    My outgoing flight with AirItaly was cancelled (with more than 2 weeks notice). As a result of this I was unable to take my return flight with another operator (EasyJet).

    Both tickets were non-refundable and I was unable to cancel my return flight. Air Italy has refunded the cost of the flight they cancelled but are refusing to refund me for the return flight.

    Any ideas where I stand with this? Or where I might be better asking the question?

    Any help would be much appreciated.
  • They had an obligation to re-route you. You will have to look at your travel insurance for the return flight they are not responsible for that.

    Austrian Airlines from Vienna. They said it was the weather in the UK but on checking the weather was the best it had been for over a week.

    I assume that once the luggage got to Dusseldorf but got no further it would still be down to Austrian Airlines as they organised the flights?

    And also, therefore, their fault the luggage didnt turn up at Manchester until the Tuesday (we landed on the Monday).

    And the luggage has not been delivered until today Thursday despite Manchester airport saying it would be delivered yesterday (Wednesday) and I waited in all day for it until I got a txt at 4pm saying it would now be delivered today.

    on the good side my case did arrive at 11am this morning so I have been able to get some washing out.

    Hello! My daughter's Vueling flight was delayed for around 17 hours. Since the flight was from Brussels to Spain (so no UK airports) she claimed through Vueling, who denied the claim citing Regulation (CE) Nº 261/2004, DESPITE THE FACT that some friends on the same flight were compensated.
    I read the regulation which can be interpreted several ways, since it does say if the delay is not the airline´s fault, citing among other reasons passenger's safety, they are not responsible. The delay was due to a technical issue and I have read on this site compensation is due in such a case anyway.
    My question is: can she use RESOLVER even when the flight was not to or from London? I did research this and thought she could not.
    If anybody can suggest a similar site for a Brussels based flight or confirm she can use RESOLVER I would be most grateful.

    Hi Nokiya,

    1st point. There have been various court cases that have all come to the conclusion that technical faults are not a reason to deny compensation.

    2nd point. They would not have already paid some passengers compensation if they did not have to.

    Read Vaubans guide and send them a LBA/NBA.

    Thanks! Never heard of that before. Will pass on to my daughter. HOwever, at first sight I read it mentions the small claims court, and this is in Belgium.
    There were several people from the same party on that flight, and the others got their compensation. I believe the airline just paid to the first few to complain and then decided to fight the others.

    They are just 'trying it on' with your daughter, it won't go as far as a court hearing. It's just a matter of showing them you are serious and will not just go away, which they would just love you/her to do.

    Try phoning their CS number and stress to them that others have already been paid compensation and that you are prepared to take this to the regulator in Belgium. Also ask them if they are members of an ADR scheme, if yes, ask for a referral to them.

    I feel that some assertive pressure will get the right result.
