  • Hi. I've only received bank charges recently. Earlier this year I was given 2 cheques which bounced & I was charged £6 each time (I think thats totally wrong, the person who wrote the cheques should surely get the charges, not me?!)
    Then in September I went over my o/d limit by just under £30. They charged me £25 at the time & want to charge me a further £25 on the 17th October.
    I've contacted my branch who told me if I want to request my money back I have to send them a cheque for £10, then they will consider it.
    Is it worth me trying to claim the money back? Do I send the letter to my branch with a cheque like they said or can I send a letter directly to the bank head office myself?
    Any advice would be appreciated
  • Attended Grimsby County Court Yesterday. The opening remark from the Judge was that as Yorkshire Bank had requested a stay I could try and convince him but that no one in the area had managed to convice him not to put a stay on before. A lost cause before you begin. He did however say that he did think that the test case would would be settled one way or another without appeals. While disappointed I was pleased that he had obviously read the file. Despite what the YB claim that the £200 they have been offering in full and final settlement is an offer and not a gesture of goodwill. Will have to await the outcome

    i wrote a long post last week explaining my posistion in an argument wth yorkshire bank

    Up shot is, i owe them £1172
    This is all charges
    There taking me to court
    They wont give me statements or coppies of signed credit agreements as "the wavier means they dont need to deal with charges claims."
    They wont deal with me only my solicitor, i cant afford a solicitor and am doin this off my own back!

    got the County court summons last week, filling it in tonight, going to contest the full amount but i need to include a defence!

    any Ideas as to what to put in there???????????
  • Defence is bank charges and OFT test case stay. You will be arguing for the case to be stayed awaiting the OFT test case conclusion and that if they choose to continue then you will be defending it on the basis that the bank charges are unlawful.
    You also need to ask for further information ie disclosure of charges that they claim make up the total amount.
    I think the first bit is acknowledging the claim, have you done that?

    i have the forms to acknowledge the claim and they need to be returned in the next 3 days, i intend to contest the full ammount on the basus that they are made of unlawfull charges, the £1172 they want is from an £830 od that was within the limit of £850. they canceled the od and billed the hell out of me for the privalidge but prior to this i had incured rediculace charges through the snowball of going over my od causing bounced dd, then when i squared the debt and was within my limit, the charges for the un autherised dd would be taken when the account didnt have enough funds and the hole thing started over with bounced dd etc, this went on for several months, as the bank wont give me the statements i am yet to calculate the full amount of the charges so i intend to contest the full amount on the basis that i canot accept responsibility for a specific ammount untill the bank provide the information i keep requesting.

    Do i need to go into details quoteing bylaws etc in the initial responce or is that only when i get to court???

    In October 06 I began trying to claim back around £2200 from Yorkshire Bank. I got right up to the court attendence point last July but I was away for two months (in the RAF) and missed the court date. Since I got back into the uk I've had a letter saying the case was closed due to non-attendence and haven't pursued it any further.
    Does anyone know if it would be possible to get the case reopened or have i blown it for myself? Many thanks in advance for any advice anyone can offer.

    I had an account with Yorkshire Bank and from 30/04/07 to the middle of July 2007 they have taken £501.70 in charges despite me cancelling all the DD's in May and asking for the account to be closed. This has resulted in an outstanding balance of £378.20.

    I filed a claim with them regarding the charges (there had been ones previously but it was the level of these ones I was really disputing) and at the end of August I received a letter saying that the matter had been put on hold pending the outcome of the High Court test case.

    In November and ever since, I have been receiving Solicitors letters chasing the outstanding balance. I have explained that I do not agree that I owe the money and that the matter has been put on hold but they are still insisting that I contact them to arrange a payment plan or they are going to take the matter to Court.

    Does anyone know how I stand? It seems grossly unfair that Yorkshire Bank can refuse to deal with my claim because of the test case but can then take me to court because they say I owe them money which is purely due to their charges!!

  • hi I'm ceratinly going to try and reclaim charges Yorkshire Bank have given me. Even though I have been overdrawn, I checked my balance yesterday and it said 135.00 overdrawn. 64.19 for loan repayment (which by rights is in a different account) 50.00 owing to the bank and then charges 25.00.

    Its really not fair!!

    So certainly gonna reclaim my charges and look into my loan account to see if i've got ppi on the loan...
  • I have just got in touch with the yorkshire bank, and they have told me, I have PPI with the loan I have taken out from 25th feb 2005, calculated the ppi 10.85 per wk for three years, so far they owe me 1,692. i'm going to try and claim it back as I didnt know i'd got that on the loan.
