shut the account down either which is good news.

The story: They refused to pay giving me a long story as to how they were "service" charges and not penalties. I used the templates and paid £120 to the online court, They filed Defence. This took 2 months to get to here. Then, out of the blue an offer to settle in full plus costs. Thanks Martin and all on here for your encouragement to follow it through to the end. Had statements (all but a few) so asked for money back heard nothingin 2 weeks so sent threatening court. next day had the standard will take 6 to 7 weeks hope its sooner letter. waited 7 weeks from date they recieved my first letter. sent a reminder that the FO only allows them 8 weeks to resolve and would be contacting him with a complaint if i didnt hear. that would have been up today. last saturday recieved offer signed and returned it. they paid cash in yesterday and i drew it our in cash today :j
HSBC im waiting of a court date and started that claim about the same time. can afford to go after my credit cards now thanks to NatWest.claimed/settled - Natwest £2,535/£2,535, HSBC visa £80/£80, MBNA £1,258/£1,258, capital one £282/£282, tesco visa £515/£515, HSBC visa £140/£140. HSBC £1,450 MCOL Stayed for OFT case. Chelsea Mortgage charges & cashback £5000/£672. complaints with banks pending OFT Halifax £30, A&L £35. TOTALS £11,325/£54820 -

Got offer letter 1 week before preliminary hearing (date was set for 17th July in Central london country court) and money arrived in account this morning.
They paid interest right up to offer date and perhaps a bit too much - not arguing with them about it. The whole process took 8 months in all.

Started 15 May - with first letter to Lloyds asking to repay charges.
Bank chose to defend - received notice of transfer of proceedings to local court on 29 June 2007. This included Lloyds defence - that they were not penalty charges from a breach of contract but 'service' charges.
Today (12 July 2007) two letters from Lloyds solicitors; one saying they were going to defend proceedings.
The other saying they were going to pay up;
Asked for £366.25 (this included court costs); offered £368.54.
Really pleased as was getting nervous about putting court bundle together.

letter today offered £676, waited 6 weeks, and they offered this, going to accept 'cos it will pay off the overdraft and have a bit left over!0 -

Sent the 1st letter back in May after downloading Martins letters, got a reply telling me I have to wait six-seven weeks for consideration.l
Got letter three days ago, advising me that though they think the charges were justified and will not accept liability they are making an offer out of goodwill and being a loyal customer. Have accepted this, pity they didn't think I was a loyal customer before they put charges to my account.

You will get your money back providing you fight for it! They don't want to give it back obviously but as soon as you launch a count court case, you're weeks away from getting back what is rightfully yours.
Don't let them get away with ripping you off - spread the word now!
I had £2000 in charges but with interest, costs & £400 the court added for time taken to launch the case, I received over £3051.
Note: - even if you owe them money - you'll get your charges back guaranteed…

Amount refunded £822
Went through the excellent steps Martin posted on the site, got rejection letters etc.
Offered to settle minus interest to no avail.
Took out court proceedings and were offered £411, phoned the fellow who sent the offer up and he instantly with no argument doubled the offer to £822, which we accepted.
ALWAYS call the bank if the offer they make is low (looks like they are trying for 50% all the time).

Incidentally, my wife emailed you on Jeremy Vines Radio 2 show when you were asking for the listeners top tips..... Her tip was to do whatever you said to do, I think you gave that one 5 stars...!0 -
Thank you so so much for all your information... I finally won my money back from Nationwide after months of letting writing and finally taking them to the small claims court.
In total i received £1,200 - £100 more than asked for.
WHOOP WHOOP!!!!!
