  • I experienced a 6+ hr delay from London Gatwick to Knock west Ireland with XL Airways, who have since folded. Is this a lost cause now or is there someone whom the claim can be made against? Any advice would be appreciated :)

    You can only claim against the airline. And, as you say, if they've gone bust who'd pay the compensation? So no.

    Is there a way that first time posters could be redirected to the FAQ's before a first post from them (on this sub section) is accepted?

    I'm not annoyed at the frequency of the same questions being asked any longer. I just think that first timers would benefit from seeing in big red letters the answer to their question, without them having to post.

    First timers clearly don't know that there are FAQ's. There must be a way to make them aware, surely?

    We flew back from America a couple of years ago & were delayed for several hours. We tried to claim compensation but were refused as they said a member of staff was sick & therefore they did there best to get a replacement asap & therefore were not entitled to any refund, is this correct?

    There is the "Important Information, please check before posting" Sticky but this appears to be overlooked

    I don't think there is a way to fix this, you only have to look at some of the other boards and you get a "I ticked the button to say I had read the Ts&Cs but I had not and now I realise what they say and I am not happy""
  • I used the template letter for a flight delay back in 2010.

    This was the response, does anyone know what the limitations are for Portugal or can point me in the right direction of a response I can tailor if I can still claim?

    We would like to inform you that Passengers and baggage transportation are subject to rules determined by the General Conditions of Transportation, The Montreal Convention and the European Regulation (EC) 261/2004.

    According to the article 16.3 of the General Conditions of Transportation, available for consultation on our website, any right to Damages shall cease if an action is not brought within two (2) years from the date of arrival of the aircraft at destination or from the date on which the aircraft should have been arrived or from the date on which the carriage stopped.

    Since the above mentioned flight arrived in 2010, we regret to inform you that the claim deadline has already expired.

    We regret all the inconvenience caused and look forward to welcoming you soon on board a satisfactory TAP flight.

    Do a search - including on google - for the Dawson case (of this week!) and write to TAP to inform them limitation in the UK is 6 years, and you will be taking them to court if they don't pay up.
