Hi All.
i fist made a claim for unfair charges using the templates on this site against yorkshire bank back in Febuary. it took them 6 months to process it as an hardship claim and then only bothered to do that after i threatedned court action. Also i owe £242 on the account am claiming for, the total am claiming for is £1100. today offered me a partial settlement of £190 pounds none of which i would even see as they said that they would pay it derictly into the account which still has the money owed to them on meaning i would still have to pay them £52 and wait til the end of the fss test case to get the rest.
So i phoned the ombudsmans help line and inform them and they said that even if i owed money on the account the bank has to pay me by payment method of my choice. so i called the bank back and told them that and they said no they dont they said my debt to them is a priority and my others are not. sorry but i dont agree with the money i owe them being a priority i see the money they owe me as a priority. so i contacted the ombudsman again and they werent happy with what the bank said and are sending them a letter urging the bank to make an offer of full and final settlement on the full amount. plus they are not happy with the fact its take yorkshire bank best part of 6 month to actualy get this far when it should take them just 8 weeks. i told in previus phones calls checking the status of my claim that they only had 3 people dealing with the complaints and that was why it was taking so long (!!!!!! a department with just 3 people).
Any way the ombudsman is sending them a letter aswell as sending myself a complaint form. i informed the bank this stating that the letter is to urge them to make a full and final settlement so they are now listening and we agreed for them to wait till they have recieved the letter before going any further. So hopefully by monday next week i will have a final settlement.
they also said they came up with their sum for settlement by stating my hardship started in april last year so they only worked out the total sum of charges from between then and when i closed the account. yet how the hell is £190 going to help me with my hardship when it all going towards the £242 that i owe them. yet during this whole time i still get letters from their solictior threatening court action depsite the bank stating collection efforts are on hold until agreement is made.
Anyway for those of you that would like to get advice from the ombudsman then here are the helpline numbers 0845 080 1800 or 0300 123 9 123 (office hours).
will let you know how i get on with my claim.

In all honesty, I think that they have dragged their heals on this but they have complied with the FSA Waiver on Bank charges ie paid money back into the account where the charges have come from(whoever you spoke to is wrong...I spoke to an ombudsman rather than maybe someone who takes phonecalls for them). I do think they could look at any charges accrued this year and perhaps suspend charges but all in all they have complied with the waiver.

Also my hardship actually started back in 2001 when i was first made unemployed which is when i started having problems with debts. but they only take into account my loss of emploeyment through redundancy back in april 2008 as the start of my finicail difficulties which is not the case. neither have they taken into account all the charges they taken from my benefits during the periods of unemployment that i had for the past 6 years

In that case then the resolution of the case is the account being closed completely if they failed to close the account. Did you write to them or get signed confirmation of this?0 -

i recieved letter from them telling me the account has been closed but the amount of £242 is still owed just after new year, but i no longer have the letter. i do have a statement for the new account they setup that i recieved last month which i phoned and them about, which is when i was told it had been reopened and was with their collections department. even though it has a totally different account number and sort code to that of the original account. yet their solicitor still send me letters demanding payment using the original account number and sort code, most recent letter being this monday.0 -
Hello all.
Around two years ago i followed the instructions on here to claim the charges back on my business account.
I ended up involving the FOS.
In the end the bank wrote and said they were not going to pay out. The FOS also wrote saying they were not going to take it further.
I wonder if i could try again? The amount is over £1000 and that would just about get me out of debt.
I was, however successful in reclaiming the charges on my visa card and am at present trying to reclaim the PPI on the visa acount.
Any advice would be greatly appreciated.

6/7 years ago my mortgage deal was coming to an end so I arranged a new deal with Yorkshire bank. After agreeing the deal over the phone I was sent mortgage proposal paperwork which I signed and returned. Six times the deal was pulled and I was told the interest rate I had initially applied for was no longer available. This was at a time when interest rates were very low but I truly believe that Yorkshire bank were witholding my offer until interest rates rose again because after 6 months of them telling me that after I had accepted a particular offer my payments had gone from £300 to £600. I am hoping to find people who have had a similar experience. I believe Yorkshire Bank were speculating and not processing my paperwork because they were hoping to make more money from me. I'd be grateful for any advice - I still have the initial paperwork - each deal takes 1-2 months for them to come back to me and reject it on account of the fact that the interest rates have changed in the time it's taken them to process it.0 -

That timing would place it at during the credit crunch. At the worst period of it, deals were being reviewed daily and replaced frequently. Some on a weekly basis. That isnt normal but the credit crunch wasnt normal either.This was at a time when interest rates were very low but I truly believe that Yorkshire bank were witholding my offer until interest rates rose again because after 6 months of them telling me that after I had accepted a particular offer my payments had gone from £300 to £600.
Interest rates have not risen since the credit crunch. Although there have been periods when deals have come in with higher or lower terms than the previous tranche.I believe Yorkshire Bank were speculating and not processing my paperwork because they were hoping to make more money from me.
You are being paranoid.each deal takes 1-2 months for them to come back to me and reject it on account of the fact that the interest rates have changed in the time it's taken them to process it.
Which was about right for that period. Nothing wrong here. All deals required the money to be advanced within a defined period or until the deal is withdrawn due to special circumstances.
Plus, you are too late anyway. You have 6 years from purchase or 3 years from being reasonably aware of an issue to raise a complaint.
