hi everyone
I've been a busy bee lately doing bank cherge refunds for friends/family! left mine til last!
Anyway i wrote to yorkshire bank request my statements (3 accounts!) end april
they cashed my cheques begin may and i wrote straight back requesting refunds
They i feel purposely dragged their heels saying systems down, work overload blah blah
At the begin of August i got the dreaded letter saying all claims were halted for test case! i feel they purposely fobbed me off
Anyway i've made a claim to moneyclaim for all 3 accounts, this cost me £120 which tbh i cant afford to waste
Anyone guess my chances0 -
I was in court on August 1st reclaiming 4366.00 + interest from Yorkshire Bank. The Judge declined YBs representatives request for a stay, and asked me to forward evidence of charges to Court and to YBs solictors. Which I did.
Today August 16th I have received a letter from court saying that it is aware of the test case which has been issued in the High Court between the OFT and certain banks and, UPON it appearing that the issues raised in the text case may affect the claim. IT IS ORDERED THAT 1 THE CLAIM IS STAYED UNTIL FURTHER ORDER WITH A VIEW TO AWAITING THE DECISION IN THE TEST CASE. 2 EITHER PARTY MAY APPLY AT ANY TIME TO LIFT THE STAY, BY APPLICATION ON NOTICE, IN ACCORDANCE WITH PART 23 OF THE CIVIL PROCEDURE RULES. AND IT IS ORDERED THAT THE ORDER DATED AUGUST 1ST (NOT DRAWN) BE REVOKED. Really confused now, does that mean I've to wait 'till next year now? What was the point in the Judge declining the stay? Help!!!0 -
Wondering if anyone can help me.
Iam currently claiming over 4000 pounds from the Yorkshire bank.
Been threw MCOL and put judgement of default in on 17/07/2007 And waited a week for reply. Rang the bank a week later to ask if i was gonna get paid.
I was told that the cheque was in the post.
A week went by no cheque so rang again told would be with me in a few days. I then recieved a letter from the bank telling me they were aware of court action made against them this was dated 31/7/2007. This letter went on to say they were going to put a application to stay cause of the OFT test case.
This is where it gets interesting they then sent me another letter dated 9/08/2007 saying that they were not originally aware of the MCOL claim made against them and that they were going to put in a application to set aside judgement on these grounds.
I have since recieved the application from the court and a court date for 29/08/2007 for which I am to appear.
Can some one please read this and offer advise or tell me a possible outcome. I am so desperate and have no one to turn to for help.
I have acctually put in a warrant for the money after I recieved the first letter just to confuse you even more.0 -
I had a letter from Clydesdale Bank on 31st July 2007 stating the claim had been put on hold until the OFT had resolved the issue.#
Does anyone know when the OFT hearing is & if they see the charges 'unlawful' does it mean i will get paid out without quibble?0 -
Hi all, Just wondering if anyone can offer any advice...we had placed a moneyclaim for bank charges from Yorkshire Bank/ Clydesdale which they offered to settle out of court (as a gesture of goodwill!) We accepted it in full payment of our claim....two months later we are still waiting for the money! The bank continues to fob us off saying that they "have so many cheques to post out, you are down for a cheque but it is taking time to process them all"
What is a reasonable length of time to give them? I thought 2 months was more than generous....any ideas what I can do to SPEED THEM ALONG!! Any advice is very very appreciated at the end of my teather with them!0 -
Send them a 7 day letter, then if they do not pay up, continue with your action. They think you do not mean it, show them you do.Don't lie, thieve, cheat or steal. The Government do not like the competition.

Hi Im new to this and I have recently requested my statements from my bank I recieved them this morning. I have noticed that when I went over my over draft limited by only a few pounds they have been charging me £6 per day plus a £25 charge. Can I claim all of this back or is it just the £25??? Really confused. It also mentions DEBIT UNDER ADVICE??? again what is this???

HI TO ALL AGAIN, I WAS POSTING ON HERE BEFORE MY COMP DIED ON ME A FEW WEEKS AGO. (GRIMETHORPE) WELL HERES AN UPDATE OF WHAT HAS HAPPENED WITH MY BANK CHARGES CLAIM.
I WENT THROUGH ALL THE PROCEDURES AS ADVISED BY MARTIN LEWIS AND EVENTUALLY ON THE 30TH JULY I WAS AT COURT FOR MY HEARING.
THE BANK FAILED TO SEND ANY REPRESENTATIVES TO THIS HEARING AND THE DISTRICT JUDGE FOUND IN MY FAVOUR AND AWARDED ME FULL CHARGES AND COST AND INTEREST TOTALLING £7.271.01
THE JUDGE GAVE THE BANK 14 DAYS TO PAY IN FULL. THE BANK THEN REFUSED TO PAY ANYTHING TO ME. THEY THEN APPLIED FOR LEAVE TO APPEAL THE JUDGES DECISION AND APPLIED FOR A STAY OF DECISION UNTIL THE OFT AND BANKS GOT THEIR DECISIONS ON TEST CASE,.
I THEN HEARD FROM THE COURT TODAY THAT I HAVE TO ATTEND ANOTHER COURT DATE ON THE 4TH SEPTEMBER 2007 TO SAY WHY I SHOULD BE PAID BY THE BANKS, THEY ALSO HAVE TO ATTEND TO SAY WHY THEY SHOULD BE ALLOCATED A STAYED VERDICT.
OBVIOUSLY I AM VERY PEED OFF ABOUT THIS DECISION SO WHEN I GO TO COURT NEXT WEEK I SHALL BE TAKING A STATEMENT THAT I HAVE WRITTEN WITH MY REASONS FOR THE CASE GOING MY WAY.

May I suggest you check the threads for arguments you can use against the judgment being set aside. Getting a judgment set aside is not that easy.As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0
