Flight delay compensation, all other EU airlines

    I know they failed in 2008 but it is possible the original confirmation of the holiday was issued before they failed and he has lost subsequent documentation which would have shown the new airline. Of course, if it was June 2008, time has just about expired anyway..
  • Advice needed. Aer Lingus

    due to fly LGW to DUB 30th May arr 10:40.
    7 days before this was changed to arr 11:40.

    At 19:40 night before, my flight was cancelled due to strike action.
    At 09:10 I was given the choice of refund or a flight to Belfast !

    Having no other position :mad:
    I arr Belfast 14:45, then train to Dublin arrived 18:20 ! !

    Question: can I claim the full € 250 euro or is it pro rata ? If so how do I claim ?
    Or can I only get my rail fare as I was told by Aer Lingus ? ?

    Any other suggestion thanks

  • Just returned from Bulgaria on Balkan airlines, we had over 3 hours delay which they said was down to flight coming in late. We saw the plane we eventually got on being repaired on the runway. When we got on it there was a strange burning smell, it took off and there were fumes in the plane causing everyone's eyes to sting and people choking, we were given wet tissues to cover our faces. eventually the plane had to return to the airport and after an hour we landed back at Bourgas airport. We then had to wait for another plane to take us home. In all it was about a 7 hour dealy. We have since found out that this has happened on several occasions and they have kept using this plane. Will we be entitled to delay compensation and further compensation because we were put through unnecessay suffering and inconvenience as they had obviously been aware of the problem for some time?

  • I was due to fly from Birmingham to Dublin when my flight, the 8.15am was cancelled due to high winds. I was booked on the next available flight at 3.15pm. When I went to check in I was told I'd made a mistake and was on the 7.15pm. When I showed the girl on the check in desk my boarding pass, she said there were no seats left as an aircraft had been diverted from Bristol and those passengers had to be accommodated. The 7.15 was delayed, finally taking off at 10.00pm and arriving in Dublin at 11.00pm. I had to stay in a hotel in Dublin as it was too late to get to my destination. I claimed from Aer Lingus and they paid for the hotel but say I'm not entitled to compensation because the flight was delayed due to bad weather. If this ever happens again I shall make sure I keep copies of all documents and record every conversation I have.

    It's a two part test so them demonstrating EC is only part 1. They could have got you there quicker in a taxi!

    Hi all,

    I'm helping a friend with a claim and noticed that there is no Adria thread (or, according to the search, even mention of Adria issues in the forum) so I thought I'd start one.

    Date: 11 May 2014
    Flight: JP0510 (LJU-CPH)
    Delay: 3:50 hours
    Reason: The pilot said that it was due to mechanical faults to two of Adria's aircrafts. Adria confirmed this in writing.

    I sent the template letter but Adria refuses to pay although they accept responsibility. I will send a second letter urging them to reconsider before taking the matter to the regulator.

    Here is the (redacted) response from the airline:

    [FONT=&quot]Thank you for your letter. In reply to your letter of claim, Adria Airways do apologize for all inconvenience resulting from the delay of our flight JP510 from Ljubljana to Copengahen on 11th of May 2014. We wish that everything could have been more favourable. We regret all the troubles in this connection, as we understand how upsetting it could be to have a journey disrupted in this way and are sorry you were not able to travel as planned.[/FONT]

    [FONT=&quot]We do realise the importance of operating according to published schedules, however sometimes for reasons beyond our control, circumstances regretfully prevent this. Whilst we try to keep flight irregularities to a minimum, unfortunately delays do occur from time to time. The delay of the mentioned flight JP510 was caused by an unexpected technical reason which appeared on two of our aircrafts that stayed grounded and affected the safety of the flight. We were not in a position to make a quick repair. It consequently led to inevitable long delay of the flight from Ljubljana to Copenhagen.[/FONT]

    [FONT=&quot]The liability for an airline in such situation to the passenger is, besides bringing him to his final destination from his ticket by offering possible re-routing and re-booking to possible available alternative flight connection by our colleagues at the face, also care and assistance provided when needed, e.g. hotel/meal vouchers, phone/fax (which services are exactly indicated acc. to EU Regulation 261/2004/EC) received as the standard handling procedure at the place.[/FONT]

    [FONT=&quot] If any direct additional expenses in this connection incurred, please do send us the original receipts for settlement, accordingly.

    Please be informed that according to the EC Regulation 261/2004 passengers are not entitled to receive monetary compensation in such case. We hope that you will understand that we are therefore unable to comply with your request for compensation in this regard or take liability for loss of earnings or working time.[/FONT] [FONT=&quot]Judgments on individual cases you mention in your letter apply to the parties involved and do not supplement or replace the EU Regulation 261/2004.[/FONT]
