    Apologies, the point I was specifically mentioning is that local branches can forward letters about bank charges to the correct department but when it comes to specifically REFUNDING cases of hardship, the branch network will not do so but a centralised team that deals with bank charges claims can do. Has the FOS said that both of you have to claim for them to look at the case of hardship? (that kinda makes sense, tbh).

  • I've decided I'm going to put on my own little protest at Yorkshire W*nk. I'm going to stand outside with posters and hand out leaflets to customers and come closing time I'm going to stage a sit in (don't know how long I'll last without a fag though:)) If only to raise awareness of how YB are treating their customers who are suffering such hardship, 8 weeks is an eternity when you're poorer than a church mouse.
    Kat, I do understand what you are saying but if the bank ask you to leave and you refuse they have every right to call the police to have you forcefully removed from the branch. There is a lot of awareness of the bank charges campaign already.
    Stick to the process on here and follow it would be my advice to you. Thousands of people have followed the tried and tested approach.

    I'm just so frustrated and reading through this thread you can see that YB seem to be the only bank who are hanging on till the bitter end. Have written another letter today to their customer services manager primarily asking him to explain what EXACTLY they have to do that will take them 8 weeks. I also got a letter from yet another firm of solicitors on behalf of YB demanding 214.88 be paid by 15th Dec, this is a closed account which they owe me at least 500 in charges on. My response to these letters has always been "BRING IT ON" If YB want that money then take me to court. I enclosed a copy of said letter and asked him if he can see the irony in it??? I closed by wishing him a merry xmas and prosperous new year something which my family won't be looking forward to. So watch this space.

    Incidently has ANYONE got their money back from Yorkshire Bank yet

    Hi - just wondering if anyone can give me some advice/help.

    Im helping my hubby claim back from the Yorkshire Bank. He already had all his statements - so we went through all the charges and sent them a list along with a letter asking for the money back(we used the template from this site and edited it to say we are in financial trouble - hoping they would hurry it up!).

    We recieved two letters back saying that they are dealing with it and will get back to us soon.
    Now we have recieved a letter from them asking us to complete a financial planner with all our outgoings/incomings and then they will decide if we will get the money back based on that?!

    Has anyone else had this? What did you do?

    Hi Busy, they want details of your income and expenditure in order to show you are under financial hardship. However don't hold your breath, even if they accept a hardship claim they will tell you their turnaround is 8 weeks. What this means is they are supposed to deal with your claim within 8 weeks but if they don't you can report them to the financial ombudsmen service who will............give them a strict telling off :rolleyes:

    I'm now waiting for them to deal with my claim but I won't do it quietly, I've written to them asking for a full explanation of EXACTLY what they have to do that takes 8 weeks!

  • Just a bit of an update (don't get excited) I have complained to my MP as she works in the treasury for whatever that's worth :confused:

    The 8 week deadline has come and gone, quelle suprise!!! YB have informed me it's taking longer than anticipated (liar liar pants on fire) and it will be at least another 4 weeks (not holding my breath) so I have just filed a complaint with the FOS.............

    Tune in for next months exciting episode :money:

    Just opened a letter from YB. I had 2 accounts and was claiming for each one separately. One account which is now closed they owe me at minimum 500, that's not counting interest, I applied the hardship rule and asked for 724 (because they would offer me less). However they have managed to accumulate 214 ALL CHARGES on this account, I have had numerous collection agencies trying to get me to pay this money and have refused point blank, if YB want this money then take me to bloody court and let's rumble!:mad:
    Anyhoo they have offered me 425 no strings as in it's not a full or final payment BUT they want to repay the 214 quid to the collections firm leaving me 210 :eek: what is wrong with these people (I use the term "people" loosely) do they think I'm gonna let them have the 214 then spend 2 years trying to get it back???

    Incidently do you think this means they will make me an offer on the other account which I've had longer and will have significantly more charges? Are they just testing the water to see how desperate/stupid I am?
  • Hi Can anyone help? I am trying to claim my hubbys (the plonker) bank charges back for him...as he is hopeless at any thing financial hence..........£3,000 in bank charges:eek: but some of this started as an overdraft ie he was overdrawn by ??£250 then it became bigger due to bank charges, So after sorting it all out going throught the process as advised in the forums Yorkshire bank refused point blank to refund anything So we paid £100 and took them to court then a stayed was put on till it gets sorted, since then Yorkshire bank have been on our backs to pay £5 each month till it is sorted, now I argued the toss with them about this stating that they owed hubby £3,000 so why should he continue to pay for been over charged their reply was if we dont contribute something towards this then we will end up with a CCJ:eek: so I left it to see what they would do and we have had solicitors letters demanding money can anyone please advise me on what to do :confused: we are tempeted to not pay anything and see if they do take us to court but I dont want it to go that far :confused:

    Yorkshire bank shouldnt do this - if they do claim against him you can defend the claim in full and counterclaim against them for the £3000 and removal of the default. Theres someone on Legalbeagles who has done this - similar amounts too - theres no financial hardship in that case so the case is stayed - Tools v Yorkshire Bank. Can't link it unfortunately but if it comes to that pm me and I will give you details of the counterclaim used.

    You can write to the Bank remind them they shouldnt be defaulting let alone hassling you for money, claiming against you when you have an outstanding stayed claim against them is a big no no :) A letter and monthly goodwill payments of £1 (or £5) might stave off them claiming against your OH which would save a lot of hassle.
