    It doesn't matter. A delay of three hours at arrival at destination is treated identically. Your flight was cancelled and were rerouted, arriving at your original final destination in excess of three hours.

    Your flight is classed as cancelled under the Reg and that being the case, so long as your rerouted journey prevented your arrival for more than 2 hours later than your originally scheduled time of arrival at Shannon then you are entitled to compensation.

    The amount due to you is €250 per passenger.

    Of course. It's a slightly odd anomaly (which I don't understand) that if you are re-routed, you only have to arrive two hours late at your final destination, not three. Why is this?

    We recently endured a 4 hour delay with Small Planet Airlines due to mechanical failure. I know we are entitled to £210 compensation each but my online research suggests that SPA won't be easy to deal with. I'd greatly appreciate any advice on the best approach to take. I'm about to email the HQ of Small Planet in Poland but I doubt they will reply so I'll also prepare an email to the CAA.

    have a search in the thread for Small Planet and you will find some others that have gone through the process
    The FAQs on the first page should give you all the info you need to take this forwards

    re the CAA, the main opinion is that this is a waste of time, they could take months to get back to you and even if they find in your favour, they cannot force the airline to pay up (I am assuming the delay was departing the UK since you mention CAA)

    As far as I can tell not a single customer has achieved any results from claiming from Small Planet, they either completely ignore the correspondence or if you push, deny the claim. They have no address in the UK, their office in Gatwick closed last year, so please don't assume you are dealing with an airline that has any qualms about ignoring the law, although there are many here who would argue most of them ignore it. Although things may have changed, I also recall the best no win no fee firm won't touch claims against SPA which may say more than I can!

    Many thanks for the reply Alan - it always frustrates me that shysters seem to constantly get away with ignoring the law. I will give it my best shot but as you say the fact that the no win, no fee brigade won't take on SPA speaks volumes.

    Hello Guys,

    I am a newbie to this forum and have found much useful information.
    I am in need of some serious help, my flight with Emirates got delayed from Birmingham Airport in Nov 2011 hence I missed my connecting flight in Dubai and reached at the final destination 7 hour late.

    I wrote to Emirates who accepted it was a operational delay (via email) but as the delay was on the second leg which is not an EU point they refused compensation.

    I took the matter to CAA which took 2 years and nothing came out of it as they told me to wait for the ECJ ruling and after that emirates rejected the claim.

    I finally took the case to Small claims court in April 2014 and now have received a 15 PAGE DEFENCE from their solicitor claiming that the claim is time barred and that the delay from EU airport was only 34 min.

    I will be posting the defence and need help preparing the bundle. I also want to check if anyone has actually won the case against emirates as I have been told this will be waste of time.

    It's a bit late to ask that! You've either got a case that stacks up or you haven't. It's up to the court to decide, not the airline.

    I totally agree but worried if I will end up paying the costs of emirates if I lose.

    Do you know if anyone has won against emirates after the ECJ ruling.

    I am also trying to post the letter(pdf) from their solicitors but could not delete my details any ideas?
