    I think Yorkshire Bank have a sneaky little scaming going which not only do most of its customers not know about or understand, but neither do any of the consumer groups know about. They charge you £25 when you go over your limit and then charge you the next month for the privilage with interest.

    I've found that going overdrawn by £30 quid has cost me well over a hundred pounds.

    As £25 at the time, £25 on the 16th, Not enough funds, therefore £25 charge and again the next month on the 16th all these plus unauthorised interest.

    £50 plus unauthorised interest, is this the highest charge?

    I didn't have enough funds to pay a phone bill on the 20th. A £35 charge for non payment, this takes me over my overdraft £25 charge.
    I sort myself out the next month and pay the payment that is in arrears. I leave enough money in the account for this months phone bill. Charge appears on the 16th £25. The 20th comes and there isn't enough funds to pay the phone bill charge of £35, this then takes me over my overdraft £25 charge and then again the following 16th.

    January = £45 + £35 + £25
    February = £25 + £45 + £35 + £25
    March = £45 + £25

    Phone = £135
    Charges = 170

    The Bank will not do anything about it. This has happend a few times over the last 6 years; I can't wait to see the list of charges, I know I should have been more careful with my money but Yorkshire Bank are taking the prevebial with their customers.

  • Went to the bank to sort out my loan account and current account, current account they've upped my limit, I was over my limit, but as I made her laugh regarding this big breasted woman who went in before me, she waived the 25.00 charge for me!!!

    PPI gotta sort out!!!

    Please can anyone help me with this problem?

    I am claiming charges back from Yorkshire Bank and I am at the process at the moment of sending off the second letter after having totalled up all the charges on the statements they have provided me with.

    My problem is that my account was closed a while ago due to me having serious money problems and I am now paying the money back that I owe them by monthly instalments.

    Having totalled up the amount of the charges it would appear that most if what I am repaying them is basically the amount of the charges.

    Anyway, my main problem is this.......I have totalled up the amount of charges but what can I do about the extra charges that were imposed on me when my account was closed?

    My closing figure was that I owed them £1101.00 and they then upped it to £1185.00 telling me that they were charges that could not be cancelled.

    They have very cleverly sent me the statements up to the date my account was closed, but I have no record of the extra charge since closure of the account. What can I do to claim this as well? Would I need to write to them for this?

    Any help or advice on this would be greatfully received.

    Hi, i'm quite a way into the process and have sent several letters and have had a very feeble offer from Yorkshire Banks Solicitors - i've put in a claim forjust under £3k. Their solicitors sent me a letter offering me £200 (their letter said £200 but the form they wanted me to sign to accept said £400!). Anyway, this was back just before the hold was put on everything. My question is really do I go to the next step which was to take them to court or do I just wait it out until a decision on 22nd May?? I can't really afford even the small amoun it will cost to take them to court as i'm so overdrawn with my current bank and my outgoing at the moment are coming in at more than my incomings so I'm really really broke and can't afford any extras other than my household bills at the moment!!

    Thought I'd let you all into my misfortune...

    A few years ago I had a Yorkshire Bank Visa with a duplicate card for my partner. My partner had used it as if it was her account as her credit rating was low and got into trouble with it which I sorted as soon as she admitted it.

    Well with all the claiming going on, I thought I'd jump on the bandwagon. I sent off my first letter to YB with my £10 cheque and within 5 days received a big package of duplicate statements (:TYB). I sat and went though all the statements and found a total of 4 charges at £15.

    So lets do the maths 4 x 15 = £60 charges
    4 x 12 maximum charge = £48 what they sould have charged
    So £60 - £48 = £12 refund due.
    And finally £12 refund - my £10 letter cheque = £2 due:eek:
    Ah well... I tried! :rolleyes::rolleyes::rolleyes:
  • Where do you get the £12 from? There is no legal basis for £12, the OFT stated they would not take action on amounts above that. It not a legal basis. Now, did they offer that and did you accept it?

  • Write to them and claim the lot. Don't be put off by the £12 thing. They will all try it but will only get away with it if you let them.
  • Afternoon all, not been here for such a long time.

    My mother is disabled and is now housebound without any phone line, my sister & I are her contact with the outside, anyhow last year we found her bank statements and to our horror she was being charged at standard rate of £8 per day (5 days), mum gave me permission to act on her behalf to deal with the charges claim. Yorkshire bank were very unhelpful to say the least.

    Mum was forced to give up work earning £64 per week as the bank were taking £40 per week plus what was still overdrawn leaving nothing and the balance steadily building up with no way of paying of.

    We did a list of her charges are suggested and to our horror it totalled over £4000, we sent the letter of also stating the hardship in May. Mum had an acknowledgment and nothing else, I have phoned and phoned only to have my calls ignored, never returned.

    Can anyone advise me what I can do next to help mum?

    Re-write to Yorkshire, quoting from above any clauses that apply to your Mum and ask for them to review their decision and treat the claim as a hardship claim as per the FSA guidelines.

    If they refuse you have the option of complaining to the Finacial Ombudsman Service (you could mention this in the letter, since if you did that it will cost them £450)
  • I would strongly suggest going straight to the FOS. From the day you claim hardship status from your bank - as you appear to have done in May and which was acknowledged by the bank - they are required to give you a definitive answer of whether they agree your hardship status of not within 8 weeks.

    The FOS will take up your case and will be able to adjudicate on your hardship status should the bank not agree to it. The criteria the FOS uses to determine hardship status is as per FSA revised waiver guidelines:

    In making an assessment of financial difficulty the firm will take into account:

    a. evidence of changes in lifestyle, including loss of employment; disability; serious illness; imprisonment; relationship breakdown; death of a partner; starting a lower paid job; parental/carer leave; and starting full-time education;

    b. evidence of the following events:
        1. items repeatedly being returned unpaid due to lack of available funds;
        2. failing to make loan repayments or other commitments;
        3. discontinuation of regular credits;
        4. notification of some form of insolvency or court proceedings;
        5. regular requests for increased borrowing or repeated rescheduling of debts;
        6. making frequent cash withdrawals on a credit card at a non-promotional rate of interest; and
        7. repeatedly exceeding a credit card or overdraft limit without agreement (and, in this regard, where a complainant has incurred over £500 in unauthorised overdraft charges in the previous 12 months, that is to be treated as indicative of financial difficulty).
