No point going to the CAA as the flight didn't originate in UK?
Download Vauban's guide, send your NBA then start legal action if no response from that.
One possible tip I saw on a different program is when you send an NBA, have the small claims papers already filled out, take a screenshot or photo and include that with your NBA as a statement of intent.If you're new. read The FAQ and Vauban's Guide

Hi JPears, thanks. My flight was Gatwick South to Heraklion so was UK initiated, I've jumped over to this thread from one I started that didn't get much attention!
I'll pull my NBA together over the next few days and send.

Has anyone else used Resolver and just not had a reply at all? I submitted a claim on Resolver to Alitalia airline back in September for 2 people for 2 flights (out and returning) from London to Havana - delays were both 3.5 hours each way arriving.
On first submitting the complaint I received an automated ‘we will get back to you soon’ email, but since then I’ve escalated it every few weeks in line with what Resolver has advised and now it’s reached the highest level of escalation and nearly 2 months later I’ve not had any kind of response.
Is this normal? Other people seem to have had claims resolved in the same week! Or at least get a response from the airline with an outcome decision.
Has this happened to others?
Would you suggest I ring the airline too now to follow up why I haven’t had a response? I’ve also sent them the EU air passenger rights forms from the beginning so they have all the information they need.0 -
Alitalia is in ongoing adminstation since going bust ladt year. It is still operating but I suspect you will have to start legal action to get any movement on this matter. Clearly they are just ignoring you. They can't ignore court papers.If you're new. read The FAQ and Vauban's Guide

As you may already know, Alitalia is bankrupt, and if it was in the UK I believe that it would have already gone the same way as Monarch.
You may not have much time, if any, to sort your claim out. Waiting for Resolver would be a complete waste of time imo, so if I were you, I would send them a LBA with a view to issuing legal proceeding.

I have been seeking compensation under EC Regulation 261/2004 for a delayed flight with XL Airways since April - I have been fighting my case and last week received an email back with an offer - a 'commercial gesture' of 100€ or 140€ in vouchers.
My original claim was for 600€ as the flight was delayed over 4 hours from SXM to CDG at a distance of 6730 km. My original booking, a direct flight, also became a 1-stop and I missed my connection from CDG to MAN.
I would like to know if anyone here has received a similar offer from XL Airways in the past? If so, what did you do, did you accept it or pursue the claim further? What was the outcome.
I can see a few people (Mr Nibz, Tinks - good luck!) are dealing with a similar issue in regards to their flights with Enter Air and pushing for full compensation. I am going to do the same

Pursue further. The fact that you have been offered something is a sign of liability but they are trying to cut there losses.
Time to initiate legal action for recovery of the compensation probably owed to you.
I assume your CDG to MAN was a different airline?
When did your flight become one stop rather than direct? At time of departure or were you notified of the change beforehand?If you're new. read The FAQ and Vauban's Guide

CDG to MAN was indeed booked with a different airline.
The flight became a one-stop just before time of departure, we were notified at the gate. The stop in PTP was for re-fuelling of the replacement aircraft.

XL are being very cheeky with that offer, it's a set amount depending on distance etc.
The airline will be XL Airways (France) as the British company went into liquidation a few years ago. This matters because I don't believe that XL have any operations or offices in the UK. If you can confirm this, it may mean that you will have to use the European Small Claims Procedure to claim your full compensation.
Dr Watson has provided a very comprehensive guide to the ESCP procedures in the Ryanair thread.
I don't recall any other claimants who have claimed from XL Airways prior to today, so you may be the first.

I’ve used both the Easy Jet website form and MSE standard letter to claim for flight delay compensation but have not received any acknowledgement from Easy Jet.
I have also e- mailed them asking fo a reply.
Is this a plan to limit payments?0
