hi, has anyone had success against yorkshire bank? currently claiming £4900 from them and in the process of going to court. They have sent us a £200 cheque as a good will gesture along with a solicitors letter, we obviously haven't cashed it. They have filed a defence but don't know what will happen due to recent suspension of court cases with FSA. Would like to hear from those who have dealt with evil yorkshire bank!!

I would like some advice on this please. I had a Yorkshire Bank account which was closed mid 2001 due to mounting charges which resulted in me being taken to court & obviously they closed the account. I wondered whether I'm able to claim anything back even though I eventually managed to settle the account. It's been on my credit record since as it stays for 6 yrs.
I would have to ask the bank for copies of records/statements which I'm sure they would be reluctant to provide after recent events.
Most info for refunds is on accounts still currently open - so any help would be appreciated x
Your claim would be outwith the 6 year limit as it was closed in 2001. Now you can start a claim from further than the 6 years but the the bank will then say its beyond the 6 years and they don't need to give you the information you require to start your claim.
Yorkshire are very bad for sending out the information even for accounts that are open so I don't see them being helpful at all for a case that is outwith the 6 year limit. Sorry its not more helpful but you can read this thread regarding the 6 year limit....

Thanks. looking further, the account was closed in nov 2001. Does that mean i still have a chance??.... I might be mistaken but does what you've said mean that if i get my skates on they will send me the aforementioned statements?0

Hi, time has now run out for Yorkshire Bank to respond to my flba. What with wehat has happened the last week or so, is it worth paying £80 on mcol to take it to court now or will it just be suspended. Any help greatly appreciated

Help !Previously posted my details but am now up to the stage where I have to pay £100 allocation fee for a court date at my local court. My claim is for bank account charges & given the recent announcements I'm still not sure where I stand & I'm loathe to pay this to find that Yorkshire just request the case be put on hold. I phoned local court who advised me I will need to pay to proceed & any application to put a case on hold is case specific - I have tried to get through to speak to legal team / solicitors for Yorkshire since Friday & frustratingly have to admit defeat at mo. Do I just have to take a chance & pay another £100 (that I can't really afford at mo) if I don't will I lose anyway? Thanks0

What they are likely to say is that they only hold or will send you the information from August 2001 up to when you closed the account as those are the months within the 6 year limit.0 -

You need to listen to the court. To proceed you need to pay the court fees and should the bank request a stay with your local court then you need to argue against this with the court.0 -

The decision is yours but if you don't file at court and wait then the early months of your claim will be time barred whereas if your claim is in the court system then your claim will be suspended from now until after the test case.0 -
Hi there, I'm currently in the process of claiming back £1300 from Yorkshire Bank and i'm in the latter stages. I've just received two letters this morning from the bank and the courts stating that they are defending the claim. I've done everything by the book but should I be worried? Will I go to court or is this just standard procedure? Sorry for my naivity but i'm a bit worried! Stew0
